Mayor Solem called the meeting to order and led in the salute to the flag. Invocation was given by Rev. L. Diez of St. Frances of 'Rome R. C. Church. Present at Roll Call: Councilmen Decker, Snyder, Clark Solem Absent: Councilman: Rubio Also Present: City Attorney Wakefield, City Admin- istrator Dangleis, Director of Public Works Wells, City Engineer Stimson, Police Chief Elkins, Fire Chief Torrance Director of Parks & Recreation Guarrera, Associate Planning Director Fitzsimmons, Planning Assistant Pavlovskis, Accounting Director Cooney, City Clerk Klarr Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried to excuse Councilman Rubio from the meeting. The Minutes of the meeting of September 5, 1972, were approved as submitted. Councilman Clark presented an award to Fire Engineer ' Raymond Knoll for fifteen years service with the City. The hour of 7:30 p.m. being the time set for a continued public hearing (from 8/21/72) on Substandard Structure Case No. 72-8 (swimming pool at 345 S. Grandin Avenue - Carl P. Smith), the Mayor declared the hearing open. The City Clerk noted, for the record, the receipt of the affidavit of proof of publication of the Notice of the first hearing on 7/17/72, published in the Azusa Herald and Pomotropic on 7/6/72. The Director of Public Works appeared before Council and noted that at the time of the investigation, the house had been empty, the pool was filled with trash, and there was a dangerous situation present. However, the owner is now living in the house and he has repaired the fence and the gates are self-closing. As yet the owner has not fixed the filter or the mechanical devices to take care of the pool; but the pool is now non- hazardous. No one else wishing to speak on this matter and no further 'communications having been received, it was Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to close the hearing and find that the hazard has been abated. The City Clerk submitted a recommendation that the fees be waived for all authorized Golden Days events, as has been done in the past, with the exception of the finger- printing and building inspection fees for the Carnival. 7:30 p.m. Call to Order Invocation Roll Call Counc.Rubio excused Appvl. The City Clerk also noted that last year, for insurance purposes, Council designated two persons as uncompensated temporary employees to work on the Golden Days Parade, driving shuttle cars, etc. Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried to approve the appointment of Mrs. Joan Robertson and Robert Sandwick as uncompensated temporary employees for the week of Golden Days celebra- tion, Oct. 8-14, 1972• A memo was received from the Accounting Director, with copy of proposed Amendment to Subagreement with the the County re: Termination (EEA - Section 5), which would extend the term of the agreement to 9/15/72 (original termination date was 8/26/72), and from thenceforth on a month-to-month basis. Moved by Councilman Decker, seconded by Councilman Clark and unanimously carried to approve the Amendment and authorize its execution by the Mayor. A request was received from San Gabriel Valley Hot Line for permission to hold a "walk" through the City as a fund-raising event, with waiver of parade permit and any other fees, and any required bond. 'Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to approve the request. A communication was received from Nicholas F. Zichichi, Radiological Defense Officer, for authorization to attend, with the Assistant Radiological Defense Officer, a Radiological Defense Officers Conference from October 11 thru 13, 1972, at Fresno, with request for an advance of accountable expenses of $250. He has been informed that he is the sole nominee for the office of President - Elect of the Association and, therefore, his attendance: at the Conference is desirable. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried by roll call to approve the request. Notice was given of three claims against the City rece"Ped by the City ^'^rk's Office: One claim by Mrs. Pearl M. Mether for alleged personal injury on 7/19/72, due to defective sidewalk on 6th Street. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried to reject the claim and refer it ' to the City's insurance carrier. The other two claims, one by Blaine E. Larsen, 912 Citrus Edge, and the other by Leonard Tyko, 916 Citrus Edge, were for alleged property damage due to blockage in main sewer, causing sewage water•to back up, on 9/7/72. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried to reject both claims and refer them to the City's insurance carrier. The City Treasurer's Financial Statement was submitted, City Tress. showing a balance of $1,169,412.71 as of August 31, 1972. Fin. Notice was given that the Planning Commission, by Resolu- P.C.Res.#1012 tion No. 1012, conditionally granted a Variance to permit cond.grtg.Var. /(,a ---a_ reduce yard of 21 feet instead of the required (V-322 - Jacob 25 feet, on property located at 314 Durant Street (Case White) V-322 - Jacob White) . No action by Council. Notice was also given that the Planning Commission, by P.C. Res.#1013 Resolution No. 1013, denied a Variance request to permit denying Var. reduced parking of 4 spaces instead of the required 8 (V-323 - David spaces, on property located at 420-422 S. Irwindale Bewley) Avenue (Case V-323 - David Bewley). No action taken by Council. An Ordinance was presented for second reading and Ord. #1043 adoption, amending the Municipal Code re: Business amending M.C. License Fees for Vending Machines, based on gross re: Bus.Lic. receipts, according to legislation enacted in 1971. Fees for Vending Mach. Councilman Clark offered for adoption the Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 5.24.010 OF THE AZUSA MUNICIPAL CODE, RELATING TO BUSINESS LICENSE FEES. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried by roll call that further reading be waived. A Resolution was presented, amending Resolution No. 5396 by the addition of a Stop Sign on Barbara Avenue at First Street. Councilman Decker offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING RESOLUTION NO. 5396 DESIGNATING STOP INTER- SECTIONS. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried that further reading be waived. Moved by Councilman Decker, seconded by Councilman Snyder that the Resolution be adopted. The City Attorney reported that he had petitioned the Public Utilities Commission for a public hearing with regard to the Santa Fe Railroad crossings in Azusa. He was informed that Santa Fe would repair the cross- ings and he has held the public hearing in abeyance. The Director of Public Works appeared before Council and reported that the 'repair fob was totally unacceptable in both its manner and its materials. The City Engineer proposed the crossing at Pasadena Avenue as reflecting the type of crossing that the City would like to see at the other streets. Res. #60p6 amending ries. #5396 by adding Stop Sign on Barbara Ave. @ 1st St. C.Atty's report re: Santa Fe R.. crossings AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, SEPTEMBER 18, 1972 Councilman Clark also suggested the possibility of remov- ing the two unused siding tracks. By consensus of Council, the City Attorney was directed to re -petition for a public hearing with the Public Utilities Commission concerning the Santa Fe Railroad crossings. The monthly reports from the various City Departments were presented by the City Administrator. Moved by Councilman Snyder, seconded by Councilman Decker and unanimously carried to receive and file. A recommendation was received from the Police Chief for approval and authorization for the Mayor to sign Amend- ment No. 1 to the Joint Exercise of Powers Agreement re: Multi -Agency Satellite -Blood -Alcohol Laboratory, extend- ing the term of the Agreement to 8/31/73. A request was received•from the Director of Public Works for authorization for him and Michael San Miguel to attend a one -day Cable Television Workshop, sponsored by the League of California Cities, to be held 9/28/72, in Los Angeles, with advance registration fee of $15 each (budgeted funds available). Councilman Snyder gave a verbal report regarding his trip to Zacatecas. He reported that the Azusa Queen was well accepted and rode in their parade. Also, it appears the Mayor of Zacatecas, and possibly another couple, plus their Queen and a Princess, will attend the City's Golden Days activities. Councilman Snyder also noted that the Chamber of Commerce received the First Place prize for the City's exhibit at the Los Angeles County Fair. Councilman Decker requested that the Fire Works Ordi- nance be revamped, suggesting that it be "tightened up". Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried that the Fire Chief, City Adminis- trator and Councilman Decker confer with the City Attorney, as a Committee, re: drafting an Ordinance for review by Council. The City Clerk read in full a Resolution authorizing payment of warrants by the City. Councilman Decker offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE 'FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Moved by Councilman Decker, seconded by Councilman Clark that the Resolution be adopted.
