JIMENEZ, DIRECTOR OF ECONOMIC & COMMUNITY DEVELOPMENT DATE: MARCH 4, 2024 SUBJECT: REQUEST TO AMEND A CONTRACT WITH STREETLIGHT RESTORATION SPECIALISTS, INC. TO PAINT STREET LIGHTS AND BOLLARDS IN DOWNTOWN AZUSA BACKGROUND: On July 19, 2023, the City Council was presented with options for street furniture and overall color scheme for the Downtown area. Based on recommendations from the Arts in Public Places Commission and the planning Commission, the City Council provided direction on the final furniture design and color for Downtown Azusa, On December 4, 2023, after considering three informal bids that were received pursuant to AMC Section 2-532 Informal Bidding Procedures, the City Council approved an award of contract in the amount of $95,843 to Streetlight Restoration Specialists, Inc. to prepare, prime and repaint street lights poles and bollards in Downtown Azusa. The quote included painting of the of 88 dual arm decorative light poles, 59 decorative bollards and traffic lights at 5 intersections along Azusa Avenue spanning from 5th Street at the south, to 9th Street to the north. Shortly after work began, it was determined that the fixtures would require additional surface preparation and priming prior to painting in order to achieve an appropriate level of aesthetic standard for the City. Additionally, there were 32 light poles not considered in the original quote that need to be added to the scope of work. Accordingly, Street Light Restoration Specialists, Inc., provided a quote to consider the added preparation work and additional fixtures. Approved City Council March 4, 2024 Public Works Contract – Streetlight Painting March 4, 2024 Page 2 RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1) Amend an existing Public Work contract by increasing the contract amount to a maximum of $145,000 for Streetlight Restoration Specialists, Inc. The contract is for the preparation, priming, and repainting of street lights, poles, and bollards in Downtown Azusa; and, 2) Authorize the City Manager to execute the Public Works Contract and approve any non- substantive revisions, in a form acceptable to the City Attorney, on behalf of the City. ANALYSIS: The proposed project will include preparation and repainting of decorative street lights, existing bollards, and traffic lights at 5 intersections along Azusa Avenue from 5th Street to 9th Street, as well as any matching fixtures on 9th Street and San Gabriel Ave. Timing and proper notification of painting to affected businesses and residents will be executed by the Contractor and City staff. The original contract was awarded for $95,843. Table 1 shows a breakdown of the original contract, cost of additional preparation and priming prior to painting, added poles not considered, along with the updated total cost. Staff is requesting an additional $7,000 for contingencies as approved by the City Manager. This would bring the total requested contract amount to $145,000. Jimenez Planning Manager Economic & Community Director Reviewed and Approved by: Sergio Gonzalez City Manager Attachment: Public Works Contract BONDS - 1 - CITY OF AZUSA STANDARD CONTRACT AZUSA BOULEVARD STREETLIGHT AND INTERSECTION POLE BEAUTIFICATION PROJECT THIS CONTRACT is made this 4th day of March, 2024, in the County of Los Angeles, State of California, by and between the City of Azusa, hereinafter called City, and Streetlight Restoration Specialists, Inc., hereinafter called Contractor. The City and the Contractor for the considerations stated herein agree as follows: ARTICLE 1. SCOPE OF WORK. The Contractor shall perform all Work within the time stipulated in the Contract and shall provide all labor, materials, equipment, tools, utility services, and transportation to complete all of the Work required in strict compliance with the Contract Documents as specified in Article 5 below for the following Project: AZUSA BOULEVARD STREETLIGHT AND INTERSECTION POLE BEAUTIFICATION PROJECT The Contractor and its surety shall be liable to the City for any damages arising as a result of the Contractor’s failure to comply with this obligation. ARTICLE 2. TIME FOR COMPLETION. The Work shall be commenced on the date stated in the City’s Notice to Proceed. The Contractor shall complete all Work required by the Contract Documents within 6 weeks from the commencement date stated in the Notice to Proceed. By its signature hereunder, Contractor agrees the time for completion set forth above is adequate and reasonable to complete the Work. ARTICLE 3. CONTRACT PRICE. The City shall pay to the Contractor as full compensation for the performance of the Contract, subject to any additions or deductions as provided in the Contract Documents, and including all applicable taxes and costs, the sum of $138,020 One Hundred Thirty-Eight Thousand Twenty Dollars and Zero Cents ($138,020). The City Manager may agree to additional items, such as additional poles and/or bollards, beyond this amount, not to exceed a total contract amount of One Hundred Forty Five Thousand Dollars ($145,000). Payment shall be made as set forth in the General Conditions. ARTICLE 4. LIQUIDATED DAMAGES. In accordance with Government Code section 53069.85, it is agreed that the Contractor will pay the City the sum of $500 for each and every calendar day of delay beyond the time prescribed in the Contract Documents for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. In the event this is not paid, the Contractor agrees the City may deduct that amount from any money due or that may become due the Contractor under the Contract. This Article does not exclude recovery of other damages specified in the Contract Documents. Attachment 1 BONDS - 2 - ARTICLE 5. COMPONENT PARTS OF THE CONTRACT. The “Contract Documents” include the following: Contractor’s Certificate Regarding Workers’ Compensation Bid Bond Designation of Subcontractors Information Required of Bidders Non-Collusion Affidavit form Contract Performance Bond Payment Bond General Conditions Special Conditions Technical Specifications Addenda Approved and fully executed change orders Any other documents contained in or incorporated into the Contract The Contactor shall complete the Work in strict accordance with all of the Contract Documents. All of the Contract Documents are intended to be complementary. Work required by one of the Contract Documents and not by others shall be done as if required by all. This Contract shall supersede any prior agreement of the parties. ARTICLE 6. PROVISIONS REQUIRED BY LAW. Each and every provision of law required to be included in these Contract Documents shall be deemed to be included in these Contract Documents. The Contractor shall comply with all requirements of the California Labor Code applicable to this Project. ARTICLE 7. INDEMNIFICATION. Contractor shall provide indemnification as set forth in the General Conditions. ARTICLE 8. PREVAILING WAGES. Contractor shall be required to pay the prevailing rate of wages in accordance with the Labor Code which such rates shall be made available at Azusa City Hall or may be obtained online at http//www.dir.ca.gov/dlsr and which must be posted at the job site. ARTICLE 9. DECLARATION OF POLITICAL CONTRIBUTIONS. Consultant shall, throughout the term of this Agreement, submit to City an annual statement in writing declaring any political contributions of money, in-kind services, or loan made to any member of the city council within the previous twelve-month period by the Consultant and all of Consultant's employees, including any employee(s) that Consultant intends to assign to perform the Services described in this Agreement. ARTICLE 10. CONFLICT OF INTEREST. In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict of interest provisions BONDS - 3 - in (State LCA – 24 CFR 85.36 and Non-Profit Organizations – 24 CFR 84.4), OMB Circular A-110, and 24 CFR 570.611, respectively, shall apply. No employee, officer or agent of the sub-recipient shall participate in selection, or in the award or administration of a contract supported by Federal funds if a conflict of interest, real or apparent, would be involved.
