Mayor Decker called the meeting to order and led in the Call to Order salute to the flag. Invocation was given by Rev. John Handley of Azusa Church Invocation of Christ. Council approval. 1/5/76 ' Moved by Councilman Rubio, seconded by Councilman Cruz and unanimously carried to approve minutes as submitted. The hour of 7:30 p.m. being the time set for Public Hearing Pub.Hrg.to to amend the General Plan of the City of Azusa by addition amend Gen. of the Housing Element, the Mayor declared the hearing open. Plan by add. Housing City Clerk presented affidavit of proof of publication of Element notice of this hearing which was published in the Azusa Herald on January 8, 1976. Planning Director addressed Council explaining state law requirements to provide adequate housing for all elements of the City. The Housing Assistance Plan which Council has adopted is a start toward meeting some of these needs. He then answered questions directed to him by Council concerning the Housing Element Report, which had been prepared by Planning staff. There being no one else in the audience wishing to be heard, it was Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to close the hearing. ' A proposed Resolution was presented amending the General Res. #6370 Plan by addition of the Housing Element. adopting Housing Councilman Rubio offered the Resolution entitled: Element A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ADOPTING THE HOUSING ELEMENT OF THE GENERAL PLAN OF THE CITY OF AZUSA. City Clerk presented the following claim against the City Claim vs City U by Myrtle M. Lauer, 109 S. Sunset Ave., for alleged U damage to fence due to a traffic collision by Azusa Police Officer, on December 24, 1975. Moved by Councilman Cruz, seconded by Councilman Solem and unanimously carried to forward to City's insurance carrier. City Clerk presented claim against the City by Nick Claim vs City Milazzo, 5216 Garypark Ave., Arcadia, for alleged damage (denied) to motorcycle from hitting hole in street (Foothill Blvd.), ' on January 4, 1976. This claim is under the City's current $500 maximum deductible. City Administrator having investigated, recommended that claim be denied. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried to deny the claim. Notice was received from Alcoholic Beverage Control of ABC Notice original license application from Harry R. Carotenuto 377--V. Notice was given that Planning Commission, by Resolution P.C.Res.#1252 No. 1252 denied a Variance application (upon request of denied Var. applicant) allowing reduced parking of 27 spaces instead application of required 42 spaces, on pproperty located at 693 E. Krout) 2.24, 1 J 1 AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, JANUARY 19, 1976 Notice was also given that Planning Commission, by Resolu- tion No. 1254 conditionally granted a Variance request allowing a reduced distance between dwelling and accessory building (garage) of 41, instead of required 10' and reduced side yard setback of 3', instead of required 5', on property located at 705 W. 4th St. (Case V-444 Frances Sherman). No action taken by Council. Notice was further given that Planning Commission, by Resolution No. 1255 recommended to City Council approval ' of change of zone for Azusa Valley Sanitarium (Western Precast), from C-3 to M-2, on property located at 1320 W. Gladstone Street. Hearing set before Council on February 2, 1976. A communication from Planning Director was submitted to Council informing them Mr. Soelberg met with City Engineer and Planning Director and discussed possibility of filing a new parcel map that would only split off the property proposed to be developed by McDonalds. Mr. Soelberg 00 appeared before the Planning Commission and requested C., that his application for Tentative Parcel Map No. 5981 be withdrawn. V Moved by Councilman Rubio, seconded by Councilman Solem U and unanimously carried to approve Mr. Soelberg's request to withdraw subject Tentative Parcel Map. An Ordinance was presented for introductory first reading adding Sections 15.04.131 to 15.04.141, inclusive, to the Azusa Municipal Code thereby amending the Building Code of the City of Azusa. Councilman Solem offered for introductory first reading an Ordinance entitled: 'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTIONS 15.04.131 TO 15.04.141, INCLUSIVE, TO THE AZUSA MUNICIPAL CODE THEREBY AMENDING THE BUILDING CODE OF THE CITY OF AZUSA BY AMENDING THAT CERTAIN COUNTY OF LOS ANGELES UNIFORM BUILDING LAWS, 1975 EDITION, HERETOFORE ADOPTED BY REFERENCE. Moved by Councilman Solem, seconded by Councilman Cruz and unanimously carried by roll call that further reading be waived. A proposed Resolution was presented commending the Azusa Woman's Club on its 75th Anniversary. Councilman Rubio offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA COMMENDING THE AZUSA WOMAN'S CLUB ON THE OCCASION OF ITS 75TH ANNIVERSARY. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to receive and file. A notice was presented that Light & Power Department enter into an Agreement for Installation and Removal of Electric Distribution Facilities for Supplying Electrical Energy for Power and Lighting Service with Covina Thread- ing, 310 N. Alameda Ave.. Azusa. A charge of $800. was required for this service. Cerritos Ave. During discussion Councilman Rubio expressed his concerns over area property owner dissatisfaction with widening of street. City Attorney stated that if Council decides to revise the plans and specifications for reconstruction of Cerritos, it could withdraw current request for bids; however, the Resolution could be adopted at this time. He also stated that City could request only those funds covering the improvement of Cerritos, not reconstruction. Councilman Solem offered the Resolution entitled: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REQUESTING AN ALLOCATION OF COUNTY AID TO CITIES FUNDS FOR THE RECONSTRUCTION OF CERRITOS AVENUE FROM FOOTHILL BOULEVARD TO 382.5 FEET SOUTH OF THE CENTERLINE OF SIXTH STREET. Resolution passed and adopted by the following vote of Council: AYES: Councilmen: Rubio, Solem, Cruz, Decker NOES: Councilmen: None ABSENT: Councilmen: Arkison Moved by Councilman Cruz, seconded by Councilman Solem and unanimously carried to withdraw call for bids for improve- ment of Cerritos Ave. Moved by Councilman Rubio, seconded by Councilman Cruz to request Director of Public Works to prepare revised plans and specifications for modified improvement of Cerritos ' Ave. City Administrator submitted an Agreement between City of Azusa and Azusa Valley Water Co., for lease of 1,000 acre ft. of water rights. City Administrator advised Council that some time ago Council approved negotiations with Azusa Valley Water Co. for 1,000 acre ft. of water rights. At that same time city submitted a bid to Fruit Street Water Co. for purchase and lease of water rights. City has been notified that it is high bidder, and will be notified if Fruit Street Water Co. elects to dispose of these rights. However, Azusa did not receive sufficient pumping rights for needs of its citizens. Azusa Valley does have an excess , and we have leased water rights from them for the past three years. The price of the water is $38 per acre ft. This is $5 per acre ft. below the amount we would have to pay the Watermaster of San Gabriel Valley Water District. After discussion, it was Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried by roll call to approve Agreement and authorize Mayor and City Clerk to execute same. City Administrator reported on Monrovia Nursery land Monrovia reclamation project to Council. He, Director of Public Nursery land Works and Planning Director had appeared before the reclamation Los Angeles County Department of Regional Planning to project oppose this project. It was their feeling that the CUP Case No. 805-1 would be approved. If Council wishes to appeal this decision, it must do so to the County Board of Supervisors. Moved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried by roll call to advise City Administrator to appeal CUP Case No. 805-1, Monrovia Nursery land reclamation project, by writing a letter to County Board of Supervisors. Request from Azusa Bicentennial Committee for Council Appvl.for approval to hang banner on Foothill Blvd. between Azusa Bicentennial and San Gabriel Avenues, announcing their All American Committee to Day Parade, to be held on February 22, 1976, at 2:00 P.M. hanggbanner annMoved by Councilman Cruz, seconded by Councilman Rubio and unanimously carried that request be granted. City Administrator brought to Council's attention the latest Legislative Bulletin from League of California Cities concerning SB 1294, re: Compulsory and Binding Arbitration for Policemen and Fireman. LCC recommended that all cities strongly oppose this legislation. City Administrator presented a proposed letter to be sent to Members of the Senate Revenue & Taxation Committee expressing City of Azusa's opposition. He also stated the net result if SB 1294 is passed, would be financial disaster for cities, and lack of control. After discussion, it was Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to send letter. City Administrator presented to Council information re: public hearing to be held on January 22, 1976, concerning 1976-77 county budget issues. Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried to direct City Administrator to write a letter to each member of County Board of Super- visors urging them to hold salaries within reason. City Administrator answered that intern programs heretofore have been merely vehicles to provide experience for pro- fessional people enrolled in academic programs, and do not service as means for permanent employment. In light of current continuance surrounding CRA activities, Ralph Ander- Councilman Cruz suggested copies of Ralph Anderson's CRA son's CRA report be obtained for use by Council Members and Planning Report Department. Moved by Councilman Cruz, seconded by Councilman Rubio that City purchase a copy of Ralph Anderson's CRA report go for each Councilman and the Planning Department. t1.
