The City Council of the City of Azusa met in regular session at the above date and time in the Civic Auditorium. Mayor Moses called the meeting to order, and led in the salute to the Flag. INVOCATION was given by Reverend Robert Flagg of the First Presbyterina Church. CEREMONIAL NONE The CONSENT CALENDAR consisting of Items 1 through 32 was approved by motion of Councilman Latta, seconded by Councilman Cruz, and unanimously carried by roll call vote, with the exception of Items F-1, F-14 and F-26, which were considered under the SPECIAL CALL portion of the Agenda; further, Councilman Cook registering a negative vote on Item F-19, Mayor Moses abstaining on Items F-18 and F-27, and Councilman Cruz abstaining on Item F-27. 1. SPECIAL CALL ITEM 2. Promotional appointment of Catherine Contreras, from Police Clerk I to Police Clerk II, effective April, 19, 1987, was approved. 3. Nicholas Macias was allowed to convert 80 hours of vacation time into pay, pursuant to IBEW Memorandum of Understanding. 4. The Water Department has a water well and structure situated north of 11th Street, west of San Gabriel Avenue. The well has been abandoned and the structure is deteriorating to a point of becoming a liability. Contract for the purchase of 10,000 feet #1/0 cable, Bid award 175 mil insulation, was awarded to King Wire and Cable for cable Corporation, low bidder, in the amount of $11,800.00, King Wire and its execution authorized. Price includes sales tax & Cable and freight to Azusa. Three bids were opened in the Corp. Office of the City Clerk on April 13, 1987, from: King Wire and Cable Corporation, Cablec Corporation and Maydwell and Hartzell. 7. The City Treasurer's Financial Statement showing a Treasurer's balance of $9,918,535.66 as of March 31, 1987, was Fin. Stment received and filed. 8. The Light Department requires two 300 KVA, three phase Frml bidding pad mounted transformers. Quotations were received waived for from four major manufacturers. Formal bidding purch of procedures were waived pursuant to the Municipal Code transfrmrs and authorization given to purchase these transformers from R.T.E., for $10,452.00, plus sales tax. This recommendation was based on the current quoted information, which includes load loss information that is used to determine the lowest overall lifetime operating cost. 9. Aka -Tani Landscape Company has completed the landscape Notice of and irrigation construction of right-of-way slopes and Comp.Proj median areas on Foothill Blvd., at the railroad 719 crossing, Project No. 719, to the satisfaction of the Superintendent of Public Works/Parks. The project was approved and the Mayor authorized to execute the Notice of Completion. The City Clerk was directed to have same recorded. 10. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. #8212 OPPOSING SENATE BILL 553, THE EMINENT DOMAIN BILL. opposing SB 553 04/20/87 PAGE TWO This Bill is designed to change the existing law governing procedures for condemnation of privately owned utility property by public agencies. Proposed change will create more litigation and potentially cost more for public agencies to exercise eminent domain proceedings. 16. The following appointments in the Light and Water Department were approved: promotional appointment of ' Joseph Cvetezar to Water Utility Crew Supervisor, effective April 21, 1987 and probationary appointment of James D. Taylor to the position of Water Operator Supervisor, effective April 29, 1987, contingent upon successful completion of a physical examination. 39-7 Appts. J. Cvetezar & J. D. Taylor 17. Specifications were completed for the maintenance of Specs appvd traffic signals at signalized intersections throughout Proj 732 City, Project No. 732. The specifications were approved, and the City Clerk directed to advertise for bids. 18. The City's Water Master Plan, completed in 1985, calls for a new water reservoir of approximately 3.0 million gallons capacity to be constructed in 1987-88 time frame to supplement water pressure zone #1. The speci- fications were completed for construction of a 2.7 million gallon capacity reservoir at 255 E. Sierra Madre Avenue. These specifications were approved and the City Clerk was directed to advertise for bids. (Mayor Moses abstaining.) 19. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA OBJECTING TO THE PROPOSED EXPANSION AND COMMERCIALIZATION OF BONELLI PARK AND URGING THE LOS ANGELES COUNTY BOARD OF SUPERVISORS TO RETAIN THIS PRECIOUS ISLAND OF OPEN SPACE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. #8214 REQUESTING AN ALLOCATION OF COUNTY AID TO CITIES FUNDS aid to Cities FOR THE PURPOSE OF MAKING REVISIONS TO THE SIGNAL funds for SYSTEM ON FOOTHILL BOULEVARD, BETWEEN TODD AVENUE AND signal systm ALOSTA AVENUE. In order to accomplish the signal timing on Foothill Blvd., it is necessary to install additional equipment in eight signal controllers, at an estimated cost of $16,000.00. This resolution is requesting funds for this purpose. 21. Final Tract Map No. 43013 was approved and its Appvl Final recordation authorized. It is a 14 unit condominium Tract Map project located on the north side of Gladstone Street 43013 west of Azusa Avenue and adjacent to the Little Dalton Wash channel. 22. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. #8215 AMENDING A POLICY REGARDING THE DESTRUCTION OF OBSOLETE destruction RECORDS FOR THE AZUSA POLICE DEPARTMENT. of Police records This Resolution amends Resolution No. 7788, adopted in 1985, and is needed due to changes in several procedural policies and omissions and additions of certain items. 23. City for alleged injuries sustained, false Claims v. Cty arrest and violation of civil rights, occurring Kennedy & December 10, 1986, by John James Kennedy, III, and John Duffy William Duffy, were denied and referred to City's Claims Administrator. Three separate resolutions authorizing payment of warrants by the City were adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Item GPA 87-1 Two separate resolutions presented I approving the General Plan designation for property located at 840-880 S. Vincent Avenue to high density residential and for property located at 620, 621, 625 and 630 North Cerritos Avenue to high density residential. The other resolution only approved the General Plan designation change for the property located on Cerritos Avenue. A discussion ensued due to the fact that the Council had denied the proposed Zone Change for the Vincent property at 'their last Council meeting, and questioned the approval of the resolution concerning both properties. Mr. Kamal Rizkalla, representing Net Advantage, addressed the Council and requested that they reconsider his zone change request for the Vincent property. Community Development Director advised the Council that if they were amenable to reconsidering the zone change request of Net Advantage, that proposed resolution approving both properties concerned with the General Plan would be appropriate, as the inconsistency with the zone classification as pertained to the General Plan Amendment could be corrected at a later date. Councilman Cook then offered the resolution dealing with both properties involved in the General Plan Amendment, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CHANGING THE GENERAL PLAN DESIGNATION FOR PROPERTY LOCATED AT 840-880 SOUTH VINCENT AVENUE FROM MEDIUM -DENSITY RESIDENTIAL TO HIGH-DENSITY RESIDENTIAL AND CHANGING THE GENERAL PLAN DESIGNATION FOR PROPERTY GENERALLY LOCATED AT 620, 621, 625 AND 630 NORTH CERRITOS AVENUE FROM COMMUNITY 'COMMERCIAL TO HIGH-DENSITY RESIDENTIAL (GENERAL PLAN AMENDMENT NO. 87-1). The Police Department advised that violators will be warned until it is common knowledge that restrictions are known. Also, a requirement of enforcement will be that sidewalk areas are clearly posted with these restrictions and Muncipal Code Section clearly visible. SPECIAL CALL ITEMS Moved by Councilman Latta, seconded by Councilman Cook and carried by roll call to continue proposed resolution granting a variance to Sabino Gibon for property located at 300 Durant Street to the meeting of May 4, 1987, in order to receive direction from the City Attorney on the proper action to be taken in the event resolution is not to be adopted. Mayor Moses and Councilwoman Avila dissenting. Plans and specifications were prepared for the application of slurry seal to approximately 14.5 miles of streets in the City. Slurry seal is a preventative maintenance program which is applied to streets which are not too badly cracked or otherwise deteriorated, but which show signs of major oxidation and minor cracking. This treatment extends the life of the asphaltic pavement, Project No. 731. After discussion, it was moved by Councilman Cruz, seconded by Councilman Cook and unanimously carried by roll call to approve the specifications with the exception of 8th Street, east of Pasadena Avenue. The City Clerk was directed to advertise for bids. Richard Widman addressed the Council on behalf of Mr. Ray Requests for Zavala, Chairman of the St. Frances of Rome Church Fiesta, game booths, requesting the following: stage & fees waived Use of City's game booths and portable for carnival stage for June 19th, 20th, and 21st, 1987. @ St.Frances of Rome Request that City crews deliver and set Fiesta-appvd up the portable stage on June 18, 1987. Waive all fees in connection with the carnival to be held on above listed dates.
