Mayor Decker called the meeting to order and led in the salute to the flag. i Invocation was given by Rev. Albert Duggan of St. Frances of Rome Church. Call to Order InvocAtion Moved by Councilman Arkison, seconded by Councilman Cruz and unanimously carried to close the hearing. City Attorney presented for second reading and adoption Ord. #2011 an Ordinance entitled: amend.M.C. re:adopting AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA Azusa Health AMENDING SECTION 7.014.010 OF THE AZUSA MUNICIPAL CODE Code ADOPTING BY REFERENCE CERTAIN ORDINANCES OF THE COUNTY OF LOS ANGELES AMENDING THE P?'3LIC HEALTH CODE OF THE COUNTY OF LOS ANGELES. City Attorney and City Clerk stated procedures for recording minutes. Moved by Councilman Cruz that he would like to have state- ments by Police Chief and Art Morales included in minutes of November 3rd meeting. Motion died for lack of a second. Councilman Arkison requested that a correction be made on Correction page 8 of November 3rd minutes re: request for financial 11/3/75 assistance by Azusa High Band Boosters, the vote was not Minutes — unanimous as he had voted no. City Clerk advised him correction would be made. Moved by Councilman Solem, seconded by Councilman Rubio Appvl.Min, and unanimously carried to approve Minutes of November 3, of 11/3/75 1975, as corrected. as correctec The hour of 7:30 p.m. being the time set for Public Hearing Puh.Hrg. amending Section 7.04.010 of the Azusa Municipal Code amend.M.C. adopting by reference certain Ordinances of County of Los adopt.by Angeles Health Code, as amended to October 1, 1975, is reference adopted as the Public Health Code for the City of Azusa, Health Code the Mayor declared the hearing open. for City of Azusa City Clerk presented affidavit ofproof of publication of notice of this hearing which was published in the Azusa Herald on november 6, 1975. There being no one in the audience wishing to be heard, it was Moved by Councilman Arkison, seconded by Councilman Cruz and unanimously carried to close the hearing. Ordinance passed and adopted by the following vote of Council: AYES: Councilmen: Rubio, Solem, Cruz, Arkison, Decker NOES: Councilmen: None ABSENT: Councilmen: None Jerry Leonard representative from Baxter Ward's Office, member of Los Angeles County Board of Supervisor's, addressed Council re: a proposal for a 270 mile grade separation 75 mile per hour route for Los Angeles County. At the conclusion of his technical commentary, and subse- quent to answering questions directed to him by Council, he solicitated Council's support to promote this system to its constituents, in order to assure the passage of the issue in the June primary election. No action taken by Council. Albert Velasquez, representative from Lampman Associates, addressed Council re: proposed alignment of natural gas M (methane) line from Azusa Western's disposal pits, to t*- Miller Brewery Co. Present proposed alignment calls for ,M4 12" line to run north on Coney Ave. across the 210 Freeway, U east on 5th St. to Virginia, north across Foothill Blvd. U to Georgia St., east on 8th St., to Miller Brewery Co. property, at the corner of Vernon Avenue. Director of Public Works and Mr. Velasquez then answered questions directed to them by Council. It was the general consensus of Council that proposed alignment is satis- factory. Azusa's Bicentennial Committee requested Council approval for their scheduled "All American Day Parade", to be held ' February 22, 1976. Main participants will be schools and activity groups within the City of Azusa. Moved by Councilman Cruz, seconded by Councilman Solem and unanimously carried that request be granted. City Clerk presented the following claims against the City: 1. John Eugene Wright aka John Tikhonoff, 638 W. Virginia Ann Dr., Azusa, for alleged assault by Azusa Police Officers on July 6, 1975. 2. Richard Salazar, 611 N. San Gabriel, Azusa for alleged assault by Azusa Police Officers when arrested on June 22, 1975. 3. Alfredo C. Salazar, 611 N. San Gabriel Ave., Azusa, for alleged assault by Azusa Police Officers when arrested on June 22, 1975. 4. Dolores A. Garner, 636 S. Gaybar Ave., West Covina, for alleged damage to vehicle and injuries to right side of neck and shoulder, due to traffic collision by City employee in City vehcile, on November 12, 1975. He further advised Council of possibility, in view of increased election expenses for March 2, 1976, election, 'to establish a $25 filing fee, as is done by other cities. Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried that a $25 filing fee be required for all Candidates running for office in the March 2, 1976, Municipal Election. An Ordinance was presented for introductory first reading 1st intro. amending Azusa Municipal Code, Section 5.12.110 relative rdg.Ord. to extraction and/or processing of rock, sand, gravel of amend.M.C. similar material, a license tax of one and one-half cents re:excavation per ton, shall be paid by every person who engages in this tax business. Councilman Rubio offered for introductory first reading an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 5.12.110 OF THE AZUSA MUNICIPAL CODE AND PROVIDING THAT THE SAME SHALL TAKE EFFECT IMMEDIATELY AS A TAX LEVY FOR THE ORDINARY EXPENSES OF THE CITY. A proposed Resolution was presented readopting Par. 1 of Res. #6348 Section 36 of the Civil Service Rules and Regulations, re: mtgs. relating to meetings of the Personnel Board. Regular of Pers.Bd. meetings of the Personnel Board shall be held twice monthly (7:30 PM) on the second and fourth Tuesdays of the month at 7:30 p.m. Councilman Arkison offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA READOPTING PARAGRAPH 1 OF SECTION 36 OF THE CIVIL SERVICE RULES AND REGULATIONS, RELATING TO MEETINGS OF THE PERSONNEL BOARD. Moved by Councilman Arkison, seconded by Councilman Rubio and unanimously carried that further reading be waived. Resolution passed and M adopted by the following vote of Council: AYES: Councilmen: Rubio, Solem, Arkison, Decker NOES: Councilmen: Cruz V ABSENT: Councilmen: None A proposed Resolution was presented authorizing appropriate Res. #6349 re: officers of the County of Los Angeles to cancel certain cancellation taxes and assessments of the City without the consent of of certain City Attorney. The Revenue and Taxation Code Section 4986 taxes has now been amended to provide that written consent of the City Attorney need not be obtained if Council, by Resolution has authorized cancellation by appropriate County Officers. Councilman Rubio offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AUTHORIZING APPROPRIATE OFFICERS OF THE COUNTY OF LOS ANGELES TO CANCEL CERTAIN TAXES AND ASSESSMENTS OF THE CITY WITHOUT THE CONSENT OF THE CITY ATTORNEY OR OTHER OFFICER OF THE CITY, Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried that further reading be waived. Calif.Edison He recommended that City of Azusa join forces with Co. other cities in opposition to this rate increase and request a stay for five months. Also, that City Council authorize City Administrator and Superintendent of Light & Power to enter into a rate adjustment study with an outside consultant for purpose of offsetting this new Edison rate. Superintendent of Light & Power presented an Agreement for Consulting Engineering Services - Rate Study, from R. W. Beck & Associates, total cost of this service not to exceed $63900. plus 15%. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried by roll call that City of Azusa pp join forces with other cities in opposition to this rate increase and requesting a stay of five months. �r Moved by Councilman Rubio, seconded by Councilman Solem and carried that City of Azusa enter into a rate adjust- ment study with R. W. Beck & Associates. Police Chief submitted to Council report from District Rpt.from Attorney's Office stating "..it is apparent that death D.A.'s of Melisio Torres Solis occurred as the result of an Off. re: accidental fall or falls from bunk in the prison cell death of of City of Azusa jail." Melisio Moved by Councilman Arkison, seconded by Councilman Rubio Solis and unanimously carried to receive and file. Police Chief submitted resignation of Police Officer Resign.Pol. William Chin, effective November 17, 1975. Mr. Chin Off.Wm.Chin has accepted a position with Santa Ana Police Department, eff.11/17/75 and requests his name remain on eligibility list for considera- tion for re-employment. Councilman Solem offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA COMMENDING STANLEY HOSFORD UPON HIS RETIREMENT AFTER ELEVEN YEARS OF SERVICE WITH THE CITY. Res. #6350 commending Stanly Hosford upon his retirement After discussion relating to boundaries, and inclusion of County Supervisors as members, it was Moved by Councilman Rubio, seconded by Councilman Solem that the City of Azusa join the Association. Motion filed by the following vote of Council: AYES: Councilmen: Rubio NOES: Councilmen: Solem, Cruz, Arkison, Decker ABSENT: Councilmen: None Moved by Councilman Rubio that Council adopt Organizational Resolution of San Gabriel Valley Association of Cities. Motion died for lack of a second. City Administrator reminded Council of the need for Council's recommendations for the Fire Validation Steering Committee. Notice was received from LAFCO of proposed annexation to City of Glendora of the area east of Citrus Avenue and north of Foothill Blvd. After discussion, it was Moved by Councilman Arkison, seconded by Councilman Rubio and unanimously carried to refer to Planning Director and City Attorney for a report at next Council meeting. Mr. Jim Lee, 327 Annandale Lara, Azusa, thanked Council and City Attorney's office on behalf of Carefree Azusa Condominium Homes, for their assistance in the matter with Hallcraft Homes re: problem of broken water lines. Recomm.for Fire Valida- tion Steering Comm. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried that further reading be waived. Moved by Councilman Solem, seconded by Councilman Rubio that the Resolution be adopted. Resolution passed and adopted by the following vote of Council: AYES: Councilmen: Rubio, Solem, Cruz, Arkison, Decker NOES: Councilmen: None ABSENT: Councilmen: None M Councilman Rubio reported on meeting of San Gabriel Valley Rpt. from Association of Cities which he attended. His report Counc.Rubio covered two main areas. The first was on the need for re: San Gab. U cities to obtain support from the legislature for changing Valley U rules relative to formation of a new County. The second Assoc. of area had to do with the by-laws of the association re: Cities $350 annual dues, as an interium requirement until such time as the association establishes permanent requirements. This item was to be brought back to the Cities for action. Councilman Rubio recommended that the City join the association as a member.
