STPL-5112(020) BACKGROUND: Willdan provided construction management and inspection services for the federal funded Alosta Avenue Street Improvements Project No. STPL-5112(020). During construction, Staff identified additional locations within the project limits in need of repair. The additional scope of work increased the number of working days by 15 and required additional construction management, inspections, materials testing, labor compliance, federal-aid invoicing and administration in accordance with the Caltrans Local Assistance Procedures Manual (LAPM) and the City’s Quality Assurance Program. This action will authorize the City Manager to amend the professional services agreement with Willdan. RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1)Approve an agreement amendment in the amount of $7,923.30, which includes a 10% contingency for potential change orders, increasing the not-to-exceed amount to $90,216.30, in a form acceptable to the City Attorney, on behalf of the City; and APPROVED CITY COUNCIL 4/18/2022 Consideration of a Professional Services Agreement Amendment with Willdan for Construction Management and Inspection Services for the Alosta Avenue Street Improvements Project No. STPL-5112(020) April 18, 2022 Page 2 2) Authorize the City Manager to execute an agreement amendment with Willdan, in a form acceptable to the City Attorney, on behalf of the City. ANALYSIS: On November 1, 2021, the City awarded a professional services agreement to Willdan to provide construction management and inspection services for the federally-funded Alosta Avenue Street Improvements Project. The project rehabilitated the pavement on Alosta Avenue between Citrus Avenue and Barranca Avenue. The additional scope of work included sidewalk, drive approach, curb and gutter, striping, setting of survey monuments, and asphalt concrete paving on Powell Ave. The construction of the project was completed on March 3, 2022. Willdan continued to work on the federal reporting requirements per the Caltrans LAPM to close out the project and participated in the Post Construction Project Review with the Caltrans Oversight Engineer was held on April 13, 2022. FISCAL IMPACT: The amended professional services agreement with Willdan was in the amount of $82,293 which included a 10% contingency for potential change orders. The costs for the added scope of services are $7,923.30, which includes a 10% contingency for potential change orders. Staff requests a revised not-to-exceed amount to $90,216.30, which includes the original amount plus the added scope of services. The funding for the Alosta Avenue Street Improvements Project was included in the FY2021-22 Approved Capital Improvement Projects, and there is no fiscal impact. There are available FY2021-22 budgets of $226,545 under 1380000661/66116A-7172, $40,000 under 0480000661/66122B (Measure M), and $40,000 under 4680000661/66122A. This First Amendment to the Professional Services Agreement (“PSA”) (“First Amendment”) is entered into on the ____ day of April, 2022, by and between the City of Azusa, a municipal corporation organized under the laws of the State of California, with its principal place of business at 213 East Foothill Boulevard, Azusa, California 91702 (“City”) and Willdan, with its principal place of business at 13191 Crossroads Parkway North, Suite 405, Industry, CA 91746 (“Consultant”). City and Consultant are sometimes individually referred to herein as “Party” and collectively as “Parties”. 2.RECITALS. 2.1 Agreement. The Parties entered into that certain Professional Services Agreement dated November 1, 2021 ("Original PSA"), whereby Consultant agreed to render professional engineering services for the Alosta Avenue Street Improvements Project (“Project”). 2.2 First Amendment. The City now desires to amend the Original PSA to include additional construction management and inspection services for the added scope of work on the the Alosta Avenue Street Improvements Project. 3.TERMS. 3.1 Scope of Services and Term.
