Mayor Decker called the meeting to order and led in the Call to Order salute to the flag. Invocation was given by Reverend Royer of St. Francis Invocation of Rome Church. Present at Roll Call: Councilmen: Rubio, Solem, Cruz, Roll Call Arkison, Decker Also Present: City Attorney Wakefield, City Administrator Dangleis, Director of Public Works Wells, Consumer Service Supervisor Eastman, Police Chief Elkins, Fire Chief Torrance, City Engineer Stimson, Planning Director Fitzsimmons, Director of Parks & Recreation Guarrera, Finance Officer Cooney, City Treasurer Talley, Personnel Clerk Forsythe, City Clerk Solis. At the request of the Mayor, the City'Administrator intro- duced the Department Heads that were present, for the benefit of the audience. The minutes of the regular meeting of 7/15/74 and the adjourned meeting of 7/31/74 were submitted for Council consideration. Moved by Councilman Cruz, seconded by Councilman Arkison and unanimously carried to approve the minutes of the adjourned meeting, and also approve the minutes of the regular meeting as corrected. Intro. of Dept.Heads Appvl. Min. 7/15/74 & 7/31/74 ' Councilman Solem presented a plaque to Mr. Dean F. Klarr, Prean, plaque former City Clerk, for his dedicated service to the City. to Mr. Dean Mr. Klarr and his family are moving to Salem, Oregon. F. Klarr The Mayor extended greetings to the Youth Exchange Intro. of Students who are visiting from Zacatecas. Councilman Youth Exchng Rubio then interpreted the Mayor's greetings to the Stud. fm' students in Spanish. The hour of 7:30 p.m. being the time set for the public Pub.Hrg. re: hearing on the second reading of an Ordinance to adopt by Ord. to adopt Reference the Uniform Fire Code. by ref.Uniform Fire Code Chief Torrance explained this is to conform with the County Building Code, in association with the Western Fire Code and will bring our Code up to date. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, AUGUST 5, 1974 Councilman Solem offered for adoption the Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REPEALING SECTIONS 15.24.020, 15.28.010, 15.28.020, 15.28.030, 15.28.040, AND 15.28.050 OF THE AZUSA MUNICIPAL CODE AND ADDING SECTIONS 15.28.010, 15.28.020,15.28.030, 15.28.040, 15.28.041, 15.28.050, 15.28.060, AND 15.28.070 THERETO RELATING TO THE ADOPTION OF THE UNIFORM FIRE CODE, 1973 EDITION, AND MAKING CERTAIN CHANGES THEREIN REQUIRED TO MEET LOCAL CONDITIONS. Moved by Councilman Solem, seconded by Councilman Cruz and unanimously carried by roll call that further reading be waived. Moved by Councilman Solem, seconded by Crouncilman Cruz that the Ordinance be adopted. Councilman Rubio stated his concern regarding the lack of fire zone signs in the Edgewood Shopping Center. He noted that it would be almost impossible for fire trucks to get through should the need arise. The City Adminis- trator remarked that this is private property but he would investigate. Moved by Councilman Solem, seconded by Councilman Arkison and unanimously carried to refer this matter to the City ' Administrator, Fire Chief and the Police Chief for study and report back to Council. The City Clerk announced that bids were opened in his office at 10:00 a.m, on Thursday, 7/18/74, for the Annual Asphalt and Paving Equipment Rental. Present at bid opening: Director of Public Works Wells, Finance Officer Cooney, City Administrator Dangleis, and City Clerk Klarr. The City Clerk presented the affidavit of proof of publication of the Notice Inviting Bids in the Azusa Herald on 6/27/74, and 7/4/74. Two (2) bids were received as follows: Firm Name Total Bid Vernon Paving Co. $1,059.00 Industrial Asphalt, a Division of Gulf Oil 1,050.97 A communication was received from the Director of Public Works, in which he recommended that the bid be awarded to Industrial Asphalt, a Division of Gulf 011 Corporation, low bidder, in the amount of $1,050.97. ' Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried by roll call to approve the recommenda- tion of the Director of Public Works to award the bid to Industrial Asphalt. The City Clerk announced that bids were opened in his office at 10:00 a.m. on Thursday, August 1, 1974, for recon- struction of Fourth Street, between Azusa Avenue and Alameda Avenue. Present at bid opening were: City Administrator Dangleis, Director of Public Works Wells, and City Clerk Solis. Page 2. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried by roll call to approve the recommendation of the Director of Public Works and award the bid to Tony C. Holquin Construction, low bidder, in the amount of $17,597. yam. The following items were preset�te..0 n—discussion, :by Councilman Arkison: 1. Discussion of Graffiti Ordinance. Councilman Arkison noted the City Ordinance concerning the sale of spray paint cans to youths, has been in effect for approximately six months. The graffiti problem is still growing, both on public and private buildings. The City Attorney stated that Bill SB 1338 has been signed by Governor Reagan, in which the parents of the children responsible for graffiti, will be civilly liable. There is a $2,000 fine plus court costs, and attorney fees; this will be considered a specific misdemeanor punishable up to 30 days in jail, and makes the defendant responsible for the repair of damage. This legislation will become effective on January 1, 1975. The Director of Public Works stated there is a new polyurethane paint that can be washed off with solvent, however, the cost is about ten times that of regular paint. It was suggested that a study be made regarding cost factor for the use of the polyurethane paint versus the cost of repainting buildings. Moved by Councilman Arkison, seconded by Councilman Solem and unanimously carried, that Director of Public Works Wells conduct a study concerning comparison costs of the use of polyurethane paint versus painting the buildings, and report back to Council. Page 3 (Bid award. to Tony C. Holquin,low bidder) Council Items 2. Discussion of Leash Law. ' Councilman Arkison stated he has received many complaints from citizens concerning the large number of dogs running the streets, upsetting trash -cans, and people being bitten by dogs. He feels the Ordinance that we now have has no teeth in it, and can anything be done about this Ordinance? Police Chief Elkins indicated that Section 1.12.010 of the Municipal Code so states that any person violating any of the provisions or failing to comply with any of the man- datory requirements of the Code, shall be guilty of a misdemeanor. He also remarked that many people leave their dogs -run at night, when they know that the Animal Control Officers are off duty. The City Attorney stated that the City of Azusa's leash law is identical to the Leash Law in most cities, and there was nothing to be gained by changing it. Councilman Cruz brought up the matter concerning smoking Smoking In public gatherings. The City of Los Angeles has an in pub. Ordinance regarding this. Would it be possible to control gatherings this? Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried to have the City Attorney check into the Ordinance that is now in effect in the City of Los Angeles. Councilman Cruz asked if anything has been done about Rpt. from employee incentive awards. Prsn. Clk. re: employee Personnel Clerk Forsythe addressed Council and said incentive that the Personnel Board had considered employee awards incentive awards during budget meeting sessions. At that time it was referred to Council for study. Moved by Councilman Cruz, seconded by Councilman Arkison and unanimously carried that the Personnel Board should consider the matter of employee incentive awards. Arthur D. Morales, 337 Soldano Ave., and Victor Gonzales, Discussion re: 124 S. Louise Ave., addressed Council and presented Pre§ervation their views re: preservation of Azusa City Hall. of City Hall After discussion, it was, Moved by Councilman Cruz, seconded by Councilman Rubio to have a Measure placed on the November ballot concerning the replacing or remodeling of City Hall. Motion failed by the following vote: AYES: Councilmen: Rubio, Cruz NOES: Councilmen: Solem, Arkison, Decker ABSENT: Councilmen: None Mr. Locher of Beck & Associates addressed Council regarding Rpt. re: the matter of the electrical rate study for the City. Electric The results of the study were as follows: rate study & proposed 1. An analysis and determination of the total Res. cost of providing electric service. 2. Allocation of costs to provide a basis for equitable recovery of costs from the various customers. 3. An analysis of existing rates to determine whether such rates will produce revenues adequate to meet projected requirements of the electric system. 4. Develop recommendations for rate adjustments, consolidation of present rates, and adoption of new rates. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried that further reading be waived. Moved by Councilman Solem, seconded by Councilman Rubio that the Resolution be adopted. Resolution passed and adopted by the following vote of Council: AYES: Councilmen: Rubio, Solem, Cruz, Decker NOES: Councilmen: Arkison ABSENT: Councilmen: None and numbered Resolution 6234. Councilman Arkison voted No simply as a vote of protest even though he knows it has to be done. The City Clerk presented a Summons against the City of Azusa, re: alleged personal injuries of J. E. McAlmond from fall on metal trap-door leading to water meters. This Summons has not yet been scheduled for hearing in Superior Court, Pomona. Moved by Councilman Arkison, seconded by Councilman Rubio and unanimously carried to refer to the City's insurance carrier. A communication was received from the Board of Supervisors recommending modifications to bridge at 1st Street and Little Dalton Wash, consisting of installing restrainers to limit movement of the bridge superstructure in order to prevent major damage in a strong earthquake. The estimated cost is $5,000. The City Administrator. reminded Council that the City must request that the work be done on the bridge. This cost is borne by the County. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried to authorize the City Administra- tor to send a letter requesting that the work be done. A request was received from United Crusade for permission to solicit for funds in the City of Azusa from October 15 to November 15, 1974. Moved by Councilman Cruz, seconded by Councilman Arkison and unanimously carried to approve the request. Summons re: personal inj. Rpt. re: bridge lst.St. & Little Dalton Wash for earthquake proofing Req, frm. United Crusade A Notice was received from Alcoholic Beverage Control of ABC Notice: a transfer application for On -Sale Beer (Food), License 622 E. 8th St. from Michael & Mary Gilroy to Deneb, Inc., for premises ` (Jack & Jill's) 622 E. 8th Street (Jack & Jill's) . Councilman Cruz asked if there was any way to control the number of licenses issued. The City Attorney stated that if there is some reason for denialthe Police Chief s.<�t:1« G could file a protest with the ABC; however, the most effective way to control is to limit areas under the zoning Ordinance in which sale of alcoholic beverages are permitted. Most of the ABC notices are for transfer of ownership and license of already existing establishments. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried to receive and file. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, AUGUST 5, 1974 The Personnel Board submitted for Council consideration a request for reimbursement for job related training expenses for Roseanne Burian, Sr. Secretary in the Personnel Office, in accordance with the Rules and Regulations, Section 108.1. Total cost $15.60. Moved by Councilman Arkison, seconded by Councilman Rubio and unanimously carried by roll call to approve 'the request. A request was received from the Personnel Board for the expenditure of funds to update the City of Azusa Civil Service Ordinance and Rules and Regulations to conform to recent changes in Federal and State regulations. There are a number of -conflicting areas, illegal require- ments and unnecessary record-keeping rules. Councilman Arkison commented that he has found by attending the Personnel Board meetings, as an appointed representa- tive, that in many instances these things are happening. The changes that can be done without going to a vote of the people should be done. The City Attorney stated that not much can be done except a revision of the Rules and Regulations. The Ordinance itself is an Initiative Ordinance and can only be changed by a vote of the people. The City Attorney suggested that he and the Personnel Clerk could review the Rules and Regulations and perhaps 90% of the problem areas could be cleared up in this way. Moved by Councilman Arkison, seconded by Councilman Solem and carried by roll call to refer this matter to the City Attorney and the Personnel Clerk for review and recommen- dation as soon as possible. Councilman Cruz abstained from voting. 1. Notice was given that the Planning Commission, by Resolution No. 1138 declared the intention of the Planning Commission to initiate a possible amendment to the Azusa Municipal Code relating to the use of mobilehomes, trailers or coaches for office, commer- cial or manufacturing purposes on a temporary basis. Hall The City Administrator informed Council that Mr. Moses, (bid award on operator of the Ghost Town, on San Gabriel Canyon Rd. -9/3/74) has requested blocks, and any of the facade, that can be saved, to be used in making a replica of the current City Hall. Moved by Councilman Solem, seconded by Councilman Arkison by roll call that Council approve the Plans & Specifications for the new, City Hall and have the City Clerk advertise for bids. Cruz from the Library Board of Trustees. The City Administrator submitted a communication from Req. for pur- Latham & Watkins, Attorneys at Law, concerning their chase of City client Frank Ullrich, who is offering to purchase city- owned propty. owned property in the vicinity of 5th and Virginia Streets for $300,000. (tbld.to 9/3/74 mtg.) The City Administrator submitted a memo to Council for consideration of the policy regarding utility turn -on costs. The present policy in this situation is that the request comes from a City Councilman and a standby lineman is thendirected_ to turn on the utility, either lights or water. The cost incurred in this process is $21.62. In some cases it could be both light and water doubling the above cost. This cost has in the past been borne by the City. It was the consensus of Council that the Police Department upon request of the consumer will send out the standby man for turn on and a fee of $10.00 will be charged. Moved by Councilman Arkison, seconded by Councilman Rubio and carried by roll call to establish a $10 fee which would include turn on for both light and.water. Mayor Decker voted no because he feels it is a waste of time, money and effort. The City Administrator presented a communication from the Light & Power Department re: Electric Distribution Facilities for.supplying Electrical Energy for Power and Light Service, with Cloth World at 495 E. Gladstone, Azusa. A charge of $300 was required for this service agreement. Moved by Councilman Cruz, seconded by Councilman Solem and unanimously carried to receive and file. The City Administrator submitted a report from the City Engineer re: Assembly Bill No. 1727 and Amendment Bill No. 3792. The proposed amendment provides a means wherein communities can make use of a portion of the sales tax money proposed for rapid transit (if passed by the electorate in November) for the operation of a community bus line. It was the City Engineer's recommendation that the City of Azusa support these bills either by a Resolution and/or communication to our State representative. Moved by Councilman Cruz, seconded by Councilman Rubio and carried by roll call to direct the City Administrator to send a letter to our State Representatives in support of these two bills. A report was received from the Director of Public Works Recom. that re: failure to comply with Notice to Abate Public substandard Nuisance of substandard building at 348 N. Dalton Avenue, bldg.at 348 owners unknown. It is the recommendation of the . N.Dalton be 'Director of Public Works that the City Council order the demolished building demolished by private contract and the cost assessed as a lien against the property, and that the City Clerk advertise for bids to demolish the structure. Moved by Councilman Arkison, seconded by Councilman Rubio and unanimously carried to approve the recommenda- tion of the Director of Public Works and authorize the City Clerk to advertise for bids for the demolition of said structure. These funds would be used to provide housing for low income groups, elderly, and minority groups. This bill will shift municipal water district elections for directors from the direct primary election to odd - numbered years. Such a change will increase the cost to taxpayers, within municipal water districts, almost as much as it costs to operate such districts for an entire year. Meeting Adjourned at 11:05 p.m. City Clerk Page 11 Mayor Decker & Councilman Rubio to be excused frm 8/19/74 Cncl. meeting Adjourn Next Resolution #6239 Next Ordinance #1083 Addition to Agenda Item 5b, section relating to comments by Personnel Clerk in response to question relating to "affirmative action program" - Page 6, Para 5- as requested by Councilman Cruz: "Under the recent amendment to Civil Rights Law, there are certain requirement practices that are recommended to hire a number of minority in your population in your city employment as related to population. Our examination procedures require a written and oral interview and certain requirements as to educational requirements that population in the area or candidate population cannot meet. We have strict rules on our written tests as to weight of examinations. 50% weight is given for the written. It is a little difficult to reach the minority group with our current hiring regulations under the Civil Service rules. Educational require- ments are not waived; we have set percentages on the test weights. In addition to that, strict eligibility lists give the department heads the authority to appoint one of the top three on the list. When you rank candidates in the order of their final score, many times you are unable to reach that candidate required to fill the minority quota. That is probably the most difficult thing to work with under our present Civil Service Rules and Regulations." Councilman Cruz interjected a query regarding a Resolution adopted by the City of Los Angeles with reference to hiring practices for minority groups, to which Personnel Clerk Forsythe replied: "I am not familiar with their hiring practices, but I public employment does fall under the Equal Employment do file reports each year with the Commission as to sa ground, sex, race, etc. Each year we have to file a r to be able to show that you have raised your quota. I 35% Mexican -American population, and in our city emplc and we cannot hire above that under our current rules do know that Commission. You lary, ethnic back- eport and you have n our city we have yment we have 15%, and regulations. I am saying we should amend our rules and regulations to enable us to hire according to our population. That is my reference to affirmative action."
