Mayor Decker called the meeting to order and led in Call to Order the salute to the flag. Invocation was given by Reverend Albert Duggan of St. Invocation Frances of Rome Church. ' Present at Roll Call: Councilmen: Rubio, Solem, Cruz, Roll Call Arkison, Decker Also Present: Acting City Attorney Lennard, City Administrator Dangleis, Director of Public Works Wells, Superintendent of Light & Power Gerharz, Police Chief Elkins, Acting Fire Chief Schad, Planning Director Fitz- simmons, Director: -of Parks & Recreation Guarrera, Finance Officer Cooney, City Clerk Solis. At the request of the Mayor, City Administrator intro- Intro.of duced Department Heads who were present, for benefit of Dept. Heads the audience. Minutes of adjourned meeting of 4/29/75, regular meeting Appvl.of Min. of 5/5/75 and adjourned meeting of 5/12/75 were submitted 4/29 75,5/5/75, for Council approval. & 5/12/75 Moved by Councilman Arkison, seconded by Councilman Solem and unanimously carried to approve minutes as submitted. Mrs. Pauline Asmus, 453 W. 2nd Street, Azusa, Bicentennial Mrs.P.Asmus Chairman, addressed Council and reported on projects rpt.on proj. proposed by Bicentennial Committee. for Bicenten= nial Mayor suggested that she contact City Administrator in order to discuss committee budget requirements.. Mr. Walter Keil, representative of Foothill CehtarnMer- Req.from W. chants, appeared before Council with request that Council Keil for waive fingerprinting policy for carnival employees of the waiver of Christiansen Amusement Corp., San Bernardino. He stated fingerprint. that the carnival owners would use city people and some of carnival transients and that all information concerning these employees & employees would be available. The purpose of this carni- license fees, val is to raise funds for the Azusa Aztec Band Boosters Club. He also requested that the license fee of $350. be waived since this is for a non-profit organization. He advised that 20% of gross receipts would be turned over to the Band Boosters. Chief Elkins advised Council of importance of finger- printing carnival employees; that many times warrant arrests have been made, also, fingerprints and pictures are available if any violations are committed. Moved by Councilman Cruz, seconded by Councilman Rubio and carried by roll call that the $350. license fee be waived. Mayor Decker dissenting as he wished to discuss the agreement with Band Boosters prior to waiving fees. Moved by Councilman Rubio, seconded by Councilman Cruz and unanimously carried by roll call that request for waiver of fingerprinting carnival employees be denied. The City Clerk presented two claims against the City: Claims vs. City 1. General Telephone Co., for alleged damage to Gen.Tel.Co.& underground communications by City's backhoe at C.IU4 Wocholz Santa Fe Ave., on 2/26/75. Wocholz, 201 Grandview, Apt. #205, Covina, for alleged use of excess force by police officers resulting in injuries to left arm and wrist on 3/$/75. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried to deny and refer to City's insurance carrier. A Notice was received from Alcoholic Beverage Control for application for On Sale Beer and Wine - Bona fide public eating place (new license) by Albert L. and Rita H. Tarozzi, for premises at 351 S. Irwindale Ave. Aplicants previously applied for license transfer at 3&7 S. Irwindale and application was protested and withdrawn. Police Chief Elkins advised Council that due to new license being for a public eating place with only -beer and wine served, and not for a bar, that he had no objections. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to receive and file. Moved by Councilman Solem, seconded by Councilman Arkison and unanimously carried to refer to Parks and Recreation Commission with report of decision to art group requesting use of park. City Treasurer's Financial Statement was submitted show- City Treas. ing a balance of $2,556,140.61 as of April 30, 1975. Fin.Statemt. Request was received from Personnel Board to amend three Pers.Bd.amend job descriptions in Police Department to allow substitu- job.descrip. tion of a GED certificate for high school graduation of 3 classif. requirement. in P.D. This request was submitted as part of the EEO committee's review of job classifications within the City. This change would seem justified as GED certificates are commonly accepted; also all classifications in the Police 'Department would then be equitable. Moved by Councilman Solem that amendment be referred to City Attorney for preparing necessary Ordinance; motion withdrawn due to amendment in job classifications not being governed by Ordinance. Moved by Councilman Arkison, seconded by Councilman Cruz and carried by roll call to approve the recommendation of Personnel Board. Councilman Rubio dissenting as he felt this would lower standards and caliber of prospective employees. city Clerk submitted a request from"The Starving Artists" Req.for use use of mini -park on corner of Azusa Ave. and Foot- of mini -park 'for hill Blvd. set up with for an Art regard to Fair. An Ordinance was presented for second reading amending Ord.for 2nd Municipal Code relating to business license taxes (Min- rdg.re: Mineral Ex- eral Extraction Tax). traction Tax City Administrator Dangleis advised Council of Finance removedfrom officer's report on excavation tax which disclosed Ag enda - Tabled information covering two quarters, with a drop in sales tax of 48% and tonnage 2%. It was recommended that the Ordinance remain unchanged until information for the last two quarters of this fiscal year is available in Septem- ber. If at that time there has not been a substantial change in the percentage of taxable sales then an amend- ment to the Ordin&rna would be in order. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to table this item until the first meeting in September. Director of Public Works submitted the Notice of Comple- Notice of Completion tion for Project No. 525, Telemetering Control System (Proj.#525) additions for Azusa water division. It was his recommendation that City Council approve Project No. 525, authorize the Mayor and City Clerk to execute document and process it for recordation with County Recorder. AZUSA AUDITORIUM AZUSA, CALIFORNIA TUESDAY, MAY 27, 1975 Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried to approve recommendation of Director -of Public Works. Director of Public Works also submitted Notice of Completion for Project No. 545, reroofing of west and east wings of City Hall. The original contract was for $28,620., but due to color and texture of existing roofing that was to be salvaged a change of $1,400. was necessary, bringing total cost to $30,020.00 'It was his recommendation that City Council approve the reroofing project and direct the City Clerk to file Notice of Completion with the Los Angeles County Recorder. Following discussion, it was, Moved by Councilman Arkison, seconded by Councilman Solem and unanimously carried to approve recommendation of Director of Public Works. A proposed Resolution was presented accepting Grant Deed re: acquisition of right-of-way for improvement of Arrow Highway. Councilman Arkison offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ACCEPTING A GRANT DEED AND DIRECTING THE RECORDATION THEREOF. Moved by Councilman Arkison, seconded by Councilman Cruz and unanimously carried that further reading be waived. Moved by Councilman Arkison, seconded by Councilman Cruz that Resolution be adopted. Resolution passed and adopted by following vote of Council: AYES: Councilmen: Rubio, Solem, Cruz, Arkison, Decker NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution 6298. Request for Council adoption of 1975 Los Angeles County Building Laws with changes. It was the recommendation of Director of Public Works that City Council direct the City Attorney to prepare a Resolution or Ordinance embodying the Los Angeles County Building Laws into the Municipal Code with the exception of the substandard building abatement portion. Discussion was held regarding requirement for installing smoke detectors in residential occupancies. Moved by Councilman Cruz, seconded by Councilman Arkison and unanimously carried that Director of Public Works make a report on cost of smoke detectors for 6/2/75 meet- ing, and City Attorney to prepare necessary Ordinance. Communication was received concerning Los Angeles County Flood Control District excess property for sale. Examination of the excess property revealed tka t it could not be used for parks and it was recommended that City Administrator be authorized to communicate to Flood Con- trol District advising that the City of Azusa has no interest in this property. Request was submitted for Eric Pfisterer, RPO, Civil" Req.E.Pfisterer to attend the Peacetime Radiation Incident attnd.Radiation 'Defense, Training course at Pasadena Training Center June 9-13, Training,Pasa- 1975, expenses not to exceed $50.00 with half being dena 6/9-13 paid by the Office of Emergency Services. 708 N. Azusa Ave. (Leo Nasser) was discussed. Director Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried by roll call to approve request. Ave. Request was received from Director of Parks & Recreation Req.Counc. for Council opposition to Assembly Bill 1911, dealing opposition with subdivisions. AB 1911 - subdivisions Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried that Mayor be authorized to Claims & send letter to proper officials protesting passage of A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA this bill. City Administrator suggested the date of June 19th, City Hall 7:00 P.M. for dedication ceremony of City Hall with Dedication Open House to follow until 9:00 p.m. The evening 6/19 ceremony was recommended because more members of the public could attend. City Administrator apprised Council of official request 3 Cities to of the cities of Azusa, Covina and West Covina to participate participate in the validation project of Phase II of the in Fire Service Long Range Planning Grant #4-90105 known also as Long Range Study Planning for the Fire Service. Moved by Councilman Solem, seconded by Councilman Arkison and unanimously carried to approve date of 6/19/75 for the dedication of city hall. Council pending item regarding status of building at Re:bldg.at 708 N. Azusa Ave. (Leo Nasser) was discussed. Director 708 N.Azusa of Public Works advised that he was unable to meet with Ave. structural engineer to date and that he would have a (Leo Nasser) positive or written report for Council meeting of 6/2/75. City Clerk read in full a Resolution entitled: Res. #6299 Claims & A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Demands ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Moved by Councilman Solem, seconded by Councilman Cruz that Resolution be adopted.
