CIVIC AUDITORIUM AZUSA, CALIFORNIA MONDAY, NOVEMBER 5, 1979 7:30 p.m.
The City Council of the City of Azusa met in regular
session at the above time and place.
Mayor Solem called the meeting to order and led in Call to Order
the salute to the flag.
Invocation was given by Reverend E. Nelson of the Invocation
Foursquare Gospel Church.
For the benefit of the audience, City Administrator Voting Machine
briefly explained usage of voting machine to be used
by Council members in lieu of oral roll call voting.
Present at Roll Call: Councilmen: Decker, Fry, Cruz, Roll Call
Moses, Solem
Also Present: City Attorney Newton, City Administrator

There being no additions or corrections, the Minutes Appvl. Min.
of the October 15, 1979, regular meeting stand approved 10/15/79 mtg.
as written.
Councilman Fry presented Plaque and Resolution, which Plaque & Res.
City Administrator read in full, to Mrs. Rita O'Leary, to Rita O'Leary
for services to the City while an employee in the
Library Department.
Council adjourned to Community Redevelopment Agency at Adj.to CRA
7:50 p.m.
CRA reconvened as City Council at 8:10 p.m. Reconvened
Ms. Nell Soto scheduled to address Council regarding U.S. Census
the U. S. Census, was not in attendance at meeting.
The hour of 7:30 p.m. being the time set for the continued Cont.Pub.Hrg.
Public Hearing on progress of the Housing and Community re:progress of
Development Program and status of projects funded Hang.& Comm.
through the program, the Mayor declared the Hearing open. Dev. Funds
Councilman Moses requested that City Administrator
contact Advisory Board Members of the Housing and
Community Development Program to verify their interest
in program, or possibly replace them with new members.
Report on status of Housing and Community Development
Program disclosed balance of funds in the amount of
$620,199.
Moved by Councilman Decker, seconded by Councilman Moses
and unanimously carried to close Hearing. No action taken
by Council.
The hour of 7:30 p.m. being the time set for the Public
Hearing on application for Housing and Community Develop-
ment Funds for 1980-81, the Mayor declared the Hearing
open.
City Clerk read affidavit of proof of publication of
Notice of Hearing published in the Azusa Herald on
October 25, 1979.

Moved by Councilman Decker, seconded by Councilman Fry
and unanimously carried that Mayor appoint Advisory
Board Members and alternates to serve on the Housing
and Community Development Program.
Moved by Councilman Decker, seconded by Councilman Cruz
and unanimously carried to continue Public Hearing to
November 19, 1979 regular meeting in order that Advisory
Board could meet and submit recommendations.
The hour of 7:30 p.m. being the time set for the Public
Hearing on appeal of denial of Conditional Use Permit
for a condominium conversion of apartments on the
property located at 1130 E. Alosta Ave. (Case No. C-225
Richard A. Lewis), the Mayor declared the Hearing open.
City Clerk read affidavit of proof of publication of
Notice of Hearing published in the Azusa Herald on
October 18, 1979 and affidavit of proof of posting dated
October 26, 1979.
Moved by Councilman Decker, seconded by Councilman Moses
and unanimously carried to continue Public Hearing to
meeting of November 19, 1979, in order that principals
of Lewis Development Company who could not attend this
meeting be afforded the opportunity to do so.

and unanimously carried to deny and refer to insurance
carrier claims for alleged negligence in maintaining
traffic signals at intersection of Foothill Blvd., and
Cerritos Ave., causing traffic collision on February 28,
1979, submitted by the following:

Moved by Councilman Moses, seconded by Councilman Cruz
and unanimously carried that Stephen Cammack, Business
License Inspector be authorized to attend Eleventh
Annual Seminar, California Municipal Business Tax Associ-
ation at Queensway Hilton, Long Beach, from November 8th
to the 10th, 1979.
Moved by Councilman Cruz, seconded by Councilman Moses
and unanimously carried to receive and file ABC Notice
for on sale beer and wine, public premises, original
application from Louis Rivas, for premises located at
407 West Foothill Blvd. (Club Llamarada), noting that
letter of protest was submitted by Chief of Police.
Councilman Decker.requested that Chief of Police submit
memo to Mayor and Council stating reasons for letter of
protest on ABC application of Louis Rivas.

Moved by Councilman Cruz, seconded by Councilman Moses
and unanimously carried that Chief of Police and Director
of Public Works prepare a safety study at that location.
Moved by Councilman Decker, seconded by Councilman Cruz
and unanimously carried by roll call to approve agreement
between the City and Public Agency Data System (PADS) for
the purchase, installation and maintenance of a data pro-
cessing system for the City.
Moved by Councilman Decker, seconded by Councilman Cruz
and unanimously carried to receive and file Fuel Cost
Adjustment for the month of November, 1979.
Moved by Councilman Moses, seconded by Councilman Cruz
and unanimously carried to deny claim of Raymond Carl
Calnan 'for alleged unlawful impounding of his vehicle
on September 19, 1979.
Moved by Councilman Fry, seconded by Councilman Decker
and unanimously carried to deny request of Los Angeles
County Fire Commission in support of formulating plans
for regional fire departments, further that copy of
City Administrator's communication to Council, also be
forwarded to the Commission.

and unanimously carried by roll call to approve the
plans and specifications for the widening and improve-
ment of Foothill Blvd., between Dalton Avenue and Rock -
vale Avenue Project No. 5290 Federal Project No.
M -MC -6571(2j, and authorize the City Clerk to advertise
for bids.

and unanimously carried, to accept with reluctance
resignation for purposes of retirement of John Luna,
Street Sweeper Operator, Public Works Department,
further that a resolution and plaque be prepared for
presentation at a later date.

and unanimously carried by roll call to authorize
traffic signal at intersection of Calera and Alosta
Avenue.
Moved by Councilman Moses, seconded by Councilman Decker
and unanimously carried to approve Final Tract Map No.
36072 (Rainbow Angling Club) and direct the Director of
Public Works to hold the map from recordation until all
agreements and bonds have been received and all appli-
cable fees paid.
Moved by Councilman Fry, seconded by Councilman Cruz
that sliding scale fee schedule be approved for all
new construction for parks and recreation facilities,
further that City Attorney prepare necessary Ordinance
and also Ordinance amending present Municial Code
deleting sub -divisions and tracts, to read 'all new
construction". Motion passed by the following vote of
the Council:

City Attorney apprised Council that in view of the
motion that refers to a new tax on construction when a
subdivision is not involved, does involve a new kind of
taxation within the City, he would research the question
of whether this would be in violation of Proposition 13,
since it could be characterized as a special tax within
the meardng of the Constitutional limitation, and that he
woula have a report on that question as well as the
Ordinances requested.

Moved by Councilman Moses, seconded by Mayor Solem Sr. Citizens
and unanimously carried by roll call that Senior restrooms
Citizen multipurpose facilities be modified to include
only restrooms and that grant proposal to Area Agency
on Aging be withdrawn; that construction of restroom
facilities be added to expansion project for offices
at Memorial Park with City funds.

Moved by Councilman Moses, seconded by Councilman Cruz Res.to be pre -
and unanimously carried that resolution be prepared pared condemning
condemning the use of force by Iranian students in this Iranian students
Country and also in Iran against our Embassy, with
notification to our Congressmen and Senators.
Councilman Moses requested that Director of Public Works
prepare a report on possibility of creating handicapped
'parking spaces in front of the Police Department, Library,
Light and Power, west side of City Hall opposite the
Council Chambers and east side of City Hall opposite
fron walkway.
Councilman Cruz requested Planning Commission to
prepare a study with regard to possibility of annexing
property easterly of Azusa from the northeast corner and
exactly how far we could extend our boundaries, further
that the Foothill Dairy property might also be considered
in the,study.
City Attorney apprised Council that report on copper
lines and minerals in the water re: Townehouse, was
being reviewed and that he would have a report within
the next two weeks.

With regard to handicapped persons receiving same benefits Handicapped
as senior citizens, City Attorney advised that there is benefits
no provision in the law for equivalent benefits; each
receive separate and different benefits.
Councilman Moses requested that a study be prepared Study -Janitor -
regarding cost differential re: Janitorial Maintenance ial services
Firm vs increasing complement to include one janitor
for the janitorial maintenance of the City Hall complex.
Councilman Decker offered a resolution authorizing payment Res.#6848

Council was apprised by City Attorney that due to possible
litigation by Ms. Carter, that Council "listen only" and

cial.
