MINUTES
JOINT CITY COUNCIL AND REDEVELOPMENT AGENCY
ADJOURNED REGULAR MEETING
NOVEMBER 14, 1983 - 7:30 P.M.
The City Council of the City of Azusa met in adjourned
regular session in the Civic Auditorium at the above time
and date.
Mayor Moses called the meeting to order and led in the Call to Order
salute to the Flag.

'Moved by Councilman Latta, seconded by Councilman Cruz
that resolution be adopted. Resolution passed and adopted
by the following vote of the Council:

Proposed redevelopment plan for the Azusa West End Project
Redevelopment Project.
'The Mayor/Chairamn declared the Hearing open. The City Clerk/
Secretary read the affidavit of proof of publication of
Notice of said Hearing, published in the Azusa Herald on
October 19th and 26th and November 2nd and 9th, 1983.
Notices of this Hearing were duly mailed by certified
mail to the last known assessee of each parcel of land in
the project area.
The following documents were received:
The Assessment of Conditions Report.
Preliminary Plan for redevelopment.
Proposed redevelopment plan for the Azusa West
End Redevelopment Project.
Relocation Method.
Owner Participation Rules.
Environmental Impact Report.
Report to City Council on the proposed
redevelopment plan.
'The City Clerk/Secretary read written communication Comm. in favor
received in favor of the redevelopment plan from Louis of plan
Zimmerli of Screwmatic, Inc.
Persons giving testimony in favor of the redevelopment plan Oath to prsns
were given the Oath by the City Clerk/Secretary. They were: testifying in
favor of plan
Mrs. Gayle Avakian - she commented on the Environmental
Impact Report, citing concerns on toxic waste materials,
circulation and traffic, smog, recreational uses and
potential contamination of public water system. She
stated that she was neither for nor opposed to the project.
Mr. Richard Chamberlain, Vice President of Transit Mixed
Concrete Company - he stated that he was neither in favor
of or opposed to the project. He expressed concern
that the Environmental Impact Report and redevelopment.
plan did not specify ultimate use or specific Agency
projects. He does not consider his property blighted.
Mr. James McWilliam - he inquired as to what is meant
by redevelopment.
Mr. Mark Sheldon - he inquired about the specific plans
for the area.
'City Clerk/Secretary read written communications received Comms. against
against the redevelopment plan from the following: plan
Richard Chamberlain, Transit Mixed Concrete Company; Frank
R. McGoey of Southwestern Portland Cement Company and Thomas
Sheedy of Kirst Construction Company, Inc.
The Mayor/Chairman then asked those who were in opposition Oath to persons
to the plan to stand and they were sworn in by the City testifying
Clerk/Secretary. They were: against plan
Mr. Clarence Lyons - he inquired about underground
water impacts and the affects of redevelopment upon
residential property.
Mr. David Solinger, Attorney, representing White
Properties - informed the Agency that his client
wants to be an owner -participant in projects in
and around his client's property.
Mr. Joseph Zaboldano - commented on notification for
future development projects.
Mrs. Gayle Avakian - queried the Council/Agency on
appraisal practices and fair market value.
' Mr. Harry Heather - expressed concern about his building
being identified as blighted.
Mr. Tom Pearson, Mr. James McWilliam, Mrs. Rachel Rado,
Mr. Mark Sheldon, Mr. Sergio Duke, Mr. Albert Delgado,
Mr. John Mercado, Mr. Arthur Andrews, Mrs. Bernardine
Andrews, Mr. Joseph Beaulieu -- all spoke as individuals
on such issues and concerns related to eminent domain,
assessed valuation, specific plans for acquisition and
development and federal funds.

Mr. Donald Peckham - expressed his concern for the high
costs of environmental permits and moving costs.
Mr. Ron Secor - inquired about the length of time property
owners are subject to eminent domain and asked what could
stop the plan.
Mr. Keith Lindsay - asked for the location of blighted
' areas, street widening, methods for acquisition and how
can the Citv Council/Agency assist property owners and
concerns over eminent domain.
Mr. Joseph Zaboldano - inquired as to the extent of vacant
land.
After all testimony for and against the redevelopment plan Recessed
and the Environmental Impact Report were given, the Council/
Agency recessed at 9:25 P.M.
City Council/Agency reconvened at 10:05 P.M. Reconvened
At this time, Mr. Gary Werner, of Municipal Services, Inc., Responses to
the City's Redevelopment Consultant addressed the Council/ public by Gary
Agency responding to the publics' comments as follows: Werner
Owners requesting to be excluded from the plan have
an opportunity to be conforming owner participants
in which case eminent domain proceedings would not
be initiated.
Property value appraisals are conducted by a professional
and certified land appraiser who takes into account
comparable properties, income to the property and
replacement costs.
Should eminent domain proceedings be initiated, the
Agency pays for all costs except an appraisal prepared
by the owner. The owner's legal fees are subject to
repayment as determined by the Court.
Property owners may petition the Agency to acquire their
property and pursuant to the Montoya Bill, the Agency
must buy the property within three years. If refused,
the Agency may not initiate condemnation proceedings.
Redevelopment will not increases taxes. Property taxes
can only increase by virtue of a building improvement
or change in ownership, pursuant to Proposition 13.
The Redevelopment Plan can be stopped if the Council does
not approve the plan or by voter referendum.
The Redevelopment Plan does not identify specifically
blighted sites, rather, it identifies an area -wide
blight. Also, the plan is not a specific plan which
sets forth proposed Agency activities. It is intended
to provide the Agency, property owners and developers
with a tool to implement the General Plan.
' The Environmental Impact Report responded to environmental
issues which were anticipated to occur as a direct
result of the redevelopment plan; namely, the earlier
development of land uses proposed by the General Plan.
Because the Environmental Impact Report does not propose
any land use changes, secondary impacts, such as toxic
wastes, recreation, etc., were not addressed.
The City Council/Agency then allowed additional time for Additional
an exchange of questions and answers from members of the comments -public
audience and Mr. Werner. and CRA Conslt.

Moved by Councilman/Director Cruz, seconded by Councilman/
Director Latta, and unanimously carried by roll call to
close the Public Hearing. The Public Hearing was closed
at 11:15 P.M.
Director Cruz offered a resolution entitled:
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF
AZUSA CERTIFYING THE ENVIRONMENTAL IMPACT REPORT FOR THE
AZUSA WEST END REDEVELOPMENT PROJECT.
Moved by Director Cruz, seconded by Director Latta that
resolution be adopted. Resolution passed and adopted by
the following vote of the Agency:

ABSENT: DIRECTORS: NONE
Director Latta offered a resolution entitled:
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF
AZUSA APPROVING THE PROPOSED REDEVELOPMENT PLAN FOR THE
AZUSA WEST END REDEVELOPMENT PROJECT AND RECOMMENDING
ADOPTION OF SAID REDEVELOPMENT PLAN BY THE CITY COUNCIL.
Moved by Director Latta, seconded by Director Cruz that
resolution be adopted. Resolution 'passed and adopted by
the following vote of the Agency:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
CERTIFYING THE ENVIRONMENTAL IMPACT REPORT FOR THE AZUSA
WEST END REDEVELOPMENT PROJECT.
Moved by Councilman Cruz, seconded by Councilman Latta that
resolution be adopted. Resolution passed and adopted by
the following vote of the Council:

Councilman Latta offered for introductory first reading an
Ordinance entitled:
AN ORDINANCE OF THE CITY OF AZUSA APPROVING AND ADOPTING
THE REDEVELOPMENT PLAN FOR THE AZUSA WEST END REDEVELOPMENT
PROJECT.
Moved by Councilman Latta, seconded by Councilman Cruz and
unanimously carried by roll call to waive further reading.
Moved by Councilman/Director Cruz, seconded by Councilman/
Director Latta and unanimously carried to adjourn.
