The City Council of the City of Azusa met in Regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Blvd., Azusa, CA 91702. REGULAR SESSION Mayor Gonzales called the meeting to order at 7:30 P.M. CITY COUNCIL ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: BECKWITH, AVILA Jr., ALVAREZ, MENDEZ, GONZALES ABSENT: COUNCILMEMBERS: NONE The Pledge of Allegiance was led by Arturo Ortega, AUSD Superintendent Invocation was delivered by Pastor Griffin Harrel from Sandals Church. ALSO PRESENT Elected Officials: City Clerk Cornejo. Staff Members: City Manager Gonzalez, City Attorney Marco, Chief of Police Wenrick, Director of Administrative Services Johnson, Director of Public Works/City Engineer Delgadillo, Deputy City Manager DeAnda-Scaia, Director of Community Resources Carpenter, Director of Economic & Community Development Marquez, IT and Library Services Director Graf, Economic Development Specialist Campos, Planning Manager Munoz, and Chief Deputy City Clerk Garcia. CLOSED SESSION REPORT City Attorney Martinez reported there was no Closed Session, thus no reportable action. CEREMONIAL Mayor Gonzales and City Council awarded Azusa Chief Bertelsen a Certificate of Recognition for his 28 years of service and congratulations on his retirement. Representative Giselle Sorial of Senator Susan Rubio’s office presented Chief Bertelsen with a Certificate of Recognition for 28 years of service on the Azusa Police Department from Senator Rubio and the California State Senate. PUBLIC PARTICIPATION Arturo Ortega provided an update on the Azusa District recognizing advanced media students from Slauson Middle School for making two Shakey’s commercials and the Gladstone High School Medical Academy having been named a distinguished academy in the state of California. The Board of Education revisited school reorganizations and voted to make changes that can be found on the School District website. Please visit calendar page for upcoming events. Will Yih thanked City Council, and everyone involved with the Dear California event. Grant Power provided a brief introduction to the San Gabriel Valley Habitat for Humanity. REPORTS, UPDATES, AND ANNOUNCEMENTS FROM STAFF/COUNCIL 1.City Manager Gonzalez announced an invitation for businesses, residents, and community organizations to join the Mayor and City Council at the Stay of the City Event on Wednesday April 20th at 6 p.m. in the Auditorium with a short reception afterwards in the Courtyard; thanked and recognized Chief Bertelsen for his years of service. CONSENT ITEM E-1 APPROVED CITY COUNCIL 7/18/2022 2. Presentation on Mosquito “Bite Back” Campaign by Levy Sun, Director of Communications with SGV Mosquito & Vector Control District, and Presentation of Proclamation by Mayor Gonzales Proclaiming April 17-23, 2022 as California Mosquito Awareness Week in the City of Azusa. City Council Communications Mayor Pro-Tem Mendez reported the Joint Powers Authority (JPA) Gold Line Construction Authority there have been changes to the work order as the construction company has increased their fees dramatically which may cause the project to go back out to bid, this would extend the completion date and likely increase the costs. This past Saturday the Council took a facilities tour and thanks to the staff for providing donuts and coffee and for working on a Saturday. The tour gave a better understanding of repairs and upgrades needed. Councilmember Alvarez provided no comments. Councilmember Avila Jr. gave thanks to the staff for their participation in the tour on Saturday, and Mayor Gonzales for the prayer breakfast on April 13th. April 9th was Dear California, one of the little league teams and Sandals Church worked cleaning out the announcer’s booth and administrative offices of the Azusa National Little League facility. Councilmember Avila Jr. reported Ginger Antunez Children’s Librarian will be leaving and thanked her for the many programs she has been involved with through the years. Councilmember Beckwith reported the Bryan Clay Track Invitational was this past weekend. The Chamber of Commerce has a number of events coming up including a Texas Holdem’ event in May. Please check their website for more information. The City Manager will be speaking at the New Member Breakfast on April 23rd. Thank you to the team of Staff members who set up the facilities tour this past Saturday. Mayor Gonzales commented a big Congratulations to Chief Bertelsen, thanks to Sandals Church for the compost/mulch event held. It was good to see the community back out again. Saturday April 23rd will be the Arbor Day Celebration at Northside park at 8 a.m. planting trees 50 trees. Come out and help! Thanks to all those who came to the Mayor’s Prayer Breakfast and thank you to the AMA for helping to facilitate that event. Mayor Gonzales will be doing his first State of the City on Wednesday. SCHEDULED ITEMS 1. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ADDING SECTION (7) TO ARTICLE VII, SECTION 18-532 OF THE CITY OF AZUSA MUNICIPAL CODE TO AUTHORIZE LIMITED ESTATE SALES TO BE CONDUCTED IN THE CITY OF AZUSA. 1) Waive full reading, read by title only and introduce Ordinance No. 2022-01: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ADDING SECTION (7) TO ARTICLE VII, SECTION 18-532 OF THE CITY OF AZUSA MUNICIPAL CODE TO AUTHORIZE LIMITED ESTATE SALES TO BE CONDUCTED IN THE CITY OF AZUSA WITH THE FOLLOWING AMENDMENTS OF CHANGING THE LANUAGE: a) From diseased to residents of the property b) Deleting the phrase no Fee c) Deleting the second sentence of the second paragraph. City Manager Gonzalez provided information regarding authorizing individuals to hold a limited indoor estate sale and answered Council questions. Mayor Gonzales expressed concern for limiting this to only a situation for diseased family members as there may be other reasons needed for an indoor estate sale and felt if a permit needs to be obtained there should be a fee to cover administrative costs and requested an annual review next year. Councilmember Alvarez commented he doesn’t believe it is fair to charge people for having an indoor estate sale. Councilmember Beckwith likes the idea of expanding the idea to cover 3 life events within a calendar year with a possibly exempting the fee for the passing of a someone. Mayor Pro-Tem Mendez commented when 3rd parties get involved there is generally a large percentage charge for handling the sale and is in support of a once-a-year exemption of the fee and opening it up to more reasons than the death of a family member. Motion by Councilmember Beckwith to Waive full reading, read by title only and introduce Ordinance No. 2022-01 as amended above by Council, seconded by Mayor Pro-Tem Mendez, and carried by unanimous vote of City Council. Minutes of the Special City Council Meeting on October 25, 2021 was approved as written. 2. Resolution No. 2022-C29 was adopted allowing certain claims and demands and specifying the funds out of which the same are to be paid. 3. Personnel Action Requests in accordance with the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s) was approved. 4. Declaration of exempt surplus land is exempt from environmental review pursuant to the California Environmental Quality Act pursuant to CEQA Guidelines Section 15312 (Surplus Government Property Sales); and Resolution No. 2022-C30 declaring that the property located at 736 and 740 North Angeleno Avenue is exempt surplus land pursuant to Government Code Section 54221 (f)(1)(A) was approved. 5. Declaration of intent to dispose of the property located at 736 and 740 North Angeleno Avenue is exempt from environmental review pursuant to the California Environmental Quality Act; and Resolution No. 2022- C31 declaring that the public interest and convenience require the conveyance of property identified as 736 and 740 North Angeleno Avenue (Assessor Parcel Numbers 8608-021-901 and 8608-021-902), declaring the City’s intent to convey, and setting a public hearing to consider conveyance was approved. 6. Adoption of Resolution No. 2022-C32, ratifying the proclamation of a State of Emergency by Governor Newsom (March 4, 2020), and authorizing remote teleconference meetings of the Legislative Bodies of the City of Azusa pursuant to Assembly Bill 361 was approved. 7. Special Assistance funds to the Gladstone High School Baseball Program for associated expenses related to athlete uniforms, safety gear and equipment; and make a finding that the community at large will receive a public benefit from the expenditure of $200 was approved. 8. Receive, review, and file the City Treasurer’s Report for the month of February 2022 was approved. 9. Accept the grant award from the California Library Association; and approve necessary budget amendments and adjust the fiscal year budget accordingly was approved. 10. Agreement amendment in the amount of $7,923.30, which includes a 10% contingency for potential change orders, increasing the not-to-exceed amount to $90,216.30, in a form acceptable to the City Attorney, on behalf of the City; and Authorize the City Manager to execute an agreement amendment with Willdan, in a form acceptable to the City Attorney, on behalf of the City was approved. 11. Purchase of Motorola radio equipment in an amount not to exceed $199,346.00; and Approve the purchase of this product as authorized under AMC Section 2-520(a), which allows us to deem supplies or equipment needed to be compatible with existing equipment already in use or which have specific compatibility components with existing city products as exempt from the competitive bidding requirements was approved. 12. Equipment Rental Agreement with Southern California Association of Governments for the use of their Kit of Parts equipment as part of their Go Human active transportation encouragement campaign; and Authorize the City Manager to execute the agreement, in substantial form, subject to minor modifications acceptable to the City Attorney, on behalf of the City was approved. 13. Memorandum of Understanding (MOU) agreement with Azusa Golden Days nonprofit; and Authorize the City Manager to execute the amendments, in a form acceptable to the City Attorney, on behalf of the City was approved. 14. Waive the competitive bidding process as authorized under Azusa Municipal Code Section. 2-517(a)(14) – Attorney Services; and Approve the increase of Blanket Purchase Order 036259 to Debra L. Reilly in the amount not to exceed $75,000 for Legal Analysis and Investigative Services was approved. 15. Approve the project plans and specifications; and Authorize staff to solicit a Notice of Inviting Bids for the Arrow Highway Street Resurfacing and Highway Safety Improvement Project; Federal Project No. HSIPL- 5112(019) was approved. 16. The Professional Services Agreement Amendment No. 1 that will increase the monies with Elevated Entitlements to provide planning support services for the Planning Division; and Authorize the City Manager to prepare and execute the agreements, in a form acceptable to the City Attorney, on behalf of the City; and Approve necessary budget amendment and adjust the current fiscal year budget accordingly was approved. Motion by Mayor Pro-Tem Mendez to approve the Consent Calendar Items E1-E16, by, seconded by Councilmember Avila Jr., and carried by unanimous vote of City Council. AYES: COUNCILMEMBERS: AVILA Jr., MENDEZ, GONZALES, ALVAREZ, BECKWITH NOES: COUNCILMEMBERS: NONE ABSTAIN: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE CONSENT CALENDAR - SUCCESSOR AGENCY RELATED BUSINESS RESOLUTION AUTHORIZING PAYMENT OF WARRANTS BY THE SUCCESSOR AGENCY DATED MARCH 31, 2022 THROUGH APRIL 13, 2022. Mayor Gonzalez offered Resolution No. 2022-R06 entitled: A RESOLUTION OF THE SUCCESSOR AGENCY OF THE FORMER REDEVELOPMENT AGENCY OF THE CITY OF AZUSA ALLOWING PAYMENT OF WARRANTS TO BE PAID OUT OF SUCCESSOR AGENCY FUNDS. Moved by Agency Member Alvarez, seconded by Agency Member Beckwith, carried by unanimous vote of the Agency to adopt Resolution No. 2021-R06.
