Mayor Decker called the meeting to order and led in the salute to the flag. Invocation was given by Mr. Frank Herber of Church of Invocation Jesus Christ of Latter Day Saints.. Heads benefit of the audience. The Minutes of the meeting of 8/5/74 were approved as Ap vl. Min. corrected and the Minutes of the meeting of 9/19/74 were 87/74 & approved as submitted. 8/19/74 Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried to approve the Minutes as corrected and submitted. Councilman Rubio presented a plaque to Mrs. Lucio Cruz Prean, ylaque who has resigned from the Library Board of Trustees. to Mrs'. VAlo Cruz The hour of 7:30 p.m. being the time set for the public hearing,on the abatement of a substandard structure at Pub.Hrg.. re: 666 W. 2nd Street, Azusa, the Mayor declared the hearing Abatement of open. Substandard structure No one in the audience wishing to speak on this matter the hearing was closed. Moved by Councilman Solem, seconded by Councilman Rubio wo, and unanimously carried to close the hearing. Councilman Cruz offered the Resolution entitled: Res. #6245 adopted A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DETERMINING AND DECLARING THAT A -CERTAIN STRUCTURE IS AN UNSAFE BUILDING,AND A PUBLIC NUISANCE AND THAT THE SAME SHOULD BE ABATED. Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried that further reading be waived. Moved by Councilman Cruz, seconded by Councilman Rubio the Resolution be adopted. The Mayor presented the offer of Frank.0.:Ullrich to pur- Offer to pur- chase property at 5th and Virginia Streets, which had chase City been tabled from the 8/5/74 Council_"'meeting, owned property 5th & Virginia AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, SEPTEMBER 33 1974 Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to remove from the table. The City Administrator addressed Council and stated there was a joint report from the City Attorney and the City Administrator reflecting Mr. Ullrich's offer to purchase the..property at the appraised price of $300,000. If Mr. Ullrich acquires the lease and buys the building from Mr. Turell he is the one entitled to purchase the property; as long as he purchases it prior to the expiration of the 90 day lease. Councilman Cruz stated: "I think that this should be up for sale in an open bid; thatt'my personal opinion on this property now. Thereby, anybody 4dthin the City, County or State has a right to buy the property as this party here". Moved by Councilman Arkison, seconded by Councilman Solem that the City Attorney and the City Administrator enter into escrow and bring back the terms to Council.. The City Clerk presented the affidavit of proof of publication of the Notice Inviting Bids in the Azusa Herald on 8/12 & 8/22, 1974. Steed Brothers -.507,790.. Mr. Wendell Mounce, 3300 Temple Street, Los Angeles addressed Council. He made a presentation explaining why bids were over the estimate. He stated that the estimates were high because of labor costs and inflation. He`further offered several alternatives.. The plans and specifications are being checked by the architect, the City Engineer and contractor; who bid the ro ecT., to see if some items can be pre -negotiated p j , p g prior to awarding the contract. Wells, Finance Officer Cooney, City Clerk Solis. The City Clerk presented the affidavit of proof of pub- licatior of the Notice Inviting Bids in the Azusa Herald on 8/15.& 8/22, 1974. A communication was received from the Director of Public Works, in which he recommended that the bid be awarded to Crown Heating and Air Conditioning Company in the amount of $27,100 and authorize the Director of Public Works and the City Administrator to negotiate a change order in the amount of $1,033. This will bring the project within the budgeted figure. Moved by Councilman Arkison, seconded by Councilman Cruz and unanimously carried by roll call to award the bid for Project No. 506-1 to Crown Heating and Air Conditioning Company in the amount of $27,100, and authorize the City Administrator and Director of Public Works to negotiate a change order in the amount of $1,033. The City Clerk announced that bids were opened in his office at 10:00 a.m, on Thursday, 8/29/74, for the demolition of a structure at 348 N. Dalton Avenue, Azusa. Present at bid opening were: Director of Public Works Wells, Finance Officer Cooney, City Clerk Solis. The City Clerk presented the affidavit of proof of publication of the Notice Inviting Bids in the Azusa Herald on 8/15/74. No bids were received and it was the recommendation of the Director of Public Works that the City Council authorize the Public Works Department to demolish the structure and have the cost thereof placed as a lien against the property. Moved by Councilman Rubio, seconded by Councilman Arkison and unanimously carried to approve the recommendation of the Director of Public Works, Mr. Ira Calvert, Director of SGVMWD,.and representing 1 the City of Azusa, addressed Council and gave a report on the financial status of the water district. Also, he gave a summary re: new pipe line that starts north of San Bernardino near Silverwood Lake and continues to Sierra Madre Avenue. The pipeline is completed and is full of water which will be released the middle of the month. This water will come from the Feather River, and should take care of the Citys needs until the year 2020. He suggested that the City use its influence with the State Officials to try and get the peripheral canal built. This will bring a better quality of water south. It was 3,580. 29,580. 30250. 27,100. The City Clerk presented the request.from the Azusa Aztec Band Boosters to address Council regarding funding of their trip to Zacatecas. Mrs. Witt, 423 N. Lee Drive, Azusa and.other interested_' representatives spoke before Council giving a brief outline of the projects that the group had undertaken as fund raising means. They are still short of the needed amount by $3,024.76, and requested that the City donate that amount. The City Administrator suggested that perhaps through the Azusa Unified School District Community Service Fund the needed amount could be split between them and the City. Moved by Councilman Cruz, seconded by Councilman Solem and unanimously carried by roll call to donate $3,000 and have the City Administrator request that the school district, through its Service Community Fund, pay half of the $3,000. Req.from Az.. Aztec Band Boosters re: fund raising The City Clerk presented a request for authorization for Appvl.pymt.. payment of Notary Fees for the Deputy City Clerk,. Council for Notary suggested that the City Clerk should also become a Fees Notary. Moved by Councilman Solem, seconded by Councilman Cruz and unanimously carried by roll call to pay the Notarial fees for both the City Clerk and the Deputy City Clerk. AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, SEPTEMBER 3, 1974 Page 5 The City Clerk presented a letter from the City's insurance carrier stating that the claim of Mr. Earl Pickens against the City for food spoilage, when his electricity was turned off in error, in the amount of $15, could not be covered under our general liability policy because it carries a $100 deductible. Moved by Councilman Arkison, seconded by Councilman Solem and unanimously carried by roll call to authorize payment -in the amount of $15 for claim from Mr. Earl Pickens. ie Personnel Board submitted the resignation of Mrs. sanne Burian, Senior Secretary in the Personnel Office, effective 9-10-74. Mrs. Burian requested that her name be placed on a reinstatement list as provided for in the Civil Service Rules and Regulations. Moved by Councilman Arkison, seconded by Councilman Rubio and unanimously carried to accept Mrs. Burian's resignation and recommend approval for her name to be placed on the reinstatement list. Atty. re: reorganization If the City Council disestablishes the Library under of Cty.Library the provisions of the Education Code, and reestablishes it under the provisions of the Government Code, the action would eliminate the Board of Library Trustees, and vest the responsibility for determining the number of, appointing, and'fixing the compensation of all library employees in the City Council. It was the consensus of Council that there was no need to make any change in the Library at this time. The City Administrator submitted proposal documents for Proposal for community antenna cable television service within the Cable TV AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, SEPTEMBER 3, 1974 Page 7 City of Azusa. When the system is in operation it will produce revenue to the city in the amount of three per- cent of gross receipts. It is the recommendation of the City Engineer that the City Council approve the franchise documents and authorize the City Clerk to advertise the Notice Inviting Bids. The City Administrator submitted for Council consideration Rpt, re: No a report received from the Chief of Police and the Fire Parking in Chief re: no parking in shopping centers. Shopping.Cntrs. The City has no authority to regulate parking in the private parking facilities. The only solution is for the center management and the.store owners to make a cooperative effort to influence their customers to use the parking areas that they have laid out. Moved -by. The Finance Officer presented a proposed agreement between the City of Azusa and the Azusa Agricultural Water Company providing for the assumption by the City of the Company's accounting. ved by Councilman Solem, seconded by Councilman Rubio d unanimously carried to approve the agreement and thorize the Mayor and the City Clerk to execute the reement. The Police Chief submitted for Council confirmation the appointments, as Police Reserve Officers, for Louis Castel, Larry Roberts, and Larry Sweers. The Police Chief submitted the resignation of .Reserve Police Officer Blas Chavira, effective 8-27-74. The City Administrator submitted a request from the Req, for water Director of Public Works that the City submit a bid'to pumping rights the Azusa Valley Water Company for the leasing of excess (Az.Valley water pumping rights. These rights will cost $43 per acre Water Co.) AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, SEPTEMBER 3, 1974 Page 9 foot for our over-pumpage, and we do have a need for additional water. Moved by Councilman Arkison, seconded by Councilman Solem and unanimously carried to approve the recommend- ation of the Director of Public Works and direct the City Administrator to submit a bid to the Azusa Valley Water Company for leasing rights. 1ruivate ncilman Arkison suggested that perhaps the Conditional Remarks re: ce approval form should be reviewed. It seems we have problems at many problems at dances and wedding receptions, where dances & wedd. guards are employed. He wondered if perhaps more receptions guards are needed for the safety of the people attending. The Police Chief remarked that he felt that employing more guards was not the best solution, but if the hours were more controlled; perhaps have a 10 o'clock cut off time, especially at wedding receptions. The Acting City Attorney stated that the Conditional Dance Permit could be revised to state a definite time limit of 10 o'clock PM, and if not adhered to the permit could be revoked. The Fire Chief gave a report on the new fire truck the City -has received from the State for aid in fighting forest fires. Councilman Solem suggested that the City should send a representative to Zacatecas for the Governor's Inaugura- tion, preferably the Mayor or a Councilman that.has not been there. owed by Councilman Solem, seconded by Councilman Cruz nd unanimously carried by roll call to send the Mayor, Mayor Protem, or a Councilman, as representatives of the ty of Azusa, to the Governor's Inauguration in Zacatecas. It was_requested that the City Administrator send a letter to the Mayor of Zacatecas, and the Governor of Zacatecas inviting them to our Golden Days Celebration. Moved by Councilman Solem, seconded by Councilman Cruz and unanimously carried to approve the request and also to invite the Queen of the Zacatecas Fiesta. Councilman Rubio stated that he had a letter from the father of the two boys who were arrested on August 31, at the VFW. He requested that the City Administrator make copies of the letter and send to the other Council members and also the Police Chief. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried to approve the request and have the Police Chief submit a report to Council on the accusations in the letter. Rpt.frm.
