HomeMy WebLinkAboutE-12 Staff Report - 2022 Jail renewalCONSENT ITEM E-12 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: ROCKY WENRICK, CHIEF OF POLICE DATE: SEPTEMBER 19, 2022 SUBJECT: AUTHORIZE FINAL EXTENSION OF CONTRACT FOR JAIL PRIVATIZATION SERVICES WITH ALLIED UNIVERSAL CORPORATION BACKGROUND: The Police Department is recommending extending contract services with Allied Universal for a period of one year. The renewal of this contract is based on the alternative purchasing procedure authorized under Section 2- 253(e) of the Azusa Municipal Code. Under that Section, competitive bidding is not required where a competitive bid procedure has been conducted by another public agency. Here, this requirement is fulfilled by the Request for Proposals to Provide the Operation of the Bell Police Department’s Type 1 Jail Facility completed by the City of Bell in September 3, 2013. The City Attorney’s office has reviewed and approved as to form the proposed renewal of the Operating Contract for the Azusa City Jail with the Allied Universal Corporation for a one year term, effective through June 30, 2023. California law authorizes general law cities to contract out the operation of their jail facilities. (See Penal Code, 6031.6; see also Costa Mesa Employees Association v. City of Costa Mesa (2012) 209 Cal. App. 4th 298, 310-311 (holding that Section 6031.6 of the Penal Code “expressly authorizes” general law cities to contract out jail services. RECOMMENDATION(S): It is recommended that the City Council take the following action(s): 1) Approve the renewal of the Operating Contract for the Azusa City Jail with the Allied Universal Corporation for a one-year term effective July 1, 2022. APPROVED CITY COUNCIL 9/19/2022 RENEWAL OF JAIL PRIVATIZATION SERVICES SEPTEMBER 19, 2022 Page 2 ANALYSIS: City Council originally approved of the privatization of Azusa’s City Jail with the Allied Universal Corporation (Formerly G4S, formerly Wackenhut Corporation) in July 1999 in terms of a five-year contract. The contract was renewed for five years in July 2004 and again in July 2009. In 2014 the contract was renewed for a three-year term with two additional optional one-year terms. Allied Universal provides the labor to operate Azusa’s Type 1 Jail on a year-round, 24 hour a day basis. Allied Universal’s performance over the past nineteen years has been commendable. Allied Universal’s jailers have thwarted many attempt suicides by inmates; they maintain the cleanliness of the jail facility and are in part responsible for the successful inspections by jail oversight entities (e.g. California Standards Authority, Grand Jury, Juvenile Court Commissioner, L.A. County Health and Fire Departments). Highlights of the contract include a minimum of two custody officers on duty for each shift 24 hours a day, one of the custody officers being female to be in compliance with regulations regarding female inmates, and one of the custody officers being bilingual in the Spanish language. FISCAL IMPACT: The approved FY 2022/23 budget includes $711,883.00 for services under 10-20-333-000-6493. Each year, any increases in the contract cost is negotiated by Staff and Allied Universal and is restricted as per the terms agreed upon in the contract.
