HomeMy WebLinkAboutD-1 Staff Report - Azusa CVRA PH 4 By-District ElectionsPUBLIC HEARING D-1 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: MARCO MARTINEZ, CITY ATTORNEY DATE: FEBRUARY 20, 2024 SUBJECT: PUBLIC HEARING - CONSIDERATION AND DISCUSSION OF COMPOSITION OF VOTING DISTRICTS FOR BY-DISTRICT ELECTIONS IN COMPLIANCE WITH THE CALIFORNIA VOTING RIGHTS ACT; AND REVIEW OF DRAFT MAPS BACKGROUND: The California Voting Rights Act (“CVRA”) became law in 2003. It provides instructions for transitioning a jurisdiction from an at-large election system to a different system - typically a by- district or by-division election system. On March 28, 2022, the City Council adopted Resolution No. 2022-C26, declaring its intention to transition from its current at-large electoral system to a by- district electoral system. On November 6, 2023 and December 4, 2023, the City Council conducted the first two of four (4) required hearings to receive public input on the transition. At those hearings, the City Council received public input and discussed the various demographic and map options they wished staff and the City’s consultant demographer to study. With that analysis complete, the City Council conducted its third public hearing to make an initial review of the draft maps on January 16, 2024. At its meeting of January 16th the Council also determined the electoral maps should consist of five districts with a rotational mayor. The hearing tonight represents the fourth public hearing, and second hearing to review draft maps and accept additional comments with the goal of having a final district map adopted in time for the November, 2024 General Municipal Election. RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1) Conduct a public hearing to receive and consider any public input; 2) Conduct further review of draft voting district maps; and Approved City Council February 20, 2024 Map 5.7 Selected Public Hearing: Composition of Voting Districts for By-District Elections and Review of Draft Maps February 20, 2024 Page 2 3) Provide further direction to City staff regarding the selection of a map; and the election schedule (sequencing) of voting districts: ANALYSIS: Previous staff reports described the milestones required under the CVRA. These included: 1. The Adoption of a Resolution of Intention. The Council adopted such a Resolution on March 28, 2022. 2. Two Public Hearings Prior to Drawing of District Maps. These hearings were conducted on November 6, 2023 and December 4, 2023. 3. Preparation and Review of Map(s). These were presented on January 16, 2024. At that time, the Council directed staff and its demographic consultants to focus on maps reflecting five (5) voting districts. Continued Discussion & Public Hearings for Map Consideration. As noted in prior staff reports, after draft map(s) have been prepared, the City must publish and make them available to the public. The City must also show the staggered terms of office and the potential sequence of the elections. A total of six (6) draft maps were presented for review at the January 16th hearing. The City Council also determined that the preferred electoral map should consist of five Council districts, with a rotational mayor. A final deadline of February 5, 2024 was established for the public to submit any further proposed maps. This deadline allowed the City’s demographic consultant sufficient time to review and analyze any publicly submitted maps. After the last hearing on January 16, 2024, additional maps were submitted. The maps to be discussed tonight include a map revision to the consultant’s map 5.1 (following input from the Council), and three (3) new publicly submitted maps. All of the draft maps were posted to the City’s website on Tuesday, February 13, 2024. Under the CVRA, maps are required to be posted for seven (7) days prior to any hearing at which maps will be formally considered. Map Adoption. The Council, after selecting a map and choosing the timing and sequence of the elections, would then adopt an ordinance providing for by-district elections, approve the map, and begin implementing by-district elections. For Azusa, the first by-district election will occur at the November 2024 General Municipal Election. A fifth public hearing for the introduction of the Ordinance is scheduled for March 4, 2024. Summary of Tonight’s Actions At Council’s direction, the City’s demographic consultant initially prepared two maps with a four district configuration, for use with the City’s current directly-elected Mayor, and two maps with a five district configuration, for use with a rotational Mayor. Following the hearing on January 16th, the consultant revised Map 5.1 to place Cerritos Avenue into a single district, and moved the area surrounding Memorial Park from District 5 into District 3. These changes are reflected in new Map 5.5. Two additional five district maps were received from members of the public, resulting in a total of seven maps with a five district configuration. One additional four district map was received from a member of the public, for a total of three maps with a four district configuration. The draft maps are summarized below: Four District Maps Previously Considered Maps 1. Map 4.1 – Deviation 5.16% (from Demographer) Creates two majority/minority Hispanic Voting Districts The districts are compact and contiguous. 2. Map 4.2 – Deviation 3.63% (from Demographer) Creates three majority/minority Hispanic Voting Districts The districts are compact and contiguous. New Map for Consideration 3. Map 4.3 – Deviation 3.74% (from Public) Creates three majority/minority Hispanic Voting Districts The districts are compact and contiguous, Five District Maps Previously Considered Maps 1. Map 5.1 – Deviation 5.53% (from Demographer) Creates three majority/minority Hispanic Voting Districts The districts are compact and contiguous. 2. Map 5.2 – Deviation 1.59% (from Demographer) Creates three majority/minority Hispanic Voting Districts The districts are compact and contiguous. 3. Map 5.3 – Deviation 6.80% (from Public) Creates three majority/minority Hispanic Voting Districts The districts are compact but District 5 is not contiguous. This map is not viable as submitted. 4. Map 5.4 – Deviation 1.08% (from Public) Creates three majority/minority Hispanic Voting Districts The districts are compact but District 5 is not contiguous. This map is not viable as submitted. Public Engagement To increase public awareness of the transition to by-district elections, the City uses a variety of public communication channels to engage members of the community. Districting information will continue to be featured on the City’s website at the following web address: https://azusaca.gov/2028/Districting-Establishing-2024-Voter-Dist. The City’s website is populated with information about how the public can participate and also provides answers to frequently asked districting questions. In addition, the link to the online mapping tool was provided on December 5, 2023, and the public submitted a total of five maps for evaluation and Council’s consideration.
