Archived video of recorded meetings is also available on the City website. Notice Regarding California Environmental Quality Act (CEQA) Determinations . Pursuant to CEQA, a "project" is defined as a "whole action" subject to a public agency's discretionary funding or approval that has the potential to either (1) cause a direct physical change in the environment or (2) cause a reasonably foreseeable indirect physical change in the environment. "Projects" include discretionary activity by a public agency, a private activity that receives any public funding, or activities that involve the public agency's issuance of a discretionary approval and is not statutorily or categorically exempt from CEQA. (Pub. Res. Code § 21065.) To the extent that matters listed in this Agenda are considered “projects” under CEQA, their appropriate CEQA determination will be listed below each recommendation. PUBLIC HEARING - FIRST READING OF AN ORDINANCE OF THE CITY OF AZUSA CITY COUNCIL AMENDING SECTIONS 88.24.005 (ALLOWED USES IN DISTRICTS), 88.28.030 (SPECIAL PURPOSE ZONE LAND USES AND PERMIT REQUIREMENTS), 88.30.070 (TRASH ENCLOSURE REQUIREMENTS), (DRIVEWAYS AND SITE ACCESS), AND SECTION 88.70.020 (DEFINITIONS OF SPECIALIZED TERMS AND PHRASES). ADDITIONALLY, AN AMENDMENT TO THE TOD SPECIFIC PLAN TO EXPAND THE STANDARD OPERATING HOURS IN THE DOWNTOWN AND DOWNTOWN EXPANSION DISTRICTS. LASTLY, TO DETERMINE THAT THE AMENDMENTS ARE STATUTORILY EXEMPT FROM CEQA UNDER PUBLIC RESOURCES CODE SECTION 21080.17. The proposed action is exempt from environmental review pursuant to the California Environmental Quality Act (Pub. Resources Code, §§ 21000 et seq.) (“CEQA”) and the State CEQA Guidelines (Cal. Specifically, the activity is not subject to CEQA because it will not result in a direct or reasonably foreseeable indirect physical change in the environment; the activity is not a project as defined in Section 15378, and the activity is covered by the general rule that CEQA applies only to projects, which have the potential for causing a significant effect on the environment. Total Cost: $6,000 Is the cost of this item budgeted? Yes Fund/Account No: 50-08-000-146-271 3. AWARD A CONTRACT FOR THE SENIOR CENTER MODERNIZATION PROJECT LOCATED AT 740 N. DALTON AVENUE This action is categorically exempt from the requirements of the California Environmentally Quality Act (CEQA) pursuant to Section 15301 Class 1 (a) – Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Staff have filed a Notice of Exemption with the Los Angeles County Clerk’s Office. RECOMMENDED ACTION: 1) Award a contract to G2K Construction, Inc. in the amount of $3,889,000, and authorize staff to increase the contract amount by up to 10% ($388,900) for potential change orders as needed, for a total not-to- exceed contract amount of $4,277,900; and 2) Approve $4,277,900 from the Capital and Infrastructure Replacement Reserve Fund to fund the Senior Center Modernization project; and 3) Authorize the City Manager to execute the contract, subject to non-substantive changes, in a form acceptable to the City Attorney, on behalf of the City. FOR UNMANNED AIR SYSTEMS STAFFING, HARDWARE, CONSULTING, AND DIGITAL FLIGHT PROGRAM SERVICES RECOMMENDED ACTION: 1) Waive purchasing procedures as authorized under Azusa Municipal Code Section 2-520 – Sole Source Purchases (which is outlined in attachment #2) and approve a service agreement with Flock Group, Inc., so that the Azusa Police Department can enhance public safety by adding needed capability to the DFR program for a total not-to-exceed $300,000; and 2) Authorize the City Manager to execute the Service Agreement, in a form acceptable to the City Attorney, on behalf of the city. AWARD OF CONTRACT TO PUBLIC RESTROOM COMPANY FOR VETERANS FREEDOM PARK RESTOOM REPLACEMENT This action is exempt from the requirements of the California Environmental Quality Act (CEQA) according to Section 15302, Class 2 (c) – Replacement or Reconstruction of Existing Utility Systems or Facilities, which involve negligible or no expansion of capacity. Staff will file a Notice of Exemption with the Los Angeles County Clerk’s Office. RECOMMENDED ACTION: 1) Waive purchasing procedures as authorized under Azusa Municipal Code Section 2-520 – Sole Source Purchases and approve the purchase and installation of a prefabricated restroom building from the Public Restroom Company in an amount of $491,928, plus a contingency for the remaining available project budget of $8,072 for potential change orders, for a total not-to-exceed $500,000; and 2) Authorize the City Manager to execute the Construction Agreement, in a form acceptable to the City Attorney, on behalf of the city.
