MENDEZ BOARD MEMBER Notice Regarding California Environmental Quality Act (CEQA) Determinations. Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. PUBLIC PARTICIPATION 1. Person/Group shall be allowed to speak without interruption up to five (5) minutes maximum time, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker’s questions or comments shall be handled after the speaker has completed his/her comments. CONSENT CALENDAR The Consent Calendar adopting the printed recommended action will be enacted with one vote. If Staff or Councilmembers wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. 1. Minutes of the Utility Board Meeting on April 24, 2023 Recommendation: 1) Approve Minutes as written. 2. Approve the Fourth Amendment to the Professional Agreement with Northstar Chemical to Provide Water Treatment Chemicals and Equipment Services Recommendation: 1) Approve the Fourth Amendment to the Professional Services Agreement with Northstar Chemical, as a DBA of Pacific Star Chemical, in an amount not to exceed $175,000, in accordance with Azusa Municipal Code Section 2-517(a) (24); and 2) Authorize the Mayor to execute the Fourth Amendment, in a form acceptable to the City Attorney, on behalf of the City. 3. Approve Temporary Leasing of Water Rights to the City of Monrovia and San Gabriel Valley Water Company Recommendation: 1) Approve water rights lease agreements with the City of Monrovia and San Gabriel Valley Water Company 4. Award the Maintenance Service Contract for Well and Booster Pump Maintenance Services to General Pump Company Recommendation: 1) Approve a Maintenance Service Contract for Well and Booster Pump Maintenance services with General Pump Company in accordance with Azusa Municipal Code Section 2-518(g); and 2) Authorize the Mayor to execute the Maintenance Service Contract in a form acceptable to the City Attorney. 5. Approval of Second Amendment to Renewable Power Purchase and Sale Agreement Between City of Azusa and Mesa Wind Power LLC Recommendation: 1) Approve the Second Amendment to Renewable Power Purchase and Sale Agreement between the City of Azusa and Mesa Wind Power Corporation 3 F. STAFF REPORTS/COMMUNICATIONS 1. Fiscal Year 2022-23 Third Quarter Budget Reports for Water and Electric Funds Recommendation: 1) Receive and file Fiscal Year 2022-23 3rd Quarter Budget Reports for Water and Electric funds. 2. Water Conservation Update – Revoking the 2-Day a Week Landscape Watering Schedule Recommendation: 1) Receive and file Staff’s report lifting the 2-day watering restrictions. 3. Detection of Perfluorooctanoic acid (PFOA) in the Groundwater Recommendation: 1) Receive and file Staff’s report - Detection of perfluorooctanoic acid (PFOA) in the groundwater. G.
