SUBJECT: PUBLIC HEARING - ADOPTION OF UPDATED CITYWIDE SCHEDULE OF FEES
AND CHARGES
BACKGROUND:
On January 19, 2016, the City Council adopted several resolutions approving certain adjustments to the
City’s Schedule of Fees and Charges. In addition, the City Council authorized Staff to adjust the schedule
of fees and charges annually based on the change in the Consumer Price Index (CPI) or 2%, whichever
was greater, but not to exceed 5%. The Los Angeles Area CPI change from September 2021 through
September 2022 was 7.8%. Because of the current high inflation environment, the current council approved
CPI capped of the 5% inflation adjustment rate will not allow the City to keep up with the most recent inflation
index from the Los Angeles area. Consequently, Staff would like to seek for council approval and update
the citywide schedule of fees and charges annually based on the percentage change of the Los Angeles Areas
consumer price index (CPI). If approved, the majority of the fees will increase by 7.8% consistent with the
latest Los Angeles area CPI. As part of the fee update, Staff would like to make other modifications to the
schedule of fees and charges that fall outside of the parameters of the previous direction provided by the
City Council.
The proposed action requests the City Council to adopt the fee modifications outlined in Attachment 4
which includes three tables: 1) New fees proposed; 2) Fees proposed to be modified by an amount other
than the previously directed CPI adjustment; and 3) Fees that are authorized under existing Azusa
Municipal Codes that are being incorporated in the fee schedule for documentation and reference
purposes.
RECOMMENDATIONS:
Staff recommends that the City Council take the following actions:
1)Receive, review, and file the updated Citywide Fee and Charges Schedule; and

2) Open the Public Hearing, receive public testimony, and close the Public Hearing; and
3) Authorize staff to update the fee schedule annually (Including the attached latest proposed fee
schedule with a 7.8% CPI adjustment for the majority of the fees) based on the percentage
change from the Bureau of Labor Statistic (BLS) Los Angeles area consumer price index (CPI);
and
4) Adopt Resolution No. 2023-C01, regarding various municipal activities and services, to be
effective on January 17, 2023; and
5) Adopt Resolution No. 2023-C02, regarding development project services fees, to be effective
60 days from January 17, 2023 (March 18, 2023).
ANALYSIS:
California Government Code 66000 allows public agencies to impose fees to recover the costs of
providing various public services. In an effort to keep current with the cost of providing services, the City
Council authorized Staff to implement the recommendations and fee adjustments from the latest fee study
adopted January 19, 2016.
The City Council also directed Staff to annually adjust the City’s Schedule of Fees and Charges by the
change in the Consumer Price Index - Los Angeles Area (CPI) with a minimum increase of 2% and a
maximum increase of 5% for most fee categories. The minimum increase of 2% is intended to mirror the
City’s labor cost of inflation. The City’s labor costs typically increase annually, even when there is a small
change in the CPI.
The Los Angeles area has experienced significant inflation during calendar year 2022, and even though
inflation has trended slightly down for the past two months, consumer prices are still at an all-time high.
The Federal Reserve will need more evidence to confirm and validate that inflation is on a sustained
downward path. It is widely expected that the Federal Reserve will keep rates higher through next year
(CY2023), and a potential rate hike at the February 1st, 2023 Federal Open Market Committee meeting.
Inflation was escalated mainly due to supply chain issues and enormous demand for goods during the
pandemic, Russia’s invasion of Ukraine impacting the energy prices, and the US government’s fiscal
stimulus. The exact policy path will depend on how inflation can be subdued, and at the best-case scenario,
without risks of a U.S. recession.
For the current review period, the CPI change from September 2021 through September 2022 was 7.8%.
As such, Staff is recommending Council to update the annual fee schedule with the percentage change
from the BLS Los Angeles area CPI annually. Furthermore, Staff is recommending Council to increase
the majority of the fees by 7.8% for the attached fee schedule included in the current review period.
Four (4) new fees are being proposed (Attachment 4, Table 1) to reflect new programs and/or to enhance
the City’s ability to provide services. The new fees include:
1) Item 24: Green Building Standard Fee (Building Division). $4 per $100,000 for each
permit valuation with appropriate fractions thereof. - The fee is required by SB1473
(Building Standards Administration Special Revolving Fund “BSASRF”) for the
adoption of building standards by State Agencies. The majority of the fees will be

collected and passed through to the State, and the City is allowed to keep 10% of the fees
specifically for related administrative costs and for code enforcement education.
2) Item 25: Strong-Motion Instrumentation and Seismic Hazard Mapping Fee (Building
Division). (a) Category 1 Construction (1 to 3 Story Residential – $ Permit valuation
amount x 0.00013) and (b) Category 2 Construction (Over 3 Story Residential & All
Commercial) - $ Permit valuation amount x 0.00028) - This fee is mandated by the State
Department of Conservation, and the funds are used primarily to produce seismic records,
data and record interpretations, and technical assistance.
3) Item S-054: Tentative Map Review (Engineering Division). Actual Staff Time. - To
recover the cost of staff time for plan check reviews.
4) Items 80-84: Carry Concealed Weapon (CCW) Fee (This Fee Exclude Live Scan Costs)
– Standard CCW-$190, Judicial CCW-$130, Reserve Peace Officer CCW-$80, CCW
Renewal-$100, CCW Duplicate/Modification-$10 (Public Safety Division)- California
CCW is a license to carry a concealed firearm in public, and the fee is established to
recoup State fees and staff time to process the application through the California
Department of Justice Bureau of Firearms.
There are seventeen (17) proposed fees to be modified by an amount other than the previously directed
CPI adjustment and higher than the 7.8% recommended CPI adjustment (Attachment 4, Table 2):
1) Item 35a: Recording Fees First Sheet (Engineering Division). From $8 to $15 - Updated
the fee to be consistent with the Los Angeles County Recording Fee amount.
2) Item 35b: Recording Fees-Additional Sheets, each (Engineering Division). From $2 to $3 -
Updated the fee to be consistent with the Los Angeles County Recording Fee amount.
3) Item S-112: Temporary Meter Rental Services: a) Meter Fee (per each meter) (Water
Utility). From $210 to $300 - To recover the actual cost of meter which has gone up in
price. The supplier increased the price of the meter, and this is a pass-through cost.
4) Item S-131D: Water Meter Fee a) 3/4 " (Water Utility). From $250 to $300 - To recover
the actual cost of meter from Sensus which has gone up in price. The supplier increased
the price of the meter, and this is a pass-through cost.
5) Item S-131D: Water Meter Fee: b) 1 " (Water Utility). From $300 to $350 - To recover
the actual cost of meter from Sensus which has gone up in price. The supplier increased
the price of the meter, and this is a pass-through cost.
6) Item S-131D: Water Meter Fee: c) 1.5 " (Water Utility). From $1,250 to $1,500 - To
recover the actual cost of meter from Sensus which has gone up in price. The supplier
increased the price of the meter, and this is a pass-through cost.
7) Item S-131D: Water Meter Fee: d) 2 " (Water Utility). From $1,500 to $1,700 - The fee
increase is to recover the actual cost of meter from Sensus which has gone up in price.
The supplier increased the price of the meter, and this is a pass-through cost.
8) Item S-131F: Fire Hydrant Relocation/Inspection Fee a) Impact Fee (Water Utility).
From $2,000 to $2,500 - The fee increase is to recover the initial labor and 20% increase
in material costs for Fire Hydrants.

9) Item S-131G: Traffic Incident Hit Hydrant Impact Fee a) Impact Fee (Water Utility). From
$2,000 to $2,500 - The fee increase is due to material cost increase to repair water main from
traffic accidents
10) Item S-131G: Traffic Incident Hit Hydrant Impact Fee c) Damage to Water Main Impact
Fee (Water Utility). From $2,000 to $2,500 - The fee increase is to recover the damage
and impact to the water main and current cost of water supply has also increased due to
the drought.
11) Item S-131G: Traffic Incident Hit Hydrant Impact Fee e) Damage to Water Facilities
Impact Fee (Water Utility). From $2,000 to $2,500 - To recover the damage and impact
to the water facilities and current cost of water supply has also increased due to the
drought.
12) Item S-116A: Water Plan Check (Water Utility). From $250 to $300 - The fee increase
is to recover cost of labor and multiple site inspections per project submittal.
13) Item S-119: Sewer Dye Test (Water Utility). From $120 to $150 – The fee increase is to
cover higher costs of actual material used for testing and labor costs
14) Item S-131M: Plan Check Fees a) Residential & ADU Per Dwelling Unit (Water Utility).
From $250 to $300 - The fee increase is to recover cost of labor and multiple site
inspections per project submittal.
15) Item 9: Burglar False Alarm Response-Registered Alarm c) Third Response (Police
Department). From $125 to $150 - Department has not updated this fee for quite some
time. Conducted survey of neighboring agencies and validated the proposed Azusa fees
are in line with neighboring agencies fees with the fee increases.

Department). From $175 to $200 - Department has not updated this fee for quite some

There are fourteen (14) fees that are authorized under existing Azusa Municipal Codes that are being
incorporated in the fee schedule for documentation and reference purposes. (Attachment 4, Table 3):
1) Section S14-7: Park and recreation redevelopment fee. 1 Bedroom $150, 2 Bedrooms
$300, 3 Bedrooms $450, 4 Bedrooms $600, and Mobile Home Units $150 (Parks
Division). - Approved by Azusa Municipal Code 14-7.
2) Section S133: Application Fee - New Business & Miscellaneous f) Commercial Rentals
- Rental with rental amount under $20,000 = $90 and Rental with rental amount over
$20,000 = $90 (from $0 to $20,000) + 95 cents ($0.95) per $1,000 on rental amounts over
$20,000 annually (Business License Division) - Approved through Azusa Municipal
Code 18-704.

FISCAL IMPACT:
The adoption of the proposed fee schedule is anticipated to allow cost recovery of various City services
without depleting the City’s funds, and are contingent on the timing of various development projects and
municipal activities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA, CALIFORNIA, APPROVING AND ADOPTING A
REVISED SCHEDULE OF FEES AND CHARGES FOR VARIOUS
MUNICIPAL ACTIVITIES AND SERVICES
WHEREAS, under the police power granted by Article XI, Section 7 of the California
Constitution, the City of Azusa is authorized to impose reasonable service fees for a variety
municipal benefits and services; and
WHEREAS, the City Council of the City of Azusa previously determined that the
users of these services should be charged fees to recover the City's expenses for providing
these services; and
WHEREAS, the City Council previously adopted Resolution No. 2022-C01, which
established fees for various municipal activities and services; and
WHEREAS, the City Council has determined that in order to continue providing
effective services for the public welfare, it is necessary to adopt a revised Schedule of Fees
and Charges which sets forth fees for City services; and
WHEREAS, based upon evidence provided, the City Council hereby determines that
the proposed fees cover, but do not exceed, the reasonable cost of providing the services for
which the fee is charged; and
WHEREAS, the City Council has determined that the proposed Schedule of Fees
and Charges is statutorily and categorically exempt from the requirements of the California
Environmental Quality Act since citing these fees fit within the statutory exemptions for local
agency decisions involving the adoption and collection of rates, tolls and other charges,
pursuant to Public Resources Code Section 21080(b)(8) and Section 15273 of the California
Environmental Quality Act Guidelines.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa,
California does hereby find, determine and declare as follows:
SECTION 1. A doption of Schedule of Fees and Ch arges. The City Council
approves and adopts the Schedule of Fees and Charges (the "Schedule"), which is attached
hereto as Exhibit "C" and incorporated herein by reference. The adopted fee schedule shall
supersede any fees and charge schedule previously adopted.
SECTION 2. Findings. The City Council finds that the fees and charges set forth in
the Schedule attached as Exhibit "A": (1) have a reasonable relationship with the City's costs
in providing and maintaining those services and facilities; and (2) are necessary to enable the
City to continue providing and maintaining the services and facilities to which they relate.
SECTION 3. Repeal of Prior Resol ution . Resolution No. 2022-C01 is hereby repealed in its
entirety.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

SERVICE CHARGES
WHEREAS, under the police power granted by Article XI, Section 7 of the California
Constitution, the City of Azusa is authorized to impose fees, charges and rates for certain
municipal services; and
WHEREAS, in addition to the authority granted by the California Constitution, Chapter
8 (commencing with section 66016) of Division 1 of Title 7 of the California Government Code
establishes a procedure for adopting fees or service charges for development projects; and
WHEREAS, pursuant to Resolution No. 2022-C02, adopted on January 18, 2022, the
City currently imposes development related fees upon applicants to recover the costs of staff
time, inspection, copying costs and other expenses related to the review and processing of
applications for property development; and
WHEREAS, many of the City's current fees charged for development services no longer
reflect the actual cost of providing such services; and
WHEREAS, Government Code sections 66016 and 66018 provide that the City may
adopt new development fees or increase existing fees after providing notice and holding a public
hearing; and
WHEREAS, notice of a public hearing on the establishment of new and revised fees was
published in accordance with provisions of section 6062a of the California Government Code;
and
WHEREAS, notice of public hearing was mailed to all interested parties who filed
a written request for a mailed notice with the City, or a waiver of notice was obtained; and
WHEREAS, on January 17th, 2023, at the time and place specified in the published
and mailed notices, the City Council held a public hearing as required by law to allow oral or
written presentations prior to levying new development fees or service charges and prior to
approving an increase in existing development fees or service charges; and
WHEREAS, at least ten (10) days prior to the commencement of the hearing, there was
made available to the public a report containing the cost, or estimated cost, of providing the
service for which the fee or service charge will be levied, and the revenue sources for providing
such services; and
WHEREAS, based upon evidence provided, the City Council hereby determines that the
development services fees set forth in the Schedule of Fees and Charges attached hereto and

incorporated herein by reference will not exceed the estimated reasonable cost of providing the
property development services for which the fee is charged; and

Carry Concealed Weapon (CCW) ‐ California CCW is
a license to carry a concealed firearm in public, and
the fee is established to recoup State fees and staff
time to process the application through the
California Department of Justice Bureau of
Firearms. In accordance to State penal code 26155
(a) ‐ When a person applies for a license to carry a
pistol, revolver, or other firearm capable of being
concealed upon the person, the Chief or other
Head of municipal policy department of any city or
city and county may issue a license to that person
upon proof of the following:
a) The applicant is of good moral character.
c) The applicant is a resident of that City.
d) The applicant has completed a course of training
as described in Section 26165.
Please note that although Penal Code Section
26155 also contains a requirement that an
applicant demonstrate "good cause" exists for the
issuance of a CCW license, the U.S. Supreme
Court's ruling in New york State Rifle & Pistol
Asslociation V. Bruen held that New York's similar
"proper cause" requirement was unconstitutional.
Therefore, pursuant to Bruen, Azusa Police
Department will not enforce the "good cause"
requirement and will not require an applicant to
demonstrate "good cause" to qualify for a CCW
license.

Mapping Fee ‐ Building Division
This fee is a state mandate by the State
Department of Conservation. The information
gathered by CSMIP is processed and disseminated
to seismologists, engineers, building officials, local
governments and emergency response personnel
throughout the state. The data is used to develop
recommended changes to seismic provisions of
building codes, to assist local governments in their
general plan process and to aid emergency
response personnel in the event of a disaster.
CSMIP is funded by a portion of local government
building permit fees, with additional funding from
other State and Federal agencies. Strong motion
fees fund the procurement, installation,
maintenance, data review collection and
interpretation of collected data from seismic
instrumentation placed in geographic
environments throughout the state. The results of
this work are seismic records, data and record
interpretations, and technical assistance for the
construction industry.

ambulance transportation as of July 1, 2022, as per section 7.16.340,
Modification of Rates, of the County Ordinance (attachment I).
Transportation services provided on or after July 1, 2022 may not be
billed above the allowable maximum rates per the attached rate
schedule.

Section 7.16.280 Rate Schedule For Ambulances
A.A ground ambulance operator shall charge no more than the following rates for one patient:
Rates Effective July 2022
1.Response to a non-emergency call with equipment and personnel at
an advanced life support (ALS) level
2.Response to an emergency 9-1-1 call with equipment and personnel at
an advanced life support (ALS) level
3.Response to a nonemergency call with equipment and personnel at a
basic life support (BLS) level
4.Response to an emergency 9-1-1 call with equipment and personnel at
a basic life support {BLS) level
5.Mileage rate. Each mile or fraction thereof
6.Waiting time. For each 30-minute period or fraction thereof after the
first 30 minutes of waiting time at the request of the person hiring the
ambulance
7.Standby time. The base rate for the prescribed level of service and, in
addition, for each 30-minute period or fraction thereof after the first 30
minutes of standby time

B.Where other special services are requested or needed by any patient or authorized representative thereof.a
reasonable charge commensurate with the cost of furnishing such special service may be made, provided
that the ambulance operator shall file with the Director of the Department of Health Services a schedule of
each special service proposed and the charge therefore. which charge shall be effective unless modified,
restricted, or denied by the Director of the Department of Health Services. Special services are defined as
services provided to a patient that are unique and individual to a specific patient's needs and are performed
on a limited basis.
C.Charges for special services provided to patients that are new services, but will become an industry
standard, must be reviewed and a rate commensurate with the service developed prior to ambulance
operators charging such rate to the general public. Such rates shall not be charged to patients until approved
by the Board of Supervisors.
D.This section does not apply to a contract between an ambulance operator and the County where different
rates or payment mechanisms are specified.
Section 7 .16.340 Modification of Rates.
The maximum rates chargeable to the general public as set forth in Sections 7.16.280 and 7.16.310 of this
chapter shall be adjusted effective July 1. 1992. and on July 1st of each year thereafter, to reflect changes
in the value of the dollar. For each of the one year periods respectively beginning July 1. 1992 and July I.
1993 such adjustments shall be made by multiplying the base amounts by the percentage change in the
transportation portion of the Consumer Price Index for AH Urban Consumers, Western Region, as
compiled and reported by the Bureau of Labor Statistics for the 12-month period ending with the last day
of the prior month of February. Beginning July 1, 1994. and on each July 1 thereafter. such adjustments
shall be determined by multiplying the base amounts by the average of the percentage changes of the
transportation portion and of the medical portion of the Consumer Price Index for All Urban Consumers�
Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12-month period
ending with the last day of the prior month of February. Beginning July 1. 2017. and on every July 1
thereafter. such adjustments shall be determined by multiplying seventy-five (75) percent of the base
amounts by the percentage change of the minimum wage change in Los Angeles County as defined in
County Code Section 8.100 .040 -Minimum Wage and by multiplying twenty-five (25) percent of the
base amounts by the percentage change of the Medical Care line item of the Consumer Price Index for all
Urban Customet·s. Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12-
month period ending with the last day of the prior month of February, except for the following changes:
Registered Nurse/Respiratory Therapist per hour after the first three (3) hours adjustment shall be
determined by multiplying the current charge by the percentage change of the minimum wage change in
Los Angeles County as defined in County Code Section 8.100 .040 -Minimum Wage: mileage aqjustment
shall be determined by multiplying the current charge for the percentage change of the transpo1tation line
item of the Consumer Price Index for All Urban Customers, Western Region. as compiled and reported by
the Bureau of Labor Statistics fot· the 12-month period ending with the last day of the prior month of
February: and Oxygen_ Disposable Medical Supplies, and a Ventilator adjustment shall be determined by
multiplying the current charges by the percentage change of the Medical Care line item of the Consumer
Price Index for all Urban Customers, Western Region, as compiled and reported by the Bureau of Labor
Statistics for the 12 month period ending with the last day of the prior month of February. The result so
determined shall be rounded to the nearest whole number and added or subtracted, as appropriate, to the

initiate implementation of these rate changes by notifying in writing each licensed private ambulance
operntor in Los Angeles County thereof, and any other individual or agency requesting such notification
from the Director. Such notice shall be sent by first class mail no later than June 15 of the prior period.
