The City Council of the City of Azusa met in regular session at the above time and place. Mayor Solem called the meeting to order. Invocation was given by Rev. E. Nelson of Foursquare Gospel Church. Present at Roll Call: Councilmen: Fry, Cruz, Solem ' Absent: Councilmen: Decker, Arkison Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried that Councilman Arkison be excused from this meeting. Also Present: City Attorney Carl Newton, City Adminis- trator Dangleis, Superintendent of Light & Power Gerharz, Public Works Maintenance Superintendent Milak, Chief of Police Elkins, Fire Chief Torrance, Planning Aide Frey, Director of Community Services Guarrera, Finance Officer Cooney, City C11 Clerk Solis M There was a correction to the Minutes of March 21, 19773 Q Page 3, Par. 14, should read permanent status, instead of step raise. Minutes stand approved as corrected. Plaques were presented to Mrs. Lynn Chase and Mr. Lyle Moritz, for their many years of service to the City of Azusa. Councilman Cruz presented plaque to Mrs. Chase and Councilman Fry presented plaque to Mr. Moritz. 'The hour of 7:30 p.m. being the time set for Public Hear- ing on the Negative Declaration of Environmental Impact on improvements at Memorial Park, Slauson Park and Northside Park, the Mayor declared the hearing open. City Clerk read proof of publication of notice of this hearing published in the Azusa Herald on March 24, 1977. City Administrator presented report from Mark Briggs & Associates which declared the negative declaration. There being no one in the audience wishing to speak on this matter it was Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried by roll call to approve the report as submitted by Mark Briggs & Associates. Mayor Solem requested next scheduled item on the agenda, Urban Futures., Inc. "Senior Citizens Project Feasibility Analysis" be held until later in the meeting, when Councilman Decker would be present. A communication from the President of Mt. View School PTA, was presented requesting a stop signal on Vernon 'Avenue at Mt. View School. There is a flashing light at this area, but it does not deter speeding cars as they come off the freeway. PTA would like Council to consider a more effective type of stop signal. Boy Scout Troop #418 requested approval of waiver of residency requirement, and also filing deadline for their fireworks stand at the northeast corner of Foothill Blvd. and Alosta Avenue. Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried to approve waiver of both requests. Mayor Solem requested next scheduled item on agenda, job classifications be held until later in the meeting, when Councilman Decker would be present. Councilman Cruz offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE (Variance Case No. V-489 Azusa Unified School District). Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried by roll call that further reading be waived. Resolution passed and M adopted by the following vote of Council: AYES: Councilmen: Fry, Cruz, Solem NOES: Councilmen: Decker ABSENT: Councilmen: Arkison City Attorney stated that the claim the City of Azusa has against the state, arising out of mandated costs for correcting a water situation at wells 4 and 6 in the amount of $590,532.08, has been denied by the ' state; it appears research and litigation may be required. He requested authorization from Council for his law firm, Burke, Williams & Sorensen, to pursue this research and litigation. Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried to approve request of City Attorney. City Attorney advised legislation has been adopted requiring cities to adopt a no smoking Ordinance, which requires no smoking areas in public assembly halls and buildings; this is part of the California Indoor Clean Air Act. He further advised that Council could waive the requirement of the section concerning its own members, provided that the rights of the non-^mokers are not adversely effected. After discussion, it was Moved by Councilman Decker, seconded by Councilman Fry and carried to designate the ®ate half of the City Auditorium for smokers and the 4 half for non- smokers, with appropriate signs to be placed; and further to exempt Council members from requirements as 'provided for in the act. Councilman Cruz Dissenting. City Attorney reported on SB508, which was introduced on March 9th of this year. The bill basically provides limitations relative to the removal of Police Chiefs from General Law and Charter Cities. He went on to explain the various requirements prior to removal from office of Police Chiefs. He noted that the League of California Cities opposes this bill which would curtail city's autonomy. Futures, Inc. re: senior citizens proj. Messers Rich Beame and Michael Brotemarkle addressed Council providing additional information and answering questions. Among questions asked were those dealing with limitations for use of proposed facilities to Azusa residents, onlj; their response was, it cL..-not be done. They were also asked if availability could be limited to senior citizens, their response was affirma- tive. Further questions relative to funding sources, availability of developers were answered by representa- tives. Mr. 0. J. Conforti, 321 S. Enid Avenue addressed Council providing information relative to difficulty in obtain- ing developers who are willing lo.work under conditions set forth by federally funded programs. Following discussion by Council, it was Moved by Councilman Decker, seconded by Councilman Fry and unanimously carried to approve continuance of plan with expenditure not to exceed $9,000., and with a periodic report back to Council from Urban Futures, Inc. Communications were submitted by Personnel Board and Director of Community Services concerning job classifica- tions as follows: 1) The substitution of a G.E.D. Certificate in lieu of a high school diploma in the Training and Experience section of job description for Public Works Maintenance Superintendent, with no change in salary range. 2) The reclassification of Supervisor of Recrea- tion position to Recreation Superintendent, with a salary increase of two and one-half ranges. During discussion Councilman Cruz remarked that positions should be filled from within, whenever possible, instead of in open examination. Moved by Councilman Decker, seconded by Councilman Fry and carried by roll call to approve requested change in Public Works Maintenance Superintendent, requiring that an open examination must be held to fill position. Councilman Cruz dissenting. Moved by Councilman Decker, seconded by Councilman Fry and carried to refer change of Supervisor of Recreation to Recreation Superintendent with attendent rate schedule change, to budget study; vacancy created by resignation of Supervisor of Recreation be filled by open examination. Councilman Cruz dissenting. Change in job descrip- tions 'City Attorney advised Council a law was passed which Res. #6513 provides that he, as City Attorney, cannot represent an re:prosecutorial individual in a criminal defense unrelated to city responsibilities matters unless the City of Azusa relieves him of any and all prosecutorial responsibilities on its behalf. The proposed Resolution would simply relieve him of these duties on behalf of the City of Azusa. City Administrator presented claim against the City by Claim vs Edward J. Peter, 723 Glen Lyn Drive, Azusa for alleged City loss of two palm trees after being trimmed by Light & Power Department. Planning Director requested Council approval of unpaid leave of absence for Mrs. Dorothy Brown, Senior Secretary in the Planning Department. Mrs. Brown is requesting 7 weeks of unpaid leave of absence from July 11 through August 26, 1977; her earned vacation time and leave will be used for her forthcoming marriage and honeymoon. Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried that request be granted. Consumer Service Manager submitted resignation of Mr. Jose Martinez for purpose of retirement on disability, effective April 4, 1977. Mr. Martinez has been employed by the City for 31 years. Moved by Councilman Fry, seconded by Councilman Cruz and unanimously carried to accept resignation, and prepare plaque for presentation. A request was submitted by Mrs. Irene Gilbertson, Assistant Director of Civil Defense to attend the Annual Election Meeting of the Southern California Emergency Services Association and Office of Emergency Services, Region I & VI, Quarterly Meeting to be held April 14-15, 1977, in Santa Barbara. City Administrator submitted claim against the City by Claim vs Bunyan Grenner, 315 Arden Avenue, Glendale, for alleged City damage to vehicle due to malfunctioning traffic signal at Arrow Hwy. and Cerritos Avenue. After investigation by Director of Public Works which disclosed City was not negligent in the maintenance of the traffic signals, it was his recommendation that the claim be denied. This signal to be at entrance to Santa Fe Recreational area, and costs will be borne by County of Los Angeles, City of Azusa and Irwindale. Azusa's proportionate share is $13,700., and funds can be taken from the 2106 Gas Tax Account. Moved by Councilman Decker, seconded by Councilman Fry and carried by roll call to approve the allocation of $13,700. for installation of proposed signal at inter- section of First Street and Irwindale Avenue. Councilman Cruz dissenting. Planning Director's report on non -conforming use businesses, which had been continued from a former meeting, was again brought before Council. Status of three businesses in report: Jack Palo, 1000 W. Foothill Blvd., Sam's Auto Dismantling, 760 W. Foothill Blvd., and Azusa Upholstery, 217 N. Azusa Avenue, was discussed by Council and City Attorney. City Attorney explained options re: amendment C7 to the Municipal Code. Notice was received from the Police Chief of appointment of Mrs. Helen Diaz as Probationary Police Clerk, effec- tive April 14, 1977. Moved by Councilman Cruz, seconded by Councilman Decker and unanimously carried to approve appointment. A request was received from Edward Cooney, Finance Officer and Joseph Guarrera, Director of Community Services for authorization to attend seminars at the Sacramento Convention Center on May 19 and 20, 1977. Accountable expenses of $150. are requested for each, and budgeted funds are available. Police Chief submitted notification of appointment of the following persons as Probationary Police Officers: Mr. Douglas Ernst, effective April 5, Mr. Frank Grasso, effective April 6, and Mr. Jeffrey Powell, effective April 7, 1977. Following extended discussion, during which Councilman Fry indicated that he would like to have applicant submit a resume, and views given concerning this matter by Mr. 0. J. Conforti, and Mr. Art Morales, it was Moved by Councilman Cruz, seconded by Mayor Solem to appoint Mrs. Ramirez to finance committee. Mr. Art Morales, 337 N. Soldano Ave., addressed Council asking if policy re: open meetings by governmental bodies, 'specifically the Personnel Board, had been changed. He indicated that door to meeting place was locked during a recent Personnel Board meeting. City Administrator answered that no changes have been made, Personnel Clerk merely forgot to unlock door for meeting. Mayor Solem asked that this situation be investigated and remedied. 1 1 City Clerk read in full a Resolution authorizing payment of warrants by the City. Councilman Cruz offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Moved by Councilman Cruz, seconded by Councilman Fry and unanimously carried by roll call that the Resolution be adopted.
