In compliance with Government Code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Archived video of recorded meetings is also available on the City website. Notice Regarding California Environmental Quality Act (CEQA) Determinations. Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items listed or not listed on this Agenda. Members of the audience will have the opportunity to address the City Council/Agency Board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the Council/Agency Board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments may be handled after the speaker has completed his/her comments. PUBLIC HEARING - CONSIDERATION OF AMENDMENT NO. 2 TO EXTEND THE EXPIRATION DATE OF THE DEVELOPMENT AGREEMENT BETWEEN AZUSA PACIFIC UNIVERSITY (APU) AND THE CITY OF AZUSA (CITY) FOR DEVELOPMENT ON THE CAMPUS OF AZUSA PACIFIC UNIVERSITY RECOMMENDED ACTION: 1) Open the public hearing, receive testimony and close public hearing: and 2) Approve Amendment No. 2 between Azusa Pacific University and the City of Azusa to extend the term of the initial Development agreement by an additional five-year and allow for a new expiration date of September 19, 2030; and 3) Waive first reading, read by title only and introduce Ordinance No. 2025-03: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA APPROVING AND ADOPTING AN AMENDMENT TO THE DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF AZUSA AND AZUSA PACIFIC UNIVERSITY; and 4) Find that the request to extend the term of the Development Agreement is in compliance with the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15164, which allows for the preparation of an addendum to a previously certified Environmental Impact Report (EIR) when only minor changes or additions are necessary, and no substantial changes have occurred that would require preparation of a subsequent EIR. VERNON AVENUE RECOMMENDED ACTION: 1) Direct applicant to revise proposal to ensure consistency with surrounding residential density prior to submittal of formal application of proposed General Plan Amendment, Zone Change, and related Design Review Project; OR 2) Direct staff not to proceed with processing the application. ACCEPT BID AND AWARD CITYWIDE TREE MAINTENANCE CONTRACT FOR PARK, PARKWAYS, MEDIAN ISLANDS AND UTILITY RIGHT OF WAY TREES RECOMMENDED ACTION: 1) Accept Bid and Award a contract for Citywide Tree Maintenance Program to West Coast Arborists, Inc. for a three-year term, with two one-year extension options, in the amount of $820,945 per year; and 2) Authorize the City Manager to execute a contract for Tree Maintenance Services, in a form acceptable to the City Attorney, with West Coast Arborists, Inc. CITY TREASURER’S STATEMENT OF CASH AND INVESTMENT BALANCES FOR THE MONTH OF FEBRUARY 2025 RECOMMENDED ACTION: 1) Receive, review, and file the City Treasurer’s Report for the month of February 2025. APPROVE PURCHASE OF FURNITURE, FIXTURES, AND EQUIPMENT (FF&E) FOR TENANT IMPROVEMENTS RELATED TO CITY-OWNED FACILITY AT 890 THE PROMENADE (PROMENADE AT CITRUS PROJECT CIP NO. 62519A) RECOMMENDED ACTION: 1) Waive purchasing procedures as authorized under Azusa Municipal Code Section 2.539 and approve the purchase of the proposed FF&E in the amount not to exceed $116,560.93 (CIP Project #62519A); and 2) Authorize the City Manager to execute a purchase agreement with Steelcase Inc. for the purchase of the proposed FF&E. ADOPT A RESOLUTION IDENTIFYING A LIST OF PROJECTS THE CITY PROPOSES FOR FISCAL YEAR 2025-2026 FUNDED BY SB1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 RECOMMENDED ACTION: 1) Adopt Resolution No. 2025-C29 identifying the projects the City will fund with its apportionment of the 2025-2026 Road Maintenance and Rehabilitation Account; and 2) Authorize staff to carry forward existing RMRA funds from the Gladstone Street Rehabilitation Project to the 2023-24 Fiscal Year budget and CalSMART system. APPROVAL OF 2025 MEMORANDUM OF AGREEMENT WITH THE SAN GABRIEL VALLEY COUNCIL OF GOVERNMENTS FOR CONTINUED PARTICIPATION IN THE SAN GABRIEL VALLEY NEIGHBORHOOD COYOTE MANAGEMENT PROGRAM RECOMMENDED ACTION: 1) Approve the Memorandum of Agreement between the San Gabriel Valley Council of Governments and the City of Azusa for continued participation in the San Gabriel Valley Neighborhood Coyote Program. AWARD OF PROFESSIONAL SERVICES AGREEMENT (“PSA”) BETWEEN THE CITY OF AZUSA AND LDM ASSOCIATES FOR ADMINISTRATION OF THE CITY’S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM RECOMMENDED ACTION: 1) Approve the execution of a Professional Services Agreement (PSA) between the City of Azusa and LDM Associates Inc. to provide consulting services to administer and implement the City of Azusa’s CDBG Programs; and 2) Authorize the City Manager to execute the Professional Services Agreement (PSA), subject to non- substantive revisions approved by the City Attorney, and to fulfill any other City obligations under the agreement; and 3) Determine that the award of the PSA does not constitute a “project” under the California Environmental Quality Act (CEQA), as defined in Public Resources Code Section 21000 et seq.
