JIMENEZ, DIRECTOR OF ECONOMIC & COMMUNITY DEVELOPMENT DATE: APRIL 3, 2023 SUBJECT: REQUEST TO INCREASE FISCAL YEAR 2022/2023 BLANKET PURCHASE ORDER WITH BEST BEST & KRIEGER, LLC. FOR LEGAL SERVICES PROVIDED TO THE CITY OF AZUSA COMMUNITY IMPROVEMENT DIVISION BACKGROUND: In accordance with the Contract provisions of Sec. 2-518 (a) of the Azusa Municipal Code, contracts over $50,000 require the review and consideration of the City Council. The Community Improvement Division is requesting authorization to increase the Community Improvement Division’s Fiscal Year 2022/23 Blanket Purchase Order (“BPO”) 037794 from $45,000 to $73,000 for legal services performed by Best Best & Krieger, LLC. This request can be accommodated through the previously approved Department budget. RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1)Waive the competitive bidding process as authorized under Azusa Municipal Code Section. 2-517(a) (14) – Attorney Services; and 2)Approve the increase of Blanket Purchase Order 037794 with Best Best & Kreiger, LLC. in the amount not-to-exceed $73,000 for Legal Services. ANALYSIS: The City of Azusa’s Community Improvement Division works concurrently with Best Best & Kreiger for legal services relating to code enforcement matters within the City. When dialogue initiated to fund this purchase order, an estimate was derived based on the anticipated needs of the City at the start of the fiscal calendar. As the year has progressed, Community Improvement Staff has been at the forefront of various code-related matters, this has resulted in the need of the Division to work closely with BBK to obtain legal Approved City Council April 3, 2023 Request to Increase Fiscal Year 2022/2023 Blanket Purchase Order - BBK April 3, 2023 Page 2 resources to aide in the compliance process, such as the case that recently went to the City Council regarding an abatement matter. Therefore, staff is requesting that the City Council consider and determine that this request is in compliance with the Contract provisions of Sec. 2-518 (a) of the Azusa Municipal Code and increase BPO 037794, not to exceed $74,000. FISCAL IMPACT: Funding for this request was included in the FY2022-23 approved budget under the Economic and Community Development’s Account Number 1035643000-6301.
