The City Council of the City of Azusa met in adjourned regular session at the above date and time in the Azusa Senior Center. Mayor Moses called the meeting to order and led in the salute to the Flag. ROLL CALL PRESENT: COUNCIL14EMBERS: AVILA, STEMRICH, NARANJO, LATTA, MOSES ABSENT COUNCILMEMBERS: NONE ALSO PRESENT City Attorney Thorson, City Administrator Fuentes, Director of Finance Craig, Community Development Director Bruckner, Business License Officer Allen, City Clerk Solis, Administrative Clerk Toscano. 'At the meeting of August 1, 1988, the City Attorney voiced his concerns regarding the potential conflict of interest of the Council voting on the proposed Ordinance regarding Admissions Taxes and the fact that the Council was given theater passes by the Edwards Theater Circuit. The members of the Council have advised the City Attorney of the fact that Mayor Moses had returned his pass within thirty days of the day he received it. The other members of the Council have returned their passes since Monday, August 1, 1988. He further stated that he spoke to the Fair Political Practices Commission and was advised that if the pass recepients used their passes for less than $250.00, then, assuming the facts are correct, all Council members would be able to vote on this issue. The City Attorney prepared two proposed Ordinances, one including a tax on admission to motion picture performances and one excluding a tax on admission to motion picture performances. Councilman Latta offered an Ordinance entitled: ,AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTIONS 3.40.010 AND 3.40.030 OF THE AZUSA MUNICIPAL CODE ESTABLISHING ADMISSIONS TAXES FOR CERTAIN EVENTS AND PROVIDING FOR AN ELECTION THEREON. (This ordinance includes motion picture performances) Moved by Councilman Latta, seconded by Councilman Naranjo to waive further reading and adopt. Call to order Roll Call Also present City Atty Advice Ord. estab. Admission taxes Mr. James Edwards addressed the Council requesting that J. Edwards the Council exclude motion picture performances in the Comments Ordinance the Council is preparing to adopt. He stated that he would like to offer alternative tax revenues for the City, but not through admissions taxes. Mr. James Edwards III, addressed the Council also requesting J. Edwards that the Council not pass the Ordinance including motion III picture performances. Comments The City Attorney advised Council that in Section 3 of the City Atty proposed Ordinance that imposes the tax on the movie Comments theater, the Council does retain the power to exempt certain events from taxation and if that is adopted the Council would retain the authority to delete movie theaters at a later date. The City Administrator stated that there was room for negotiation and compromis on this issue with Messrs. Edwards. 1 1 After a lengthy discussion regarding this issue, it was Table motion moved by Councilman Latta, seconded by Councilman Naranjo 8/10/88 and unanimously carried by roll call to table motion to adopt proposed ordinance to Wednesday, August 10, 1988, so that the Council and Mr. James Edwards could meet and negotiate. Moved by Councilman Latta, seconded by Councilman Naranjo Adjourn to and unanimously carried by roll call to adjourn to 8/10/88 Wednesday, August 10, 1988, 7:00 P.M. at the Civic 7:00 P.M.
