The City Council of the City of Azusa met in regular session at the above date and time in the Civic Auditorium. Mayor Moses called the meeting to order and led in the Call to order salute to the Flag. INVOCATION was given by Reverend Gordon Coulter of the Free Invocation Methodist Church. Mr. Perez, President of Sister City Committee thanked the Council for inviting the Choir group from Zacatecas to the City of Azusa and the Council meeting. He introduced Mr. Sosa, Director of the Choir group from Zacatecas who in turn introduced the students in the group. The entire Council presented the group with Centennial Pins. ' The CONSENT CALENDAR consisting of Items 1 through 22 was approved by motion of Councilman Cook, seconded by Councilman Latta, and unanimously carried by roll call vote, with the exception of item F-11, which was considered under the SPECIAL CALL portion of the Agenda. The Light Department requires three transformers in two different sizes for a new construction project at Peach Tree Manor. Quotations are on file from four major manufacturers from other orders that were quoted on in January, 1987. Approval was given to waive formal bidding procedures pursuant to the Municipal Code and to authorize the purchase of two 100 KVA single phase transformers and on 167 KVA single phase transformer from Wesco, Inc., for a cost of $7,445.42 which includes sales tax. 6. Bid opening for Project No. 726-87 (Phase II), roof structure for the Durrell House. One bid, only, was received and opened in the Office of the City Clerk from Pruitt Construction. Approval was given to award the contract to sole bidder, Pruitt Construction, in the amount of $15,400.00 and to authorize its execution. 7. Amendment No. 2 to the Power Sales Agreement between the City and the Department of Water Resources of the State of California was approved and its execution was authorized. This amendment agrees to reduce Azusa's obligation to purchase from DWR during 1988 by 2 megawatts. In return, Azusa will compensate them for this loss of megawatts by purchasing energy in like amount or pay the difference. This agreement reduces our power cost $44,000.00 monthly. Informal quotes Transformers Roof/Durrell House PYuitt Construction Power Sales Agmt. Amend. 8. Amendment No. 1 to the California -Oregon Transmission Calif.-Oreg. Project Agreement was approved and its execution was Transmission authorized. This amendment clarifies certain sections Amend. #1 of the original agreement. 9. The Rules of the Civil Service System and the various Vacation resolutions and Memoranda of Understanding between the Carry-over City and its bargaining units, state that an employee Employees shall not accrue vacation beyond a 24 month accumulation, unless Council so authorizes. Approval was given that on a one-time basis all employees be granted a blanket carry-over of vacation into 1989, stipulating that each person shall be at or below his or her vacation limit on 6/30/89, or shall not accrue further vacation credit until it drops below its respective vacation balance limit. 10. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. #8352 AMENDING RESOLUTION 8051 REGARDING THE APPOINTMENT OF ICRMA SPECIFIC REPRESENTATIVES TO THE INDEPENDENT CITIES RISK Reps. MANAGEMENT AUTHORITY. This resolution appoints the Personnel Assistant as an alternate member of said board. 11. SPECIAL CALL ITEM. 12/21/87 PAGE TWO Spec Call 12. Informal proposals were solicited from professional Foothill/ engineering firms for construction surveying for Alosta Project No. 695, Foothill/Alosta medians. Four medians proposals were received from: Gilbert Engineering Co., Gilbert Olson & DeTilla Associates, Carl W. Donmoyer & Engineering Associates, Inc., and Municipal Engineering Company Consultants, Inc. Approval was given to award the Proj. 695 construction surveying proposal to Gilbert Engineering Co., on a "time and material" basis, not to exceed $6,000.00. 13. The City Treasurer's Financial Statement, showing a Cty Treas. balance of $9,083,718.51, as of November 30, 1987, was Fin.Stment received and filed. 14. On July 7, 1986, Council adopted Ordinance No. 2318 Excavation increasing the excavation tax. Due to the passage of Tax, Measure Proposition 62, this increase must be ratified by the 4/12/88 electorate or it will expire on November 15, 1988. Muni.Elect. Approval was given to place the measure on the ballot at the General Municipal Election to be held on April 12, 1988. 15. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. #8353 CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF Calling & A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, Giving APRIL 12, 1988, FOR THE ELECTION OF CERTAIN OFFICERS AS Notice REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF 4/12/88 CALIFORNIA RELATING TO GENERAL LAW CITIES AND FOR THE Muni.Elect. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. #8354 CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE Requesting LOS ANGELES COUNTY TO RENDER SPECIFIED SERVICES TO THE Co. Svs. CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 12, 1988. 17. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. #8355 CALIFORNIA, PROVIDING FOR THE FILING OF REBUTTAL Filing of ARGUMENTS FOR CITY MEASURES SUBMITTED AT THE GENERAL Rebuttal MUNICIPAL ELECTION OF APRIL 12, 1988. Arguments 18. The City Attorney was directed to prepare the Impartial Cty Attny Analyses relating to measures submitted to the voters to prepare at the April 12, 1988 election. Imp.Anal. 19. In order to complete the picnic facilities project at Picnic Pioneer Park in the same vandal resistant concrete, facilities formal bidding procedures were waived pursuant to the Pioneer Pk Municipal Code and authorization was given for the purchase of one picnic table, 7 waste containers, 5 barbecues and 1 preparation table from Moore Recreation and Park Equipment, at a cost of $7,381.52, including sales tax. 20. Pursuant to the Municipal Code, approval was given to "Quitting Sav-On Furniture to hold a "Quitting Business" sale, Business" limiting the time period to 30 days, with a 30 day Sav-On ' extension upon receipt of a letter requesting same, if Furniture additional time is required. 21. The City has offered low interest loans to low income Low int. households under the CDBG program since 1985. The Loans CDBG funding is essentially depleted although a few cases Program are in progress. To complete three final projects, allocation of $10,458.00 was approved. 12/21/87 PAGE THREE 22. Mr. Henry Barbosa, Attorney for Falcon Cable Media, to Falcon addressed Council stating that there would be no changes in personnel due to the transfer of the cable television. Councilman Cook offered a resolution as amended, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE TRANSFER OF A FRANCHISE FOR A CABLE TELEVISION SYSTEM FROM CABLE TV FUND 10-C, TO FALCON CABLE MEDIA, L.P. Moved by Councilman Cook, seconded by Councilman Latta to waive further reading and adopt. Moved by Councilman Cruz, seconded by Councilman Latta and carried by roll call* that in light of the approved ,Conditional Use Permit having taken care of the applicant's land use problem that the Zone Change Case No. Z-260, General Plan Amendment No. 87-2 and Precise Plan P-2490 be denied. Mayor Moses abstained. Testimony R. Medina for app. Hrg closed Z-260, GPA -87-2 P-2490 Denied PUBLIC HEARING - on extension prohibiting the issuance of Pub.Hrg. land use entitlements for all multi -family residential, with Moratorium certain exceptions, for parcels within the City generally Multi -family bounded by First Street on the south, Foothill Blvd. on the residential north, San Gabriel Ave. on the west and Pasadena Ave. on the east. The Mayor declared the Hearing open. Hrg. open The City Clerk read affidavit of proof of publication published in the San Gabriel Valley Tribune on December 11, 1987. Testimony was solicited from the public. Mr. Harry Stemrich addressed Council inquiring what was Testimony meant by "with certain exceptions". H. Stemrich Staff responded by explaining that duplexes are considered Testimony the certain exceptions. The current moratorium still allows Staff 'duplexes and more than one single family on a lot, but not three units or more. Moved by Councilman Cook, seconded by Councilman Latta and Hrg. closd. unanimously carried by roll call* to close the Hearing. Councilman Latta offered an Urgency Ordinance entitled: AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF Ord. #2361 AZUSA EXTENDING A MORATORIUM PROHIBITING THE ISSUANCE OF Extending LAND USE ENTITLEMENTS FOR ALL MULTI -FAMILY RESIDENTIAL, WITH Moratorium CERTAIN EXCEPTIONS, FOR PARCELS WITHIN THE CITY OF AZUSA 1 year GENERALLY BOUNDED BY FIRST STREET ON THE SOUTH, FOOTHILL BOULEVARD ON THE NORTH, SAN GABRIEL AVENUE ON THE WEST, AND PASADENA AVENUE ON THE EAST. Moved by Councilman Latta, seconded by Mayor Moses to waive further reading and adopt. Urgency Ordinance was passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: CRUZ, LATTA, MOSES NOES: COUNCILMEMBERS: COOK ABSENT: COUNCILMEMBERS: AVILA SPECIAL CALL ITEMS Special Call Mr. Gary Solem removed this item from the consent calendar G. Solem to express his concern regarding the naming of the Addressed north/south connector road adjacent to the Foothill Center Cncl. "Old Mill Road". He stated that the street should be an st. title extension of Cerritos, further that it would complicate things if it is named Old Mill Road. Mr. Bob Talley also addressed Council regarding this item B. Talley stating that naming the street Old Mill Road would cause Addressed confusion to the public as well as Fire and Safety Cncl. Departments, and that the street should be named Cerritos. st.title 12/21/87 PAGE FIVE Moved by Councilman Cook, seconded by Councilman Cruz and Street title carried by roll call* that the naming of the north/south Cerritos connector road adjacent to the Foothill Center be Cerritos instead of and that the extension of Eighth Street retain the Eighth Old Mill Rd. Street Title, further, that the Public Works Department post said street names upon completion of both roads, and that staff be directed to notify the appropriate Fire and Safety Departments of these changes. Mayor Moses dissenting. PUBLIC PARTICIPATION Pub.Prtc. NONE OTHER BUSINESS/CITY COUNCIL Mayor Moses requested information regarding the possibility Bus shelter of installing a bus stop shelter at Azusa and Gladstone. @ Azusa & Staff addressed Council stating that the area is located in Gladstone State right-of-way, which means Cal Trans has review responsibility for it. In order for a bus shelter to be approved at this location it would have to be of a break away design. Currently, ours does not meet Cal Trans requirements. In order for the City to put one at this location they would have to redesign it or construct one of wood. Moved by Councilman Cruz, seconded by Mayor Moses and unanimously carried by roll call* to construct a bus shelter at Azusa Avenue and Gladstone Street. Councilman Latta offered a resolution entitled: Res. #8359 Closed Sess A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA TO 'RECESS TO CLOSED SESSION ON DECEMBER 21, 1987, PURSUANT TO THE PROVISIONS OF GOVERNMENT CODE SECTION 54957, AND MAKING FINDINGS PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (c). Moved by Councilman Latta, seconded by Councilman Cruz to adopt the Resolution.
