Archived video of recorded meetings is also available on the City website. Notice Regarding California Environmental Quality Act (CEQA) Determinations. Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. B. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items listed or not listed on this Agenda. Members of the audience will have the opportunity to address the City Council/Agency Board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the Council/Agency Board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments may be handled after the speaker has completed his/her comments. RECOMMENDED ACTION: 1) Open the Public Hearing, receive public testimony, and close the Public Hearing; 2) Review and adopt the following Resolution No. 2023-C63: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING PARTICIPATION IN THE LOS ANGELES URBAN COUNTY PERMANENT LOCAL HOUSING ALLOCATION PROGRAM BY AUTHORIZING THE MAYOR, OR HIS/HER DESIGNEE, TO SIGN A REIMBURSABLE CONTRACT WITH THE LOS ANGELES COUNTY DEVELOPMENT AUTHORITY (LACDA) ACTING ON BEHALF OF THE COUNTY 11/6/2023 - 4 - 3) Authorize the City Manager to execute the grant Agreement between the City of Azusa and the California State Department of Housing and Community Development in a form acceptable to the City Attorney. PUBLIC HEARING - CONSIDERATION OF ADOPTION OF A RESOLUTION CALLING A SPECIAL ELECTION AND A RESOLUTION DECLARING ELECTION RESULTS RELATED TO IMPROVEMENT AREA NO. 3 OF THE COMMUNITY FACILITIES DISTRICT NO. 2005-1 (ROSEDALE) OF THE CITY OF AZUSA RECOMMENDED ACTION: 1) Open the Public Hearing, receive public testimony, close the Public Hearing; 2) Adopt Resolution No. 2023-C64, calling a Special Election and Submitting to the Qualified Electors of Territory Proposed to be Annexed to the Designated Improvement Area No. 3 of Community Facilities District No. 2005-1 (Rosedale) of the City of Azusa the Question of Levying Special Taxes within that Territory (Annexation No. 1); 3) Adopt a Resolution No. 2023-C65, declaring Election Results for the Annexation of Territory to the Designated Improvement Area No. 3 of Community Facilities District No. 2005-1 (Rosedale) of the City of Azusa (Annexation No. 1); and 4) Waive further reading, read by title only, and introduce first reading of Ordinance No. 2023-06, authorizing the Levy of Special Taxes in a Community Facilities District, including Certain Annexation Territory identified as Annexation No 1, into Improvement Area No. 3 of the Community Facilities District No. 2005-1 (Rosedale). FIRST READING - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA MODIFYING AND AMENDING ARTICLE VIII – GARAGE, YARD AND PATIO SALES, SECTION 18-532 GARAGE SALE REGULATIONS AND DETERMINING THIS ORDINANCE BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. CEQA. This Ordinance is not a project within the meaning of Section 15378 of the State of California Environmental Quality Act (“CEQA”) Guidelines, because it has no potential for resulting in physical change in the environment, directly or indirectly. The City Council further finds, under Title 14 of the California Code of Regulations, Section 15061(b)(3), that this Ordinance is nonetheless exempt from the requirements of CEQA in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. ACCEPTANCE OF PROJECT COMPLETION AND AUTHORIZATION TO FILE A NOTICE OF COMPLETION FOR VOIP (VOICE OVER INTERNET PROTOCOL) TELECOMMUNICATION SYSTEM PROJECT. RECOMMENDED ACTION: Accept the project completion; and Authorize staff to file a Notice of Completion for the VoIP Telecommunication System Project. APPROVE GRANT AGREEMENT FROM CALIFORNIA OFFICE OF TRAFFIC SAFETY FOR THE “SELECTIVE TRAFFIC ENFORCEMENT PROGRAM” (STEP) 2023-2024, GRANT NUMBER PT24009. RECOMMENDED ACTION: Accept a grant in the amount of $95,000 (for hourly wages at an overtime rate) from the California Office of Traffic Safety (OTS) to conduct DUI Saturation Patrols to apprehend drunk drivers, Warrant Service Operations and other related programs; and Authorize the Mayor to execute the grant agreement. RECOMMENDED ACTION: Approve and authorize the City Manager to enter into a Memorandum of Understanding (MOU) and authorize the City's continued participation in the North San Gabriel River Working Group ("NSGRWG") to collaborate on services and enhance public safety in the North San Gabriel River Area with the Cities of Duarte and Irwindale. RECOMMENDED ACTION: Waive purchasing procedures as authorized under Azusa Municipal Code Section 2-521; and Approve a Professional Services Agreement with EMCOR for preventative maintenance of the City’s HVAC systems in an amount not to exceed $109,608 per year; and Authorize an annual blanket purchase order in the amount of $50,000 for miscellaneous repair work; and Authorize the City Manager to execute the Professional Services Agreement, in a form acceptable to the City Attorney, on behalf of the City. Orange Place; and Authorize the City Manager to execute Amendment One to Lease Agreement, in a form acceptable to the City Attorney, on behalf of the City, subject to non- substantive changes made by the City Manager and the City Attorney.
