The City Council of the City of Azusa met in regular session at the above date and time. Mayor Moses called the meeting to order, and led in the Call to order salute to the Flag. INVOCATION was given by Reverend Stephen Gustin of the Berean Christian Center. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. #8191 ORDERING THE ANNEXATION OF TERRITORY IDENTIFIED AS appvng. So. "SOUTHERLY ANNEXATION DISTRICT 92" TO THE CITY OF AZUSA Annex. #92 PURSUANT TO THE CORTESE/KNOX LOCAL GOVERNMENT REORGANIZATION ACT OF 1985. The Local Agency Formation Commission has approved the City's application for annexation without notice and hearing and without an election. 6. The contract for Project No. 725, Landscaping and Irrigation of Gladstone Avenue medians, was awarded to Barrios Associates, low bidder, in the amount of $34,682.56, and its execution authorized. The City Clerk was directed to return unsuccessful bidder's guarantee. Two bids were received and opened in the ' City Clerk's office on March 9, 1987 from Sunrise Landscapers and Barrios Associates. 3,5- 7 Bid award Proj. 725 Barrios Asso. 7. The contract for Project No. 726, moving the McKee Bid award House at 575 E. Foothill Blvd., to City Park was Proj. 726 awarded to the sole bidder, Pride House Movers, in the Pride House amount of $25,000.00, and its execution authorized. Movers Bid opening was held on March 9, 1987, in the City Clerk's office. 8. Sully Miller of Long Beach completed Project Numbers 711 and 712, street improvement for First Street and Citrus Avenue, to the satisfaction of the City Engineer. The project was approved; the Mayor was authorized to execute the Notice of Completion and the City Clerk was directed to have same recorded. 9. Creative Homes of West Covina completed Project No. 669-3, floor and wall covering, and painting a portion of the West Wing of City Hall (Phase III), to the satisfaction of the City Engineer. Claim v. the City by Esther Munoz and her unborn baby, due to alleged injuries sustained on January 9, 1987, was denied and referred to City's Claims Administrator. 11. Hrg reopened 03/16/87 PAGE FOUR 349-3 Testimony was received from staff, advising that the Testimony Planning Commission at their regular meeting of January 21, 1987, had recommended that this zone change case be denied. Since that date, the applicant has revised his plans calling for 90 units rather than 94 and that it was recommended that the zone change be approved. Testimony was then received from the applicant. CONTINUED PUBLIC HEARING - General Plan Amendment No. 87-1, Cont.Pub Hrg on application of the following: GPA 87-1 Net Advantage, Inc./Anton L. Bargaehr regarding zone change case Z-258 to allow conformance with the zone change request to amend the General Plan from medium density residential to high density residential for property located at 840-880 S. Vincent Avenue. Michael B. Brashear, et al., regarding zone change case No. Z-259 to allow conformity with zone change request ' to amend the General Plan from community commercial to high density residential for properties located at 620, 621, 625 and 630 N. Cerritos Avenue. The Mayor declared the Hearing reopened. Hrg reopened Testimony was received from staff. Further, that in the body of the resolution approving the General Plan Amendment be disclosed that Councilwoman Avila was against the first portion of the amendment with regard to Zone Change Case Z-258. CONTINUED ITEM - Proposed resolution fixing and establishing Cont.Item the irrigation rate to be charged for untreared water by the Res. re: fees - City. Customers now receiving this untreated water have for untreated been paying the Azusa Agricultural Water Company, and in wtr order to streamline the operation and facilitate billing, it was recommended that these customers be transferred to the City Water Department. The City has 80% ownership in the Azusa Agricultural Water Company. Moved by Councilman Cook, seconded by Councilman Latta to waive further reading and adopt. Tucker, for premises located at 234 S. Virginia Avenue, Case No. 86-105. Subject property was granted a variance to permit a second dwelling (mobilehome) without additional garage space. Subsequent to obtaining the variance and placing the mobilehome on the property, the owner rented the mobilehome and a third trailer prior to completing construction, in direct violation of the variance conditions. The Mayor declared the informal hearing open. The City Clerk swore in the appellant, Mr. Tucker, prior to his addressing the Council regarding the nuisance. The City Clerk swore in the Code Enforcement Officer, prior to his statements regarding this case. The City Clerk swore in Mr. Dale Sanderlin, prior to his statements regarding this nuisance, which he was in favor of abating. PUBLIC NUISANCE APPEAL - of Robert K. and Carole M. Clark Pub Nuis Appl for premises located at 701-705 W. Ninth Street, Case No. 87-31 87-31. Subject property was declared a public nuisance on February 11, 1987. The primary problems in volved are: failure to comply with an approved and accepted precise plan of design and an accumulation of trash and debris on the property. It was consensus that these interviews be held separately from Council business. It was then moved by Mayor Moses, seconded by Councilman Cruz and unanimously carried by roll call that interviews of applicants for the vacancy in the Planning Commission be held on March 30, 1987 at 5:30 P.M. in the Light and Water Conference Room. Moved by Councilwoman Avila, seconded by Councilman Latta that resolution be adopted. Councilwoman Avila requested information on the Resolution accepting a grant of easement from Anton L. Bargaehr for providing electrical distribution facilities to the proposed apartment complex east of Mr. Bargaehr's property. She was apprised by the City Attorney that the easement was necessary and had no bearing to Mr. Bargaehr's zone change requests. Moved by Councilman Latta, seconded by Councilman Cruz to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: COOK, CRUZ, LATTA NOES: COUNCILMEMBERS: AVILA, MOSES ABSENT: COUNCILMEMBERS: NONE PUBLIC PARTICIPATION Mr. Udashkin of Very Special Chocolates addressed the Council regarding Senate Bill 624, which would provide that a food is adulterated if it is a confectionery and it bears or contains any alcohol in excess of 2% by weight. Under existing law, the percentage by weight is 5%. He stated that this proposed change would cause a hardship on his company as well as other providers of this confection. He requested that Council support the defeat of this Bill by either letter or resolution. As the matter he was discussing was not an Agenda item the Council took the following action. Moved by Mayor Moses, seconded by Councilman Cook and carried by roll call that the need to take action on this non -agenda item is required because the need to act arose after the posting of the agenda. Therefore, staff was directed to prepare a letter in support of the defeat of Senate Bill 624 to be forwarded to all members of the Committee, Governor Deukmejian, and our senate and assembly representatives if the Hearing on this Bill is expected to be held before the 30th of March; if not, then the support of the defeat of this Bill would be presented to the Council at their meeting of March 30th, in resolution form. OTHER BUSINESS/CITY COUNCIL 271 Oth.Bus/Cncl Councilman Cook advised that the Planning Commission had No action on taken action with regard to the placement of garage Cncl Cook's entrance and driveway in conjunction with Variance Case No. item V-930, 207 N. Orange Avenue, therefore, this item was not acted upon. Councilwoman Avila advised that she had seen the plans for No action on Variance Case No. V-930, and was not desirous of appealing Cncl Avila's the Planning Commission's approval of this item, therefore, item no action was taken on this item. Councilman Cook offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA TO Res. #8200 RECESS TO CLOSED SESSION ON MARCH 16, 1987, PURSUANT TO THE Closed Sess PROVISIONS OF GOVERNMENT CODE SECTION 54957 AND MAKING FINDINGS. Moved by Councilman Cook, seconded by Councilwoman Avila to waive further reading and adopt.
