Mayor Solem called the meeting to order and led in the salute to the flag. Invocation was given by Rev. B. J. Paroulek of the First Presbyterian Church. Present at Roll Call: Councilmen: Rubio, Decker, Snyder, Clark, Solem Also Present: City Attorney Wakefield, City Administrator Dangleis, Director of Public Works Wells, Superintendent of Light & Power Gerharz, Police Chief Elkins, Fire Chief Torrance, Director of Parks & Recreation Guarrera, Personnel Clerk Forsythe, Associate Planning Director Fitzsimmons, Accounting Director Cooney, City Clerk Klarr The Minutes of the meeting of November 20, 1972, were approved as submitted. The Mayor welcomed the troupe from the Ballet Folklorico, from the University of Zacatecas, Mexico. Paul Mendoza introduced Raul Fernandez, Director of the troupe, who thanked the Council. The Mayor and Councilmen presented a plaque to Senor Fernandez, who accepted on behalf of the troupe and said he would give it to the Governor of Zacatecas. The Mayor thanked the troupe for sharing the Christmas -tree lighting ceremony with them prior to the Council meeting. The City Clerk announced that bids were opened in his office at 10:00 a.m. on Thursday, 11/30/723 for the furnishing of a Telemetering Control System for the Azusa Water Department (Project #511). Present at bid opening were: City Administrator Dangleis, Director of Public Works Wells, Water Utility Superintendent Gros- didier, Accounting Director Cooney, and City Clerk Klarr. The City Clerk presented the affidavit of proof of publication of the Notice Inviting Bids in the Azusa Herald & Pomotropic on November 16 and 23, 1972. Three (3) bids were received as follows: Name Amount Automation Associates, Inc. $18,996.00 American Chain & Cable Co., Inc., 22,500.00 Bristol Division Envirotech Corp., Instruments & 24,250.00 Controls Gro up (Engineer's estimate, $17,000) A communication was received from the Director of Public Works, recommending that the bid be awarded to Automa- tion Associates, Inc., low bidder, in the amount of $18,996. Attached to this bid was the statement that"a deduction of $2,007 could be made if a Robertshaw Model 223 recorder were substituted for the Sparling Model 740 shown on the plans". If this deduction were made, the low bid would be $16,989. The substitute recorder has been investigated and has been found to satisfy the requirements for that link of the system. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried by roll call to authorize the Director of Public Works and the City Administrator to negotiate a change order with reference to the Robert- shaw Model 223 recorder. The City Clerk announced the bid opening at his office was held at 10:00 a.m, on Thursday, 11/30/72, for the sale of the City's surplus equipment: 2 Accounting Machines, 1 Billing Machine, and 1 Wheeldex Rotary File. Present were: City Administrator Dangleis, Director of Public Works Wells, Accounting Director Cooney, and City Clerk Klarr. The City Clerk presented the affidavit of proof of publication of the Notice Inviting Bids in the Azusa Herald on 11/9/72, and stated no bids were received. No action taken by Council. The time of 7:30 p.m. being the time set for two public hearings, the Mayor declared the following hearings open: (a) on appeal from denial of Permit (P.C. Res. #1020) alcoholic beverages (beer 300 feet of a residential located at 325 N. Azusa A Lucille Ciriza). Conditional Use to allow sale of and wine) within zone, on property venue (Case C-124 - (b) on appeal from denial of Variance (P.C. Res. #1021) to permit reduced parking of 10 spaces instead of the required 11 spaces, on property located at 325 N. Azusa Avenue (Case V-32$ - Lucille Ciriza). By consensus of Council, both hearings (a) and (b) were considered jointly. ` The City Clerk presented the Affidavits of Proof of Publication of both Notices in the Azusa Herald on 11/23/72, and Affidavits of Posting of both Notices on 11/22/72. He informed Council of the receipt of communi- cations from: Floyd W. Arnold, owner of property at 341 and -345 N. Azusa Avenue, in opposition to the grant- ing of the Conditional Use Permit; Murray and Micaela Hirota in opposition to the granting, -of the Conditional Use Permit and the Variance. A memo was received from the Planning Commission, which stated the subject property is zoned C-2 and applicant proposes to open a beer bar and serve sandwiches; ' although this use is ordinarily permitted in this zone, subject property is located within 300 feet of a resi- dential zone and, therefore, requires a Conditional Use Permit. It further stated that as a retail commercial development, the off-street parking requirement for the entire development would be 7 spaces. Due to the change of use, an additional 4 spaces are required and, although the entire rear portion of subject property is paved, there is only room for 10 off-street parking spaces if the required access is maintained. (Case V-328, Lucille Ciriza) (appeals denied AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, DECEMBER 41 1972 It was the opinion of the Planning Commission that the granting of these requests would not be in the best interests of the adjacent areas and City, due to the proximity of the residential uses, and both requests were denied. Charles Nabarrete, 261 W. 8th Street, Pomona, attorney representing Gordon Branham and Mrs. Bella Santa Cruz who propose to run the business at the subject location, appeared before Council. He stated that the business would be a neighborhood bar and grill and that the Associate Planning Director had recommended approval to the Planning Commission. Gordon Branham, 19142 Armstead, Glendora, addressed Council and stated he felt that he was improving the building and adding to the general improvement of the City. Also, that it would not be a simple beer bar, but would serve sandwiches and lunches. He further stated there would be no band, but there might be a juke box. Gilbert Trujillo, 1396 North Alameda Avenue, co-owner of property at 329 and 3291 North AlamedsAvenue, appeared before Council and read into the record the petitions in opposition to both the Conditional Use Permit and the Variance,each petition containing 20 signatures, which he had submitted to the Planning Commission and which had been previously submitted to Council. He expressed the concern of certain other property owners that there will be crimes of violence associated with a bar, with persons frequenting the area who would not be acceptable tc residents in the area. He further protesteLl the granting of a Variance for reduced pa'rking. He pointed out that the parking area served both the bakery and the proposed bar. Presently, part of the parking area is covered by a refuse bin for the bakery, and he assumed a second bin would be required for the bar. Mr. Branham again addressed Council and declared that the type of clientele would not be of the type Mr. Trujillo envisioned. He also pointed out that the parking spaces are there to serve both businesses and that it is a matter of one space less than the requirement. Mrs. Bella Santa Cruz addressed Council and wondered, if these appeals were denied, would there be any other kind of business she could have in that building, particularly with the parking requirement. The Mayor responded that he was sure there was. and referred her to the Planning Department for further information. No one else wishing to speak regarding these hearings and no further communications having been received, it was Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried that both hearings be closed. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried by roll call to deny both appeals (C-124 and V-328) and instruct the City Attorney to prepare the necessary Resolutions. Marsha Doiron, 960 E. Gaillard Street, a student in the audience, addressed Council and asked the reasons why the appeals were denied. Council Members explained their reasoning, based upon representing the people of the area who did not want the bar to be located there. A request was received from the newly formed Azusa Appvl. req.by Fireman's Association, which is generated out of the Az.Fireman's demise of the Azusa Police and Fire Association, for Assn.for dues dues to be deducted from paychecks, with a list of all to be ded.from members and signatures authorizing deductions in the paychecks amounts stated. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried to grant the request. The matter of reimbursement to the Sister City Reimb.to Sister Committee for accountable expenses incurred during the City Com. for visitation of the Mayor of Zacatecas, during Golden exp.incurred Days celebration, was submitted to Council. A request was received from the Director of Parks & Waiver of Recreation for Council to waive the 50¢ bicycle bicycle lic. licensing fee for the period January 1-31, 1973. The fee from Bicycle Safety Contest is scheduled for Saturday, Jan -1-31, 1/27/73, at Memorial Park, sponsored by the Mayor's 1973 Safety Committee. Moved by Councilman Rubio, seconded by Councilman Clark and unanimously carried to waive the bicycle licensing fee from January 1-31, 1973, as requested. Councilman Snyder reminded Council of the Ballet Folk- Ballet Folk- lorico from the University of Zacatecas A,t to be held at lorico from Citrus College Auditorium, 12/7/72, at 6:00 p.m. Univ.of Zac., ' 12/7/72,Citrus Aud., 8 p.m. The City Clerk read in full a Resolution authorizing Res. #6047 payment of warrants by the City Claims & Demands Councilman Decker offered for adoption the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.
