NOTICE TO THE PUBLIC FOR REGULAR MEETING. In compliance with Government Code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Archived video of recorded meetings is also available on the City website. Notice Regarding California Environmental Quality Act (CEQA) Determinations. Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items listed or not listed on this Agenda. Members of the audience will have the opportunity to address the City Council/Agency Board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the Council/Agency Board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments may be handled after the speaker has completed his/her comments. REQUEST TO AUTHORIZE PROCESSING A SPECIFIC PLAN AMENDMENT FOR THE MONROVIA NURSERY SPECIFIC PLAN TO ALLOW FOR RESIDENTIAL DEVELOPMENT OF 40 NEW TOWNHOMES STYLE UNITS AND MAINTENACE OF THE HISTORIC BUILDING ON SITE AT 817 E. MONROVIA PLACE. RECOMMENDED ACTION: 1) Direct staff to process proposed Specific Plan Amendment and related Design Review Project, 2) Direct applicant to make certain changes to proposed plan prior to application submittal for staff to process; OR 3) Direct staff not to process the subject application. Total Cost: N/A Is the Cost of this item budgeted? N/A Fund/Account No: N/A 2. AWARD A CONTRACT FOR THE AZUSA DOG PARK PROJECT. This action is categorically exempt from the requirements of the California Environmentally Quality Act (CEQA) pursuant to Section 15332 Class 32 (a)-(e) – In-Fill Development Projects. Staff has filed a Notice of Exemption with the Los Angeles County Clerk’s Office. RECOMMENDED ACTION: 1) Approve $839,379 from the Undesignated Excess Reserves to fund the Dog Park Construction and General Area Improvements project; and 10/7/2024 - 4 - 2) Award a contract to LMT Enterprises, Inc in the amount of $2,095,834.31, and authorize staff to increase the contract amount by 10% ($209,583.69) for potential change orders as needed. The total not- to-exceed contract shall be $2,305,418; and 3) Authorize the City Manager to execute contracts, in a form acceptable to the City Attorney, on behalf of the City. RECOMMENDED ACTION: 1) Receive, consider, and discuss the Parks & Recreation Commission recommendations for the name of the dog park; and 2) Determine the name of Azusa’s first dog park. DECLARATION OF SURPLUS PROPERTY PURSUANT TO AB 1486 – 725 NORTH AZUSA AVENUE IN THE CITY OF AZUSA, CALIFORNIA, COUNTY OF LOS ANGELES, (APN: 8608- 023-927). RECOMMENDED ACTION: Adopt Resolution No. 2024-C57, declaring that the property located at 725 North Azusa Avenue (APN: 8608-023-927) is surplus land and is not necessary for the City’s use and directing the City Manager to follow the procedures set forth in the Surplus Land Act, California Government Code Section 54220, et seq., as amended by AB 1486, for the sale of surplus land, and finding that such declaration is not a project subject to environmental review under the California Environmental Quality Act. RESOLUTION DECLARING PURSUANT TO GOVERNMENT CODE SECTION 54221 THAT REAL PROPERTY OWNED BY THE CITY LOCATED AT 622-624 NORTH SAN GABRIEL AVENUE (APN 8611-004-914) IS EXEMPT SURPLUS LAND, AND FINDING THAT SUCH DECLARATION IS NOT A PROJECT SUBJECT TO ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. RECOMMENDED ACTION: Adopt Resolution No. 2024-C58, declaring pursuant to Government Code section 54221 that real property owned by the City located at 622-624 North San Gabriel Avenue (APN 8611-004-914) is exempt surplus land, and finding that such declaration is not a project subject to environmental review under the California Environmental Quality Act. APPROVAL OF AMENDED AND RESTATED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE AZUSA CITY EMPLOYEES ASSOCIATION. RECOMMENDED ACTION: Approval of amended and restated memorandum of understanding between the City of Azusa and the Azusa City Employees Association.
