The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Mayor Gonzales called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. Title: City Attorney REGULAR SESSION Mayor Gonzales called the meeting to order at 7:30 P.M. CITY COUNCIL ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: ALVAREZ, AVILA Jr., BECKWITH, GONZALES, MENDEZ ABSENT: COUNCILMEMBERS: NONE The Pledge of Allegiance was led by Superintendent Arturo Ortega. Invocation was delivered by Pastor Rick McDonald from Azusa House of Prayer, in Azusa. ALSO PRESENT Elected Officials: City Clerk Cornejo. Staff Members: City Manager Gonzalez, City Attorney Martinez, Chief of Police Wenrick, Deputy City Manager De Anda-Scaia, Planning Manager Munoz, Economic Development Specialist Campos, and Chief Deputy City Clerk Garcia CLOSED SESSION REPORT – The City Council convened at 6:30 P.M.; City Attorney Martinez reported the following regarding Closed Session: Item 1 and Item 2 – City Council provided feedback and no reportable action was taken. CEREMONIAL – None Mayor Gonzales remained on the dais and handed over the meeting to Mayor Pro-Tem Mendez due to him losing his voice. CONSENT ITEM E-1 APPROVED CITY COUNCIL 10/3/2022 PUBLIC COMMENT – Arturo Ortega, Superintendent of the Azusa Unified School District, provided highlights and updates on the school district. REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL City Manager Communications City Manager Gonzalez provided an update on how the City is working to combat drought and reduce water consumption. City Clerk: Request to set a time and date to hold interviews of Board and Commission Applicants City Clerk Cornejo shared that a total of 14 applications for Boards and Commissions were received, including 11 incumbents. He suggested some dates and times for Council to conduct interviews. Azusa Chamber of Commerce Year End Report and Presentation Steve Castro, Executive Director of the Azusa Chamber of Commerce, provided updates on how the Chamber is meeting deliverables as stated in the MOU. Mayor Gonzales asked Staff if quarterly updates or semi-annual updates on the Chamber of Commerce would be possible to ensure strong a partnership. Deputy City Manager De Anda-Scaia informed Council that the Chamber of Commerce does provide Staff with monthly breakdowns of the previous month’s activity, and this information can be shared with Council more frequently if requested. Mr. Castro presented a video message from the Chair of the Azusa Chamber of Commerce, Maureen Taylor. Council Comments Mayor Pro-Tem Mendez shared that he also attended the ICA conference. He congratulated Mayor Gonzales on the great turnout at the Kathy’s Cool Cuts event, going 14 years strong. Councilmember Alvarez suggested having an opening ceremony for the Golden Days parade at the October 3rd Council Meeting. Councilmember Avila thanked staff for all the hard work they put into having the previous outdoor council meeting. He thanked the library staff for hosting a successful mini-carnival. He thanked Jennifer Wu and the Azusa Police Department for hosting a great National Night Out. He thanked all Community Service staff for hosting the concerts in the park. He reported that he attended the Independent Cities Association Summer Session and briefly described the discussions they engaged in. Councilmember Beckwith shared that he attended the ICA conference and provided updates on coming events in September. Mayor Gonzales shared that an Azusa resident, Margaret Davis, will be celebrating her 100th birthday soon. He requested for the City Clerk’s department to prepare a certificate to commemorate her momentous birthday. He also requested for Staff and the City Attorney to look into a local preference ordinance for local vendors and local construction companies to be considered for projects within the city. SCHEDULED ITEMS – CITY COUNCIL 1. CONSIDERATION OF APPROVAL OF A SPECIAL EVENT PERMIT APPLICATION BY THE AZUSA CHAMBER OF COMMERCE TO HOST TASTE OF THE TOWN ON ALAMEDA AVENUE BETWEEN FOOTHILL BOULEVARD AND SANTA FE AVENUE. Economic Development Specialist Campos provided a presentation for the special event permit for the Chamber of Commerce to host Taste of the Town. In response to questions posed by Councilmember Beckwith, Economic Development Specialist Campos reported that plans for additional restrooms are being taken into consideration to accommodate an event of this size. She clarified that due to the ticket price and the set parameters for the alcohol vendors, this is an adult oriented event. Mayor Gonzales inquired if the fundraiser is for the Golden Days or the Chamber of Commerce. A representative from the Chamber clarified that the event is a fundraiser for the Chamber of Commerce, however it serves as a kick off event for the Golden Days Parade. Council provided direction for the applicant to look into providing a public benefit to the community, such as donation in good faith to the Golden Days Committee. Motion to approve Item D-1, 1) Authorization for the closure and use of the public right-of-way on Alameda Avenue between Foothill Boulevard and Santa Fe Avenue; 2) Authorization for the use of public parking lots located north of City Hall, the public parking located on the northwest corner of Alameda Avenue and Foothill Boulevard and the parking located at the Senior Center; 3) Authorization for the City Manager to execute the Special Event Permit Agreement with the Azusa Chamber of Commerce for Taste of the Town in a form acceptable to the City Attorney, on behalf of the City; and 4) Make a finding that the community at large will receive a public benefit from the expenditure of funds for the recommended items and waive associated costs, was made by Mayor Gonzales, seconded by Councilmember Beckwith, and carried by the unanimous vote of Council. DESIGNATION OF VOTING DELEGATE & ALTERNATE FOR THE LEAGUE OF CALIFORNIA CITIES 2022 ANNUAL CONFERENCE AND CONSIDERATION OF PROPOSED BYLAWS AMENDMENTS. Deputy City Manager De Anda-Scaia provided a staff report. Mayor Gonzales inquired who will be attending to the League of California. He nominated Councilmember Avila Jr. as the voting delegate and Councilmember Beckwith as the alternate. Motion to approve Item D-2, 1) Designate Councilmember Avila Jr. as the Voting Delegate and Councilmember Beckwith as the alternate for the League of Cities Annual Business Meeting, was made by Mayor Gonzales, seconded by Councilmember Alvarez, and carried by the unanimous vote of Council. FIRST READING OF ORDINANCE AMENDING VARIOUS PROVISIONS OF ARTICLE XI, DIVISION 2, CHAPTER 18 OF THE AZUSA MUNICIPAL CODE: RELATING TO THE CITY OF AZUSA MOBILE HOME RENT STABILIZATION REGULATIONS. City Attorney Martinez provided a staff report. In response to questions posed by Councilmember Beckwith, City Attorney Martinez explained the rent cap written in the revised ordinance draft. Discussion ensued regarding clarifications and amendments to the Azusa mobile home rent stabilizations regulations ordinance. Motion to approve Item D-3, 1) First Ready of Ordinance No. 2022-03: An ordinance of the City Council of the City of Azusa, California, amending various provisions of Article XI, Division 2, Chapter 18 of the Azusa Municipal Code relating to the City of Azusa Mobile Home Rent Stabilization Regulations, with the amendments to Section 3a, striking the language after the word “City”, and amending Section 8 rather than striking the language entirely, to leave language that would state that the Ordinance shall be reviewed from time to time by the City Council, was made by Mayor Gonzales, seconded by, and carried by the unanimous vote of Council. The minutes of the Special Meeting of April 25, 2022 and Regular Meetings of May 2, 2022 and May 16, 2022 were approved as written. 2. Resolution No. 2022-C53 allowing certain claims and demands and specifying the funds out of which the same are to be paid was adopted. 3. Personnel Action Requests in accordance with the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s) were approved. 4. Authorization for Staff to release the proposed Request for Proposals (RFP) for CalRecycle Payment Programs was approved. 5. Resolution No. 2022-C54, ratifying the proclamation of a State of Emergency by Governor Newsom (March 4, 2020), and authorizing remote teleconference meetings of the Legislative Bodies of the City of Azusa pursuant to Assembly Bill 361 was adopted. 6. Finding that the declaration of surplus property is exempt from environmental review pursuant to the California Environmental Quality Act; Adoption of Resolution No. 2022-C55 declaring that the property identified as APN: 8684-013-904 and APN: 8684-013-923 is surplus land and is no longer necessary for the City’s use; and Approving the form of the Notice of Availability attached to the resolution, and directing the City Manager to follow the procedures set forth in the Surplus Land Act, California Government Code Section 54220, et seq., as amended by AB 1486, for the lease of surplus land, were approved. 7. Acceptance of ‘The Orchard’ project located at (626 N. Azusa Ave) as outlined in 2017 Disposition and Development Agreement between the City and Azusa Block 36 LLC; Authorization for the City Manager to execute the Certificate of Completion, in a form acceptable to the City Attorney on behalf of the City; and Authorization for Staff to submit the Certificate of Completion for recordation to the Office of the County Recorder of Los Angeles County, were approved. 8. Resolution No. 2022-C56 approving the Azusa-RMC Joint Powers Authority Budget for Fiscal Year 2022-23 was adopted. 9. Acceptance of the grant award from the California Resources Recycling and Recovery’s (CalRecycle) SB 1383 Local Assistance Grant Program in amount of $70,912; the Second Amendment to the Memorandum of Agreement between the City of Azusa and San Gabriel Valley Council of Governments (SGVCOG) for the implementation of a Regional Edible Food Recovery Program in a form acceptable to City Attorney; and necessary budget amendments and adjust the appropriate fiscal year budget accordingly, were approved. 10. N/A 11. The City Treasurer’s Report for the month of June 2022 was received, reviewed, and filed. 12. Approve on a “month to month” basis an agreement based on the current contract while City Staff completes a new request for proposal for security services; and authorization for the City Manager to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City were approved. 13. Authorization for release of Request for Proposal for Dog Park Consulting Design Services was approved. 14. Professional Services Agreement with Guadagno & Sons to operate a three-day carnival for weekend of October 7-9, 2022; and Authorization for the City Manager to execute the Professional Services Agreement, in a form acceptable to the City Attorney, on behalf of the City, subject to non-substantive changes made by the City Manager and City Attorney were approved. 15. License Agreement with COLGATE Bright Smiles, Bright Futures to provide oral health outreach and screening visits, up to monthly, at City of Azusa Facilities; and Authorization for the City Manager to execute the License Agreement, in a form acceptable to the City Attorney, on behalf of the City, subject to non-substantive changes made by the City Manager and City Attorney were approved. 16. License Agreement with APU for Slauson Park Community Pool/ Azusa Aquatics Center; and Authorization for the City Manager to execute the use License Agreement in a form acceptable to the City Attorney, on behalf of the City, subject to non-substantive changes made by City Manager and City Attorney were approved. 17. Waive of purchasing procedures finding it in the city’s best interest to approve a sole source contract award to American Heavy Moving and Rigging, Inc; and Approval for the amount of $88,475 which includes a ten percent contingency amount; and Authorization for the use of up to $500,000 from the undesignated excess reserves were approved. Motion to approve Consent Calendar Items E-1 to E-17, was made by Mayor Gonzales, seconded by Councilmember Alvarez, and carried by the unanimous vote of Council. Barrios, Life-Long Azusa Resident. We adjourn in solemn honor of those Azusans who were lost to Covid-19.
