The City Council of the City of Azusa met in regular
session at the above time and place.
Mayor Solem called the meeting to order.
Invocation was given by Monsignor Robert J. Stein of
St. Frances of Rome Church.

Minutes of the meetings of April 18th and April 26th,
C7 1977, will be approved at the May 16th Council meeting.
N The hour of 7:30 p.m. being the time set for Public
Hearing on change of zone from "P" (Residential and Off -
Street Parking) to C-3 (General Commercial) on property
p at the southwest corner of Azusa Avenue and Foothill Blvd.,
the Mayor declared the hearing open.
City Clerk read proof of publication of notice of this
hearing published in the Azusa Herald on April 21, 1977,
and Notice of posting on April 22, 1977•
City Clerk read recommendation from the Planning Commis-
sion which stated change of zone will have no detrimental
environmental effects, and further requested change of
zone from "P" to C-3 be approved. There being no one in

Moved by Councilman Arkison, seconded by Councilman Decker
and unanimously carried to table to the next regular
scheduled Council meeting when owner is present to pro-
vide more information.
The rehabilitation of building at 638J N. Azusa Ave.,

structural engineer had submitted plms to the building

Director of Public Works. Mr. Miller then requested
another extension to July 5th Council meeting because
of his forthcoming vacation, and pending action by the
building department re: submitted plans.
Moved by Councilman Cruz, seconded by Councilman Fry
and unanimously carried to grant Mr. Miller an exten-
sion of time until July 5, 1977, for rehabilitation of
his building at 6381 N. Azusa Avenue.

VFW Azusa Post No. 8070 requested Council approval to Appvl.VFW
set up a road block on Foothill Blvd., on May 21, 19773 req. to sell
for purpose of selling poppies. John Moreno, Sr. Vice poppies
Commander, addressed Council stating that permission is

requested to also sell poppies on May 20th; and upon being
informed that roadblocks are not permitted, asked what
requirements are for selling on Foothill Blvd.
Chief of Police addressed Council advising Mr. Moreno of
requirements. Salesperson may stand in any area where
there is a left hand turn lane, or islands, as long as
traffic is not in any way impeded.

and unanimously carried to grant request of VFW, with
stipulation they work with the Police Department on

American Legion Auxiliary requested Council approval to Appvl.American

The Glendora Lions Club requested Council permission to Req.from

'City Attorney presented proposed Resolution implementing
the provisions of Section 1094.6 of the Code of Civil
Prccedures. This new section provides for a reduced
statute of limitations period of 90 days, from original
6 months, for the filing of actions seeking judicial
review of decisions of a city arising out of an adjudi-
catory administrative decision made after a hearing
suspending, demoting or terminating an officer or
employee, revoking or denying an application for a permit
or license, or denying an application for any retirement
benefit or allowance.

Councilman Decker asked what was the status of rehabilitation
and remodelling of the Civic Auditorium, as well as its Civic Aud.

Director of Public Works solicit additional architects
who may be interested in remodelling project.
'City Attorney submitted requested information to make
the Personnel Board an advisory agency, its function
would be limited to recommendations to City Council,
for Council action. He presented an amendment to the
Personnel Rules .... to Rule 3.01, I, by adding sub-
paragraph 5, to read as follows:
"not withstanding any other provision of these rules
except as otherwise provided by Ordinance the
function and power of the Personnel Board shall be
limited to making recommendations to the City
Council capacity shall be advisory to City
Council'.
Moved by Councilman Decker, seconded by Councilman Cruz
and unanimously carried to refer amended rule to Personnel
Board, for its action and recommendation �o be submitted
to Council at meeting to be held on May 16, 1977.
Upon appearance of Messers Van Beek and Van Olphen at
Council meeting, they requested Council reopen hearing
which had been tabled to the next regularly scheduled
Council Meeting. City Attorney advised that this was
not appropriated because of possibility that some person
'in the audience may have wanted to testify, but did not
do so because of no testimony by applicant. This would
leave a possibility of litigation in the future.
After discussion relative to this possibility, it was
determined by Mr. Van Beek that if any thing of this
nature should occur, he would accept all responsibility.

and unanimously carried to reconsider the prior action
taken, and re -open hearing.

Notice was received for the fuel cost adjustment for Fuel Cost

Moved by Councilman Decker, seconded by Councilman Fry
and unanimously carried to receive and file.
Request from Finance Officer that certain city property Surplus City
be declared surplus and go to informal bids for sale of property
same, was submitted for Council approval.

City Administrator presented claim against City under Claim vs City
the $1,000. allowed deductible, by Michael T. Camilleri,
5821 Viceroy Street, Azusa, for property damage by City
vehicle while replacing utility pole. After investigation
it was determined that City was at fault and claim should
be paid.

and unanimously carried by roll call to honor the claim
in the amount of $150.

Mr. Van Beek addressed Council re: intentions of building
a boat sales business on subject property. Mr. Van Beek
answered questions relative to physical construction of
proposed building and premises.
Mr. Arthur Morales addressed Council voicing his favorable
feelings re: Mr. Van Beek's proposed business.

Finance Office submitted for Council approval confir-
mation of appointment of Mr. Calvin L. Myers as
Equipment Mechanic, Range 119.5 Step 1, effective May 9,
1977.
Moved by Councilman Fry, seconded by Councilman Cruz
and unanimously carried to approve request.
City Administrator brought to Council's attention a
pending LCC sponsored bill which would raise the force
account limit from $5,000 to $10,000, for new construc-
tion. On repair or maintenance of any City owned
facility amounting to $4,000, or more, must go to bid.
This represents a reduction of $1,000 from the $5,000
now in force. He requested Council authorization to
prepare a letter requesting an amendment to present
wording of bill or opposition to, pending further infor-
mation from the League Legislative Analyist.

City Administrator called to Council's attention,
matter of construction of proposed sidewalks and
walls by developer of Canyon Cove tract. He noted the
need for direction to be given to developer in the matter
of plantings and responsibility for care, and also place-
ment of sidewalks and walls. He indicated that presently
there is an apparent discrepancy between what the developer
and City are responsible for. He asked that Council
take action to designate positioning of walls relative
to sidewalks and direct that developer provide adequate
planting to protect wall from defacing activities.
Moved by Councilman Fry, seconded by Councilman Decker
and unanimously carried to direct developer of Canyon
Cove tract to provide plantings needing little care and
to position them for easy City maintenance and to prevent
wall defacement.
Councilman Fry asked Police Chief for information as to
altercation at the Mecha Cinco de Mayo fiesta on Soldano
Ave.
After report by Police Chief regarding the occurrence,
Councilman Fry requested an additional report describing
judicial disposition of all persons found guilty.
City Clerk read in full a Resolution authorizing payment
of warrants by the City.
Councilman Decker offered the Resolution entitled:
