CORNEJO, CITY CLERK ADRIAN GARCIA, MMC, CHIEF DEPUTY CITY CLERK DATE: FEBRUARY 6, 2023 SUBJECT: ADOPT RESOLUTION NO. 2023-C07 AMENDING AND RESTATING RESOLUTION NO. 2010-C20 CONCERNING THE SELECTION CRITERIA AND TERM OF THE MAYOR PRO TEM AND SELECTION OF MAYOR PRO TEM. BACKGROUND: To comply with State Law and in an effort to increase voter turnout, on August 16, 2021 the City Council adopted Ordinance No. 2021-04, Changing the City General Municipal Election Date from March of even-numbered years to the Statewide and Presidential General Election, Commencing with November, 2022 Election. As a result, council reorganization, including the rotation of Mayor Pro Tem and appointment to regional boards and committees needed to be modified in order to provide an equal and apportioned amount of time for each councilmember. At its meeting of January 17, 2023, the City Council directed staff to return with a resolution to allow for the change. Resolution No. 2023-C07, will establish new criteria for the selection of Mayor Pro Tem. A Mayor Pro Tem is to be selected on the third Monday in January, and should be the Council Member with the greatest seniority that has not previously served in that capacity. The Mayor Pro Tem shall serve from January until January of each succeeding year. RECOMMENDATIONS: Staff recommends the City Council take the following action: 1)Adopt Resolution No. 2023-C07, amending and restating Resolution No. 2010-C20 Concerning the Selection Criteria and Term of the Mayor Pro Tem; and 2)Approve the selection of Councilmember Dennis Beckwith, as Mayor Pro Tem for a one-year term, expiring January 2024. ANALYSIS: This action will adopt Resolution No. 2023-C07 and approve the selection of a Mayor Pro Tem for the period of February, 2023 through January, 2024. Based upon the previous rotation established by the City Council, Councilmember Beckwith would be next in line. Mendez (Appointed to office in 2020, Elected to office in 2022): March 2022 through March 2023 Council Member Dennis Beckwith (Appointed to office in 2021, Elected to office in 2022): Not yet served FISCAL IMPACT: No Fiscal Impact. BE IT RESOLVED by the City Council of the City of Azusa as follows: SECTION I. That the City Council of the City of Azusa hereby amends Resolution No. 10-C20 in its entirety and adopts the following mayor pro tern selection criteria and term of office. (1)Intent. The primary intent of this Resolution is to ensure that the city's mayor pro tern is selected on objective criteria. Criteria such as seniority and public support as expressed in the number of votes received in an election are to be used as the basis for selecting the mayor pro tem. It is the Council's intent to ensure that each council member serving on the Council receives the opportunity to serve as mayor pro tem at least once during his or her four-year term as a council member. (2)Selection Criteria. Annually, at the City Council meeting on the third Monday in January, the mayor pro tem shall be that council member with the greatest seniority, which has not previously served as mayor pro tem. However, if such council member does not accept the nomination for mayor pro tem, then the next most senior council member, which has not yet served as mayor pro tem, shall be offered the position of mayor pro tem. However, if two or more councilmembers qualify for the position of mayor pro tem by virtue of having equal seniority, then that council member who received the highest number of votes in the November General City Election shall be the mayor pro tem. (3)Selection Criteria in the Event All Have Served. If all council members have previously served as mayor pro tem, then the mayor pro tem shall be that councilmember with the greatest seniority. If such councilmember does not accept the nomination for mayor pro tem, then the next most senior councilmember shall be offered the position of mayor pro tem. However, if two or more council members qualify for the position of mayor pro tem by virtue of having equal seniority, then that council member who received the highest number of votes in the November General City Election shall be the mayor pro tem. Attachment 1 (4) Term. Mayors Pro Tem shall serve from January until January of each year succeeding year. A new successor shall be selected on the third Monday in January of every year. Notwithstanding this section, the mayor pro tem shall continue to serve until his or her successor takes office. SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
