Roll Call CLOSED SESSION NOTICE TO THE PUBLIC FOR CLOSED SESSION Prior to going into closed session, the City Council will convene in the Auditorium serving as Council Chambers to take public comment on the closed session items only. General public comment will be provided for during the regular portion of the meeting beginning at 7:30 P.M. 1. PUBLIC EMPLOYEE DISCIPLINE/DISMISSAL/RELEASE – Pursuant to California Government Code Section 54957. 5/1/2023 - 2 - 7:30 P.M. - REGULAR MEETING OF THE CITY COUNCIL, THE SUCCESSOR AGENCY, THE PUBLIC FINANCING AUTHORITY NOTICE TO THE PUBLIC FOR REGULAR MEETING. In compliance with Government Code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Foothill Blvd.; copies for public view are at the Azusa City Library - 729 N. Dalton Ave., Azusa Police Department Lobby - 725 N. Alameda Ave., and the City of Azusa Web Page www.azusaca.gov. Persons who wish to speak during the Public Participation portion of the Agenda or on a Public Hearing item, shall fill out a card requesting to speak and shall submit it to the City Clerk prior to 7:30 P.M.; cards submitted after this time will not be accepted. Those wishing to participate during Public Comment may do so in-person at the Azusa Auditorium, or may submit written public comments by emailing PublicComment@azusaca.gov. Emailed public comments are due by 5:30 p.m. and shall be limited to no more than 250 words. Written public comments will be provided to the City Council and will be part of the record but will not be read aloud. Archived video of recorded meetings is also available on the City website. Notice Regarding California Environmental Quality Act (CEQA) Determinations. Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. Closed Session Report by the City Attorney CEREMONIAL 1) Proclamation proclaiming May 2023 as Older Americans Month in the City of Azusa. 2) Proclamation proclaiming the week of May 1-6, 2023 as National Small Business Week in the City of Azusa. 3) Proclamation proclaiming the week of May 1-6, 2023 as the 54th Annual Municipal Clerks Week in the City of Azusa. 4) Proclamation proclaiming the week of May 7-13, 2023 as Public Services Employee Recognition Week in the City of Azusa. 5) Certificate of Recognition to Azusa Connects, Redeemed Life Church, Athens Services, and Azusa Beautiful for their participation in April Clean & Green Month and Clean California Community Day. 5/1/2023 - 3 - B. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items listed or not listed on this Agenda. Members of the audience will have the opportunity to address the City Council/Agency Board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the Council/Agency Board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments may be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes. C. REPORTS, UPDATES, AND ANNOUNCEMENTS FROM STAFF/COUNCIL 1. City Manager Communications. D. SCHEDULED ITEMS 1. APPROVAL OF AGREEMENT OF DISSOLUTION FOR THE AZUSA-RMC JPA AND APPROVAL OF CONVEYANCE OF PROPERTY TO THE WATERSHED CONSERVATION AUTHORITY (WCA). RECOMMENDED ACTION: 1) Accept the grant deed for the subject property; and 2) Approve the Azusa-RMC JPA dissolution agreement; and 3) Approve the conveyance of the subject property to the WCA for conservation purposes and authorize the City Manager to prepare and execute all agreement(s) and deed(s) in a form acceptable to the City Attorney, on behalf of the City. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED APRIL 13, 2023 THROUGH APRIL 26, 2023. APPROVAL OF FIRST AMENDMENT TO AGREEMENT FOR JANITORIAL SERVICES BETWEEN CITY OF AZUSA AND ULTIMATE MAINTENANCE SERVICES, INC. RECOMMENDED ACTION: Approve the First Amendment to the City-Wide Janitorial Services Agreement between the City of Azusa and Ultimate Maintenance Services, Inc; and Authorize the City Manager to execute an amendment to the contract, in a form acceptable to the City Attorney, on behalf of the City. RECOMMENDED ACTION: Approve an increase to the Fiscal Year 2022/23 Blanket Purchase Order #037453 for On-Call Consulting Services with ClientFirst Consulting Group in the amount of $25,000. CONSIDERATION OF A RESOLUTION SETTING THE NUMBER OF TRANSITIONAL FIREWORKS SALES PERMITS FOR 2023. N/A Fund/Account No: N/A 8. REQUEST TO INCREASE FISCAL YEAR 2022/2023 BLANKET PURCHASE ORDER FOR LIEBERT, CASSIDY, WHITMORE FOR LEGAL SERVICES PROVIDED TO THE AZUSA POLICE DEPARTMENT. RECOMMENDED ACTION: Waive the competitive bidding process as authorized under Azusa Municipal Code Section. 2-517(a) (14) – Attorney Services; and Approve the increase of Blanket Purchase Order for Liebert, Cassidy, Whitmore in the amount not-to-exceed $60,000 for Legal Services. N/A Fund/Account No: N/A 10. APPROVAL OF FOUR PROFESSIONAL SERVICES AGREEMENT EXTENSIONS FOR REVENUE COMPLIANCE AUDITS AND DISCOVERY SERVICES. RECOMMENDED ACTION: Authorize extensions to the audit agreements to January 18, 2024 at amounts not to exceed $25,000 per year per agreement; and Authorize the City Manager to approve two (2) additional one-year extensions for each agreement, upon satisfactory performance in an amount not to exceed $25,000 per audit service. Fund/Account No: N/A 11. EXTEND TERM OF LETTER OF AGREEMENT WITH AZUSA UNIFIED SCHOOL DISTRICT (AUSD) FOR FINANCIAL SUPPORT OF 2023 SUMMER PROGRAMMING. RECOMMENDED ACTION: Approve the extension of term for the Letter of Agreement (Agreement) with the Azusa Unified School District, through the summer of 2023, which supports recreational and youth programming for AUSD students.
