HomeMy WebLinkAboutF-1 Staff Report - Adoptioon of Ordinance Speed LimitsOrdinance Amending Azusa Municipal Code relating to Prima Facie Speed Limits Citywide April 7, 2025 Page 1 SECOND READING ITEM F-1 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: ROBERT DELGADILLO, P.E., DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE: APRIL 7, 2025 SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE NO. 2025-01 AMENDING SECTION 74-231 AND 74-232 OF THE AZUSA MUNICIPAL CODE RELATING TO PRIMA FACIE SPEED LIMITS CITYWIDE BACKGROUND: On March 17, 2025 the City Council introduced Ordinance No. 2025-01. The ordinance of the City Council of the City of Azusa amends Section 74-231 and 74-232 of the City of Azusa Municipal Code relating to prima facie speed limits citywide. The purpose of tonight’s action is adoption of the ordinance. Once adopted, it becomes effective in thirty (30) days and once signs are posted advising of the revised speed limits on the affected segments. RECOMMENDATION: It is recommended the Council read by title only, waiving further reading, and adopt the following Ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 74-231 AND 74-232 OF THE AZUSA MUNICIPAL CODE RELATING TO PRIMA FACIE SPEED LIMITS CITYWIDE ANALYSIS: On October 17, 2023, Engineering staff issued a task order to Willdan Engineering, an “On-Call” engineering consultant, to provide professional traffic engineering services to prepare an Ordinance Amending Azusa Municipal Code relating to Prima Facie Speed Limits Citywide April 7, 2025 Page 2 Engineering & Traffic Survey Report to re-certify speed limits on forty-eight 48 roadway segments throughout the City. These roadway segments were last surveyed in 2015. The California Vehicle Code (CVC) sections 40801 and 40802 require Engineering and Traffic Surveys that verify the prima facie speed limit before enforcement by such a device is legal. The law further specifies that these surveys be conducted every 7 years. Cities and Counties in California are required to follow the California Vehicle Code (CVC), primarily Sections 22357 and 22358, to establish speed limits within their jurisdiction. The law requires speed limits to be set by ordinance on the basis of an engineering and traffic survey. Following the CVC requirements allows local law enforcement to use radar equipment to enforce the speed limit. The speed limit survey in the 2024 Engineering and Traffic Survey Report are attached hereto as Exhibit “A”. As shown in Table-1, results of the Engineering and Traffic Survey indicate that six (6) of the existing speed limits will be reduced by 5 miles per hour (mph). The remaining forty-two (42) speed limits will remain the same. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The action merely reaffirms and makes a minor amendment to existing speed limits on certain street segments, and there is no possibility that approving the amendment will have a significant effect on the environment. Therefore, no environmental analysis is required. FISCAL IMPACT: There is no fiscal impact for the recommended actions. Upon City Council approval, the Public Works Streets Division will install the recommended signage as a part of normal operations.
