In compliance with Government Code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Foothill Blvd.; copies for public view are at the Azusa City Library - 729 N. Dalton Ave., Azusa Police Department Lobby - 725 N. Alameda Ave., and the City of Azusa Web Page www.azusaca.gov. Persons who wish to speak during the Public Participation portion of the Agenda or on a Public Hearing item, shall fill out a card requesting to speak and shall submit it to the City Clerk prior to 7:30 P.M.; cards submitted after this time will not be accepted. Those wishing to participate during Public Comment may do so in-person at the Azusa Auditorium, or may submit written public comments by emailing PublicComment@azusaca.gov. Emailed public comments are due by 5:30 p.m. and shall be limited to no more than 250 words. Written public comments will be provided to the City Council and will be part of the record but will not be read aloud. Archived video of recorded meetings is also available on the City website. Notice Regarding California Environmental Quality Act (CEQA) Determinations. Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items listed or not listed on this Agenda. Members of the audience will have the opportunity to address the City Council/Agency Board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the Council/Agency Board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments may be handled after the speaker has completed his/her comments. CONSIDERATION OF A SPECIAL EVENT PERMIT APPLICATION BY A5 EVENTS ON BEHALF OF ONELEGACY TO CONDUCT A ONE AND FIVE KILOMETER RUN-WALK FAMILY FESTIVAL IN CONJUNCTION WITH AZUSA PACIFIC UNIVERSITY AND ADOPT A RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE OF CERTAIN CITY OF AZUSA STREETS IN THE ROSEDALE AREA. RECOMMENDED ACTION: 1) Authorize the City Manager to execute the Special Event Permit Agreement for OneLegacy’s Donate Life 1K/5K Run Walk, operated by A5 Events, in a form acceptable to the City Attorney, on behalf of the City; 2) Authorize the City Manager to execute the Reimbursement Agreement for OneLegacy’s Donate Life 1K/5K Run Walk, operated by A5 Events, in a form acceptable to the City Attorney, on behalf of the City; and 3) Adopt Resolution No. 2023-C19 authorizing the closure of certain City of Azusa streets as discussed hereing for a limited time, in order to allow for the event to take place. CONSIDERATION OF APPROVAL OF A SPECIAL EVENT PERMIT APPLICATION AND WAIVER OF FEES BY AZUSA HIGH SCHOOL TO ALLOW FOR A PUBLIC FIREWORKS DISPLAY AT AZUSA HIGH IN CONJUNCTION WITH A COMMENCEMENT CEREMONY ON JUNE 6, 2023. RECOMMENDED ACTION: 1) Consider and approve Azusa High School’s request for a Special Event Permit to allow for a one-time firework display in conjunction with commencement activities on June 6, 2023; 2) Authorize the City Manager to execute the Special Event Permit Agreement with Azusa High School in a form acceptable to the City Attorney, on behalf of the City; and 4/17/2023 - 4 - 3) Make a finding that the community at large will receive a public benefit from the expenditure of funds for the recommended items and waive associated costs. CONSENT CALENDAR – CITY COUNCIL The Consent Calendar adopting the printed recommended actions will be enacted with one vote. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED MARCH 30, 2023 THROUGH APRIL 12, 2023. RECOMMENDED ACTION: Adopt Resolution No. 2023-C20 allowing certain claims and demands and specifying the funds out of which the same are to be paid. Total Cost: N/A Is the cost of this item budgeted? RECOMMENDED ACTION: Approve the following Personnel Action Requests in accordance with the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s). Total Cost: N/A Is the cost of this item budgeted? N/A Fund/Account No: N/A 4. APPROVE AREA D REGIONAL COMMUNITY EMERGENCY REPSONSE TEAM (CERT) MUTUAL AID AGREEMENT. RECOMMENDED ACTION: Adopt the Area D CERT Mutual Aid Agreement; and Authorize the City Manager to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. RECOMMENDED ACTION: Award contracts per Request for Proposals (RFP) for Police Tow, Impound and Referral Tow Services to: a. Royal Coaches Auto Body & Towing, 208 N. Aspan Ave., Azusa, California 91702; and b. Jan’s Towing, 1045 W. Kirkwall Ave., Azusa, California 91702 Authorize the City Council to approve the Professional Services Agreement for the contract with Royal Coaches Towing and Jan’s Towing for tow truck services; and Authorize the City Manager to authorize the extension of the contracts for three additional one-year terms upon recommendation from the Police Department. AUTHORIZATION TO ISSUE CITY SERVICE REQUEST WITH LOS ANGELES COUNTY PUBLIC WORKS FOR THE VINCENT COMMUNITY BIKEWAYS PROJECT. RECOMMENDED ACTION: Authorize the Director of Public Works/City Engineer to issue a City Service Request with Los Angeles County Public Works for the Vincent Community Bikeways Project for an amount not to exceed $43,400. RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE 2022 AND 2023 RESIDENTIAL ROADWAY REHABILITATION PROJECT; REJECTION OF BID PROTEST; AND APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH WILLDAN FOR INSPECTION SERVICES. RECOMMENDED ACTION: Adopt a Resolution No. 2023-C21 authorizing an award of contract in the amount of $2,558,716, which includes a 10% contingency for potential change orders as needed, to the lowest responsible bidder, Toro Enterprises, Inc., submitting a responsive bid; Reject the bid protest from the second lowest bidder, Kalban.; Approve a professional services agreement in the amount of $56,012.00, which includes a 10% contingency for potential change orders as needed, to Willdan; and Authorize the City Manager to execute the project contract, in a form acceptable to the City Attorney, on behalf of the City. REQUEST TO APPROVE PURCHASE ORDER WITH LOS ANGELES COUNTY REGISTRAR- RECORDER/COUNTY CLERK FOR ELECTION SERVICES ASSOCIATED WITH CONDUCTING THE NOVEMBER 8, 2022 GENERAL MUNICIPAL ELECTION FOR THE CITY OF AZUSA. RECOMMENDED ACTION: Approve the Purchase Order and Invoice No: 23-2071 with Los Angeles County Registrar-Recorder/County Clerk in the amount of $74,119.32 for Conducting the November 8, 2022 General Municipal Election. Total Cost: $74,119.32 Is the Cost of this item budgeted? Yes Fund/Account No: Election-1015210000-7060. 9. CITY TREASURER’S STATEMENT OF CASH AND INVESTMENT BALANCES FOR THE MONTH OF FEBRUARY 2023. RECOMMENDED ACTION: Receive, review, and file the City Treasurer’s Report for the month of February 2023. Total Cost: N/A Is the Cost of this item budgeted? N/A Fund/Account No: N/A 10. AWARD A CONTRACT FOR THE ARROW HIGHWAY PARKWAY & MEDIAN LANDSCAPE IMPROVEMENTS PROJECT – PHASE II; AND ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE CITY OF COVINA. RECOMMENDED ACTION: Award a contract in the amount of $1,945,183.73, which includes a contingency in the amount of $105,125.48 for potential change orders as needed, to KASA Construction; Authorize the City Manager to execute a Memorandum of Understanding with the City of Covina for a not to exceed amount of $698,569.70 for the construction of the Arrow Highway Parkway and Median Landscape Improvements within Covina’s jurisdiction; and Authorize the City Manager to execute contracts, in a form acceptable to the City Attorney, on behalf of the City. Fund/Account No: LACMTA Local-Return Funds per Exchange Agreement (STP-L Funds Balance) Measure M Funds. 11. AZUSA POLICE DEPARTMENT PARKING LOT IMPROVEMENT BLOCK WALL AND ENTRY GATES. RECOMMENDED ACTION: Approve a purchase order with Robert’s Iron Works Inc. in an amount not-to-exceed $98,265.00 and a 10% contingency not-to-exceed $9,826.00 for potential change orders as needed. APPROVE PROPOSAL AND AUTHORIZE THE CITY MANAGER TO ENTER INTO A FIVE YEAR CONTRACT WITH LENSLOCK TO PROVIDE SECURITY CAMERAS FOR THE LIBRARY, CITY HALL AND SENIOR CENTER. RECOMMENDED ACTION: Approve the proposal for Lenslock security camera system; Authorize the City to enter into a Professional Services Agreement with Lenslock to complete the security camera project; and Authorize a budget amendment for an increase of $199,828.13 over the course of the five year contract to cover the cost of the contract with Lenslock in the amount not to exceed one hundred ninety-nine thousand eight hundred twenty- eight dollars and thirteen cents.
