Mayor Solem called the meeting to order and led in the salute to the flag. Call to Order Invocation was given by Rev. Ronald Royer of St. Frances Invocation of Rome R. C. Church. Present at Roll Call: Councilmen: Rubio, Decker, Snyder, Roll Call Solem Absent: Councilmen: Clark Also Present: City Attorney Wakefield, City Administrator Dangleis, Director of Public Works Wells, Superintendent of Light & Power Gerharz, Police Chief Elkins, Fire Chief Torrance, Director of Parks & Recreation Guarrera, Planning Assistant Pavlovskis, City Clerk Klarr Moved by Councilman Snyder, seconded by Councilman Rubio Counc.Clark and unanimously carried to excuse Councilman Clark from the excused from meeting, due to his being on vacation. meeting The Minutes of the meeting of August 20, 1973, were approved as submitted. A Plaque and Resolution of Commendation (Resolution No. 6128) were presented by the Mayor to Sid F. Mulligan, former member of the Personnel Board. ' The hour of 7:30 being -the time set for a public hearing on the proposed vacation of a portion of an alley lying south of 4th Street, between Virginia and Barbara Avenues, subject to reservation and exception of certain rights and easements, per Resolution #6125, the Mayor declared the hearing open. The City Clerk presented the affidavit of proof of publication of Resolution No. 6125 which set the hearing date as September 4, 1973, at 7:30 p.m., and which was published on 8/16/73 in the Azusa Herald. The City Clerk also presented the affidavit of posting Notices of passage of the Resolution of Intention to Vacate, by the Director of Public Works, which stated that posting was completed on 8/10/73. The Director of Public Works stated he has no objection to said vacation as the alley serves no purpose, and recommended that the portion of said alley specified be vacated but any utility easements be retained. No written communications having been received and no ' one in the audience desiring to be heard, it was Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to close the hearing. Moved by Councilman Snyder, seconded by Councilman Rubio and unanimously carried to find that the alley is not required -for present or prospective use and to order its vacation subject to the reservation of utility ease- ments, and direct the City Attorney to prepare the neces- sary Resolution ordering said vacation. The Director of Parks & Recreation summarized the cost from owner for a Mini Park at the corner of Foothill Blvd, and Azusa Avenue, for a total of $2 500. Of that amount, the City would actually lose $400 in seeding and fertilizing; the tree wells, benches, etc., are mobile and could be removed and used elsewhere by the City. Moved by Councilman Rubio, seconded by Councilman Snyder and unanimously carried by roll call to establish a Mini Park at Foothill Boulevard and Azusa Avenue at a cost not to exceed $2,500, with.a written agreement from the owner, including a 30 -day notice of termination clause for either party. The matter of clarification of the action concerning Re: clarif. Cable Television, from the 8/6/73 meeting, was considered. of action from 8/6/73 Councilman Decker explained his motion as desiring to mtg.on Cable investigate the area of franchise companies and services, T.V. which had not been investigated so far by the Committee. No action taken by Council. A verbal report was given by Father Royer of St. Frances Verbal rpt. of Rome Church, concerning the results of the meeting on by Father 8/22/73 with the Deacons Club re: use of the Parish Hall. Royer on ' resultsof Father Royer informed Council that Mrs. Gonzales and mtg.on 8/2/2 2/73 Mrs. Miranda, signers of the petition, were present for w/Deacons Club a portion of the meeting, to explain the nuisance re:use of factor. He reported that a series of rules have been Parish Hall prepared, and approved by the Police Chief, which would govern the use of the hall primarily by organizations renting the hall. He felt the concern of the Deacons, together with the new rules, would be sufficient to meet the problems. Mrs. Josephine Gonzales, 415 N. Soldano Avenue, addressed Council and stated her feelings that the new rules would help. She again emphasized the nuisance of the loud music from noon to past midnight, particularly with wedding dances. The Police Chief indicated he was satisfied, as did representatives from the Deacons Club. Council felt the various parties involved had come to a satisfactory solution and commended them all. No action taken by Council. A request was received from the City Librarian that the position of Audio -Visual Supervisor, now listed in the budget, be re -titled Assistant City Librarian. He noted Mrs. Elsie Vandale has been appointed to the new position, effective 7/30/73. ' Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to instruct the City Attorney to prepare an amendment to the complement Resolution. A request was received from the League of California Cities for Council designation of voting representative and alternate for the Ccnference in San Francisco. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to appoint Mayor Solem as voting representative, and Mayor Pro Tempore Rubio as alternate. The City Clerk requested approval and authorization of execution of the annual Agreement between San Gabriel Valley Symphony Association and the City; also authori- zation for payment of $200 (budgeted) after the first concert has been held. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried by roll call to approve and authorize execution of said Agreement; also, payment of $200 after the date of the first concert. The City Clerk presented a claim against the City by Robert L. Garcia for alleged damage to his vehicle while Police were arresting a suspect, on 8/24/73. The Superintendent of Light & Power requested confirma- tion of the probationary appointment of Miss Deborah Jacob as Secretary, at Step 1 of Range 110.0, beginning 9/11/73, subject to her passing physical examination. Councilman Rubio suggested Council oppose the proposed County plan for establishing the position of a County Mayor. After discussion, it was Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to authorize a letter be sent to the Board of Supervisors and signed by Mayor Solem on behalf of Council, in opposition to proposed charter amendment of Los Angeles County providing for separation of powers. It was noted that Council had approved an emissary to carry around 9/16/73 the invitation to the Governor. It was suggested that members of Council accompany representatives from the Sister City Committee on their visit to Zacatecas around 9/16/73. It was unknown as to who could go and the exact itinerary. The City Administrator was requested to prepare the necessary schedules. Paul P. Mendoza, Chairman of the Sister City Committee, informed Council of conversations with the Mayor of Zacatecas, who wished to prepare for the delegation from Azusa and needed to know the number of persons visiting Zacatecas. He also indicated the Governor of Zacatecas may be accompanied by a 40 -member band and folklorico dancers when he visits Azusa. No action taken by Council. The City Clerk read in full a Resolution authorizing pay- Res. ##6137 ment of warrants by the City.
