Mayor Solem called the meeting to order. Present at Roll Call: Councilmen: Rubio, Decker, Snyder, Clark, Solem Also Present: Honorable Sam Cianchetti, City Attorney Wakefield, City Administrator Dangleis, Director of Public Works Wells, Super- intendent of Light and Power Gerharz, Police Chief Elkins, Fire Chief Torrance, Director of Parks & Recreation Guarrera, City Librarian Ector, Associate Planning Director Fitzsimmons, City Clerk Klarr City Clerk Klarr stated that by Resolution No. 6178, adopted February 19, 1974, the City Clerk was authorized to canvass the results of the General Municipal Election held on March 5, 1974, and declared that all total votes cast tally out exactly the same as on the night of the election. Copies of the City Clerk's Certificate of Canvass were distributed to Council. A Resolution was presented, reciting the fact of the General Municipal Election held March 5, 1974, declaring the results thereof. Included in this Resolution is the Certificate of Canvass, marked Exhibit "A% declaring there were seven (7) candidates for Members of the City Council, and declaring that Jens J. Solem, James F. .Arkison, and Lucio D. Cruz, were the three candidates with the top number of votes. Councilman Decker offered the following Resolution: 7:30 p.m. Call to Order Roll Call City Clerk canvassed results of Municipal Election Res. #6185 declaring Municipal Election results AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, MARCH 12, 1974 Page 2 RESOLUTION NO. 6185 A RESOLUTION OF THE CITY COUNCIL OF THE CIr OF AZUSA, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF AZUSA ON THE 5th DAY OF MARCH, 19743 DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS.AS ARE PROVIDED BY LAW 'WHEREAS, a regular general municipal election was held and conducted in the City of Azusa, County of Lot Angeles, State of California, on Tuesday, the 5th day of March, 1974, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the rotes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 6178 adopted the 19th day of February, 1974, the City Clerk of the City of Azusa canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as "Exhibit A." NOW, ^1HEREFORE5 THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: ISECTION 1. That there were twelve (12) voting precincts established for the purpose of holding said election, consisting of consolidations of the regular election precincts in the City of Azusa as established for the holding of state and county elections. SECTION 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by the laws relating to cities in the State of California, to wit: Three (3) members of the City Council of said City for the full term of four years. SECTION 3. That the whole number of votes cast in said City (except absent voter ballots) was 2,664. That the whole number of absent voter ballots cast in said City was 28, making a total of 2,692 votes cast in said City. SECTION 4. That the names of persons voted for at said election for Member of the City Council of said City are as follows: Donald(Don) F. Clark Robert (Bob) R. Snyder Jens J. Solem James (Jim)F. Arkison Lucio D. Cruz David G. Evans Robert (Bob) G. Fry That the number of votes given at each precinct and the number of votes given in the City to each of such persons above- named for the respective offices for which said persons were candidates were as listed in Exhibit "A" attached. AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, MARCH 12, 1974 Page 3 SECTION 5, The City Council does declare and determine that: ' Jens J. Solem was elected as Member of the City Council of said City for the full term of four years; James F. Arkison was elected as Member of the City Council of said City for the full term of four years; Lucio D. Cruz was elected as Member of the City Council of said City for the full term of four years. SECTION 6. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election, showing: Ill The whole number of votes cast in the City; 2 The names of the persons voted for; 3 For what office each person was voted for; 4 The number of votes given at each precinct to each person, (5) The number of votes given in the city to each person. SECTION 7. That the City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Section 11550 and Section 11559 of the Elections Code of the State of Calif- ornia, shall deliver to each of such persons so elected a Certificate of Election signed by him and duly authenticated; that he shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in his office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. Moved by Councilman Decker, seconded by Councilman Rubio that the Resolution be adopted. The Resolution was then passed and adopted by the above -listed vote of Council, and numbered Resolution 6185. Councilman Clark declared he had a statement to make and 'he would like it to become a part of the minutes of this meeting. The statement read, as follows: Four years ago when I took the oath of office for Councilman, my conduct and performance in office were to be my campaign platform for re-election. I lived up to the oath of office and served this city honestly and faithfully to the best of my ability. The election is over now and I accept the result of my votes. However, in the elections code there is a chapter known as the Waxman-Dymally Campaign Disclosures Act. The preamble to this act states in section 11501, and I quote: It people have a right to expect from their elected representatives at all levels of government assurances of the utmost in integrity, honesty and fairness in their dealings; (b) The people further have a right, in order to knowledgeably vote for both candidate and measures, to a true and timely disclosure of the identity of financial backers and the extent of their financial support. Because of the failure of one of the candidates to comply with this law prior to the election, I submit the voters of Azusa were denied information which would allow them to cast a knowledgeable vote. Furthermore, the election code also states in section 11601, and I quote: "Any person who knowingly and t.rillfully violates any of the provisions of this chapter is guilty of a misdemeanor. As you know Mr. City Clerk and members of the council, such a violation did occur during this city's municipal election held March 5, 1974. This adjourned meeting is to be my last official function as a member of this council, but to partici- pate in a ceremony which, despite a violation of the election code, places a person in a position of public trust and responsibility, is contrary to my principles, and is contrary to the statement of the oath of office. I therefore respectfully abstain from voting on any resolution approving the canvas of ballots. 1 AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, MARCH 12, 1974 Councilman Snyder declared he abstained from voting on the above Resolution as he felt somewhat the same as Councilman Clark. Page 6 Mayor Solem extended the privilege of the floor to Remarks by retiring Councilmen Snyder and Clark for any remarks retiring Colinc they may wish to make. Snyder & Clark Councilman Snyder expressed his thanks to the City employees for all of their courtesies, to the City of Azusa for allowing him to serve on the Council, and to his colleagues for their indulgence and patience. He stated, for the record, he could not and would not have destroyed City Hall or marred its"beauty in any way... Councilman Clark expressed his belief in the system of City Government, a system of which we should be very proud. He stated he learned a great deal about the functions of the Government during his term as Councilman, and is appreciative of the opportunity to do so.. He further stated he would like to leave as he came in: with a good feeling about the City. Mayor Solem expressed his appreciation to the people of Azusa for their support and confidence. The City Clerk having received and filed affidavits of campaign expenses from each of the candidates, as required by law, presented a Certificate of Election to each of the successful candidates. The Honorable Sam Cianchetti, Judge- of the Municipal Court, Citrus Judicial District, thenadministered the 'oath of office to the three new members of the City Council. Mayor Solem invited the newly elected Councilmen to the Council table, and each was seated. Mayor Solem extended the privilege of the floor to each newly elected Councilman for any remarks he may wish to make. Councilman Cruz thanked the people for their support and stated he will enforce his campaign platforms. Councilman Arkison noted it took 17 years to go from the Press table to this Council table. He stated he made certain commitments to the people and hopes to carry out those commitments. Councilman Solem said he has been associated with City Government for nine years as a Councilman and for the Planning Commission before that. He stated it has been his pleasure to work with and for the people, and he feels confident that this new Council will continue to work for the City as before. 'City Clerk Klarr, presiding as Chairman, provided the opportunity for either verbal nominations crto have a direct ballot cast with highest number of votes being considered a nomination and selection of Mayor for the new term. He declared nominations were now open. Councilman Cruz nominated Councilman Rubio for Mayor. Councilman Solem nominated Councilman Decker for Mayor. Mayor Solem Certif. of Election Oath of Office by Judge Cianchetti Councilmen seated Remarks by newly elected Councilmen Nominations for Mayor AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, MARCH 12, 1974 Page 7 Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried that nominations for Mayor be closed. Moved by Councilman Solem that selection of Mayor be by secret ballot. Motion died for lack of seconding. The City Clerk declared that voting will be by roll call.. 'Councilman Rubio failed to be chosen Mayor by the following vote of Council: AYES: Councilmen: Rubio, Cruz NOES: Councilmen: Decker,;Arkison, Solem ABSENT: Councilmen: None Councilman Decker was then chosen Mayor by the following Counc Decker vote of Council: chosen as Mayor AYES: Councilmen: Decker, Arkison, Solem NOES: Councilmen: Rubio, Cruz ABSENT: Councilmen: None Mayor Decker expressed his appreciation for the honor of being chosen Mayor, He stated he will do his best to be a good Mayor, as it will be difficult to follow Mayor Solem and Mayor Memmesheimer. Mayor Decker then assumed the Chair and called for Nominations nominations for Mayor Pro Tempore. for Mayor Pro Tempore Moved by Councilman Arkison, seconded by Councilman Cruz that Councilman Rubio be nominated as Mayor Pro Tempore. Councilman Decker nominated Councilman Solem as Mayor Pro Tempore. Moved by Councilman Solem, seconded by Councilman Arkison and unanimously carried that nominations be closed. Councilman Rubio was then chosen Mayor Pro Tempore by Counc Rubio the following vote of Council: chosen as Mayor Pro Tem. AYES: Councilmen: Rubio, Solem, Cruz, Arkison, Decker NOES: Councilmen: None ABSENT: Councilmen: None Councilman Rubio thanked the members of Council for the honor of being chosen Mayor Pro Tempore. Moved by Councilman Arkison, seconded by Councilman Solem Adjourn and unanimously carried that the meeting be adjourned.
