HomeMy WebLinkAboutE-20 Staff Report - Street Imp Bond AgreementCONSENT ITEM E-20 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: ROBERT DELGADILLO, PE, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE: SEPTEMBER 19, 2022 SUBJECT: REQUEST AUTHORIZATION TO APPROVE AN AGREEMENT FOR COMPLETION OF PUBLIC IMPROVEMENTS BETWEEN THE AVENUE LLC AND THE CITY OF AZUSA BACKGROUND: On September 12, 2018, the Planning Commission approved the project known as “The Avenue” (Lumia) located at 800 N. Azusa Ave. The project is required to construct certain public improvements which include but are not limited to resurfacing public streets, removing and reconstructing curb and gutter and sidewalks, and installing public utilities including water, sewer and storm drain. A Bond Agreement for the construction of these improvements is required to provide adequate financial security in the event the Developer or their Surety company fail to perform or construct the required improvements in accordance with City standards. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1) Approve Agreement for Completion of Public Improvements between the The Avenue LLC, and the City of Azusa. ANALYSIS: The Agreement for Completion of Public Improvements will serve as the instrument for the Developer to give the City of Azusa a one-year warranty against any defects or deficiencies in the public improvements constructed as part of “The Avenue” (Lumia) Project.
