HomeMy WebLinkAboutE.4 - Staff Report - Release of Bonds Tract 83344CONSENT ITEM E-4 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: ROBERT DELGADILLO, P.E., DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE: JULY 21, 2025 SUBJECT: RELEASE OF SUBDIVISION IMPROVEMENTS PERFORMANCE BOND AND SURVEY MONUMENT PERFORMANCE BOND FOR TRACT 83344, ROSEDALE BACKGROUND: On June 19, 2023 the City Council approved the Final Tract Map 83344 for the final subdivision map of 24 lots designated as Tract Map 83344, located at 807 E Promenade. This subdivision now accommodates a detached single-family residential neighborhood located at Barberry Way and Azusa Veterans Way. The City Council also authorized staff to enter into an agreement with Rosedale Land Partners II, LLC, a Delaware Limited Liability Company for the completion of public improvements that included streets, sidewalks, curbs and gutters, public utilities, and storm drain facilities. As required by the Agreement, the Developer was to post adequate securities to ensure the construction and installation of the required improvements in the event the Developer or their surety fail to perform/construct the required improvements. RECOMMENDATIONS: Staff recommends the City Council take the following actions: 1)Accept the Public Works Improvements; and 2)Exonerate the Subdivision Improvements Performance Bond in the amount of $619,825 and Survey Monument Performance Bond in the amount of $23,000 for Tract 83344. ANALYSIS: Tract 83344 is located in the Rosedale Community bound by Azusa Veterans Way to the west, Rosedale Avenue to the east, The Promenade to the south, and the Great Park to the north. At the June 19, 2023 City Council meeting, the Council approved the Final map and the associated Public Improvements Agreement. Approved City Council July 21, 2025 Release of Subdivision Improvements Bond and Survey Monument Performance Bond, Tract 83344 July 21, 2025 Page 2 The Public Improvements for Tract 83344 of Rosedale have been constructed by the Developer to the satisfaction of City staff. In addition to the Public Improvements, the Developer has submitted all records confirming that the Land Surveyor has adequately set all monuments in conformance with the approved Final Tract Map 83344. Staff is recommending that the City Council accept all improvements constructed by the developer for Tract 83344 and exonerate all bonds associated with the Public Works improvements. FISCAL IMPACT: There is no fiscal impact associated with the proposed recommendations. All maintenance of the public improvements was included in the FY25/26 adopted budget.
