The City Council of the City of Azusa met in regular session after recessing from their Study Session, at the above date and time in the Civic Auditorium. Mayor Moses called the meeting to order and led in the salute Call to order to the Flag. The Invocation was given by Director of Community Services, Invocation Joe Guarrera. ROLL CALL Roll Call PRESENT: COUNCILMEMBERS: CRUZ, COOK, CAMARENA, LATTA, MOSES ABSENT : COUNCILMEMBERS: NONE ALSO PRESENT City Attorney Thorson, City Administrator/Chief of Police Wood, Finance Director Craig, Community Development Director Cunningham, Community Services Director Guarrera, Assistant to the City Administrator Fuentes, Consultant Werner, Deputy City Clerk Lara. CEREMONIAL 'Councilman Camarena presented a Certificate of Appreciation Cert. of Apprec. to Avery Label which was received by Mr. Terry Schuler, to Avery Label Director of Human Resources. Councilman Cruz presented a Proclamation, which the City Proc.-Hike-a-thon Administrator read in full, to Pat Sperl announcing the City's sponsorship of Saint Jude's Bike-a-thon to be held April 20, 1985. CONSENT CALENDAR Cons.Cal.appvd F-4 &8 - special The CONSENT CALENDAR consisting of Items 1 through 16 call was approved by motion of Councilman Cook, seconded by Councilman Camarena and unanimously carried by roll call vote, with the exception of Items F4 and F8 which were considered under the SPECIAL CALL portion of the Agenda. 1. The Minutes of Study Session and regular meeting of Min appvd March 18, 1985, were approved as written. 2. Appointment of Richard Komes to the position of Parks R.Komes appt. Maintenance Worker I, effective April 2, 1985, was approved. ' 3. RESOLUTION NO. 7679 Res. #7679 maint. agmt w/ A RESOLUTION OF THE CITY COUNCIL OF THE State -Hwy 39 CITY OF AZUSA APPROVING AGREEMENT FOR MAINTENANCE OF STATE HIGHWAY IN THE CITY OF AZUSA. 4. RESOLUTION NO. 7682 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA URGING FEDERAL AND STATE AUTHORITIES TO BAN THE USE OF CLOVE CIGARETTES. 13. City Treasurer's Financial Statement showing a balance of $8,347,556.64, as of February 28, 1985, was 'received and filed. 14. RESOLUTION NO. 7683 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. ORDINANCES/SPECIAL RESOLUTIONS ,Councilman Cook offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 15.04.010 OF THE AZUSA MUNICIPAL CODE RELATING TO THE ADOPTION BY REFERENCE OF THE "COUNTY OF LOS ANGELES BUILDING LAWS" CONSISTING OF FOUR PARTS ENTITLED "COUNTY OF LOS ANGELES BUILDING CODE," "PLUMBING CODE OF THE COUNTY OF LOS ANGELES," "MECHANICAL CODE OF THE COUNTY OF LOS ANGELES," AND THE "ELECTRICAL CODE OF THE COUNTY OF LOS ANGELES" Moved by Councilman Cook, seconded by Councilman Camarena and unanimously carried by roll call to waive further reading and introduce. Moved by Councilman Cook, seconded by Councilman Camarena and unanimously carried by roll call that City Clerk be directed to publish notice of public hearing with regard to the adoption of the Los Angeles County Building Laws. AT THIS TIME THE MAYOR INTRODUCED MR. JOHN HERNANDEZ, FIELD DIRECTOR FROM CONGRESSMAN MARTINEZ' OFFICE TO THE COUNCIL AND THE AUDIENCE, WHO WOULD BE WORKING IN THE CITY'S AREA AND ATTENDING COUNCIL MEETINGS FROM TIME TO TIME. SCHEDULED ITEMS CONTINUED PUBLIC HEARING - on appeal of action of Planning Commission granting a conditional use permit - C-347, Harry Goodlin/Canyon Inn, 2280 San Gabriel Canyon Road. The Mayor declared the hearing re -opened. Testimony was received. Moved by Mayor Moses, seconded by Councilman Camarena and unanimously carried by roll call to continue said public hearing to meeting of April 15, 1985, as survey of property was not completed as requested. PUBLIC HEARING - on proposed Development Agreement between the City of Azusa, Monrovia Nursery and Manresa Retreat. The Mayor declared the Hearing open. Deputy City Clerk read the affidavit of proof of publication of notice.of said hearing published in the Azusa Herald on March 20th and also the affidavit of proof of posting said property tn March 22nd, 1985. estimony was solicited but none received. PUBLIC HEARING - on appeal of action of the Planning Pub. Hrg. Commission granting a conditional use permit to allow Western Ash operation of an ash storage and delivery facility - SW C-349 corner of 10th Street and Todd Avenue - Western Ash. Case No. C-349. The Mayor declared the Hearing open. Deputy City Clerk read the affidavit of proof of publication of notice of said hearing published in the Azusa Herald on March 20, 1985. 04/01 48M11L PAGE FOUR Communication was received from Western Ash advising that they formally withdraw their proposal to locate operations in the City of Azusa. In view of the above the Hearing was terminated and it was moved by Councilman Camarena, seconded by Mayor Moses and unanimously carried by roll call that Council formally accept withdrawal of the Western Ash project, as stipulated in letter of March 7th, from Mr. Allen, Executive vice President, thus terminating proceedings on that project; further advising that if Western Ash decides to open said project up again, or to relocate in another part of Azusa, that they would have to go through a separate formal process. SPECIAL CALL ITEMS Moved by Councilman Latta, seconded by Councilman Cruz to Parkway tree refer parkway tree list to the Parks and Recreation list rfrd to Commission for further study, with the possibility of hiring Pks&Rec Comm.& a consultant to aid in the selection of proper parkway possbly hiring trees in the City. Motion failed by the following vote consultant of the Council: (failed) AYES: COUNCILMEMBERS: CRUZ, LATTA NOES: COUNCILMEMBERS: COOK, CAMARENA, MOSES ABSENT: COUNCILMEMBERS: NONE Moved by Councilman Camarena, seconded by Mayor Moses that parkway tree list with the addition of the Red Oak tree as an approved parkway tree be approved with the following exceptions: The crape myrtle tree now designated for 600 W. Brian, 1300-1400 N. Deborah, 700 W. Lori Ann and Holmar Ave. be referred to the Parks and Recreation Commission for a change of tree designation; further that on Hilltop/Nobill area there be a choice of either the magnolia or canary pine tree. Motion passed by the following vote of the Council: AYES: COUNCILMEMBERS: COOK, CAMARENA, MOSES NOES: COUNCILMEMBERS: CRUZ, LATTA ABSENT: COUNCILMEMBERS: NONE Moved by Councilman Camarena, seconded by Councilman Cook and unanimously carried by roll call to approve the speci- 'fications for the construction of environment for new computers with specifications reflecting options on the power conditioning equipment, i.e., bids to be received with and without that cost and Council accepting either/or bid,in the final analysis,after need has been determined. Further finding that this project is categorically exempt from the provisions of the California Environmental Quality Act.
