The City Council of the City of Azusa met in regular session at the above date and time in the Civic Auditorium. Mayor Moses called the meeting to order and led in the Call to Order salute to the Flag. INVOCATION was given by Director of Finance Craig in the Invocation absence of Pastor Lewis of the Emmanuel Southern Baptist Church. Ceremonial The whole Council presented a plaque to Angelo Plaque to A. Evangelista, retiring City employee, commending him for his Evangelista years of service with the City. The CONSENT CALENDAR consisting of Items 1 through 11 was Cons Cal approved by motion of Councilman Latta, seconded by appvd Councilwoman Avila and unanimously carried by roll call vote. 1. The Minutes of the regular meeting of November 7, 1988, Min appvd were approved as written. ' 2. Parcel Map No. 19123 which is a development for Parcel Map apartment purposes, located on the east side of Vincent 19123 appvd Avenue, north of Arrow Highway, was approved and its recordation authorized. The proposal was reviewed by staff and found to be in conformance with the requirements of the Subdivision Map Act. 3. The promotional appointment of Nick Dechant to the Promo appt position of Street Maintenance Worker III/Equipment N. Dechant Operator, effective October 29, 1988, was approved. Plans and specifications for Project No. 739-87, Plans & Specs regrading and turf rehabilitation of the ball field at Proj 739-87 Northside Park, were approved and the City Clerk directed to advertise for Bids. This project is funded as a part of the Park Development Program. At previous Council meetings, approval was given for Edison - Power Sales Agreements with the City of Pasadena and Azusa Firm the California Department of Water Resources. In order Trans. Agmts to transmit the power purchased from these two utilities it was necessary to rely on Edison for transmission. The 1989 Edison -Azusa Firm Transmission Service Agreements providing the terms and conditions were approved and their execution authorized. Liquid Flow Engineering has completed the installation Notice of of an automated sprinkler system at Slauson Park, Comp. Proj Project No. 744A, to the satisfaction of staff. The 744A project was approved and the Mayor authorized to execute the Notice of Completion. The City Clerk was directed to have same recorded. Fiscal year 1988-89 is the first year of the City's operation of Project Headstart. It was now appropriate to adopt a salary and benefits resolution covering individuals employed under this program. Also, to amend the existing resolution that applies to the non- classified employees, elected and appointed officials, so as to transfer the classification of Headstart Director to the Headstart Resolution. Resolution passed and adopted by the following vote, to wit: AYES: COUNCILMEMBERS: AVILA, STEMRICH, NARANJO, LATTA, MOSES NOES: COUNCII14EMBERS: NONE ABSENT: COUNCIL4EMBERS: NONE SCHEDULED ITEMS PUBLIC HEARING - on the possible revocation of a special use permit granted by City Council Resolution No. 3546, dated November 27, 1956, Azusa Rock Company, Inc., aka Kirst Construction Company, Inc., which was granted to allow removal of rock, sand and gravel, and to operate a rock plant, rock crusher, plant, ready -mix concrete plant and asphalt plant, on the property located at 3901 Encanto Parkway. The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of publication of notice of said hearing published in the Azusa Herald on November 9th, as well as affidavit of proof of posting said property on November 10th, 1988. City Attorney apprised the audience that approximately four weeks ago the Council reque - ted staff to investigate the possibility of miticiation mea.: _.es to alleviate some of the problems that had ' yen addres-ed at the quarry site. Tile Council also reque�itad that the Public Hearing be re -noticed to give everyone the opportunity to participate and comment on those proposed mitigation measures. He advised that staff would report on those negotiations. After that, public testimony can be received from those who wish to speak on the proposed mitigation measures or on the subject of the revocation of the rock quarry. In general, that this is a public hearing on all of those issues. Councilwoman Avila then read a statement to the citizens of Azusa. She stated that the whole issue should be brought back into perspective of what is basically the real issue concerning the status of the conditional use permit, which was granted some thirty years ago. That this Council is faced with the burden of that decision and above all the responsibility to come to an objective, mutual consensus of a rightful decision for the citizens, both legally and ethically. She further stated that the issue has become emotionally clouded by innuendo and flagrant attempts to pressure an irresponsible and premature vote of the Council by intimidation. She went on to say that much testimony has been heard and will be heard on this matter. The people elected the Council to represent them and in reciprocation of that trust, the Council will reach an honest and unbiased solution that is fair and equitable to all parties. The contingency from Duarte is here as guests and shall be treated as such and she trusted that they would conduct themselves in like manner as well as the entire audience. She went on to state that, as an elected official, she represented the entire City, and not a few special interest groups and would vote with a clear conscience and without any mental reservation. 11/21/88 PAGE FOUR Sched. Items Pub Hrg Azusa Rock Hrg opened Comments Cty Atty Statement Cnclwmn Avila Mayor Moses stated that it appeared to him that the conditional use permit has been violated. That the citizens of Azusa have a right to their opinions and feelings; that it is their city and their decision. He admonished the audience that he wanted the proceedings to go as smoothly as possible without emotional outbursts. Director of Community Development Bruckner addressed this item stating the the purpose of the hearing was to hear and consider any new testimony for possible revocation of the use permit governing Azusa Rock; to review any past evidence that might be on the record before the Council and also to review any potential conditions that have been created that would relieve the impact that Azusa Rock is currently creating on the environment. He went on to state that when the Council is deliberating they can rely on any testimony that is on the record to date; Planning Commission as well as Council. The Council has three potential alternataives of action available: No action, which would allow Azusa Rock to continue its operations as presently conducted, Revocation of Special Use Permit No. 3546, which would result in the closure of the quarrry, Impose additional conditions on Azusa Rock in order to mitigate the impacts. Mr. Bruckner elaborated on the findings that would have to be made in order to revoke the special use permit and also on the amended proposed conditions. Statement Mayor Moses Testimony staff 'The Mayor requested the action that the Planning Commission Comments had recommended, and was advised that the Planning Moses Commission recommended revocation of the use permit, based on their findings that there was abandonment and that Azusa Rock was a nuisance. Discussion was held regarding the use of Encanto Parkway only in emergencies and the use of explos..ves. Mr. Glenn Watson, representing Azusa Rock, addressed the Comments Council advising that he had no other comments to make G. Watson regarding this issue, but, did want to commend staff for their diligence and care in preparing the proposed conditions, and that they were acceptable to them. City Attorney apprised the Council that in the event the Comments Council approved the special use permit with these proposed Cty Atty conditions, that he would prepare a resolution with certain findings and would use the language of the conditions as they were presented this evening. Mayor John Hitt of the City of Duarte addressed this item stating that he and the City of Duarte appreciated the opportunity to speak before the Council to present the ,_concerns of the citizens of Duarte. He further stated that though they continue to believe that revocation of the permit would be the best way of solving the problems created -'*by the quarry operation, they also recognized that the Council has many perspectives to consider and that it is a difficult decision. While mitigation measures are not their preference, and the proposed measures are not as strong as they would like them, he hoped they would be implemented as quickly6as possible, and then they would have a better opportunity to judge their effectiveness. He stated that they are willing to accept them at this time. 11/21/88 PAGE FIVE Comments Mayor Hitt of Duarte Mrs. Gayle Avakian addressed this item stating that the rock quarry operation should be closed down permanently. She felt that the Council did not work diligently enough with the Committee to Save the Foothills. Rock quarrying should not be permitted in the water conservation zone. She felt that the Council was not interested in the health and welfare of the citizens. She felt the Council had the evidence to revoke their permit. Ms. Marlene Fox, attorney, representing the City of Duarte 'addressed this issue stating that the Mayor of Duarte has advised the official position of the City of Duarte. She, however, wanted to state for the City of Duarte, that the mitigation measures proposed are the absolute minimum that would be acceptable; because the City of Duarte favors the revocation of the quarrying permit. She felt that there was enough evidence to prove that the quarry was inoperable for a certain period of time and that they quarried beyond their boundaries and other conditions had been violated. Further, that the manner in which the quarry is operated consititutes a public nuisance. She did have some questions which she would like answered. Would the proposed conditions become a part of the special use permit if adopted by Council; she requested clarification on Condition I, regarding renewal of the quarry application and would that be a public hearing; further clarification on the public hearing process wherein the permit would be reviewed every two years. She also requested information on the zone change that had been continued regarding the rock quarry property and when that would be considered by the Council. Also, the status of the quarrying reclassification and redesignation of the rock quarry application to the State of California. She appreciated all the kindnesses and courtesies extended to her by staff and Council. Comments G. Avakian Comments M. Fox The Mayor asked Mrs. Fox on the status of the law suit Comments against the City of Azusa by the City of Duarte and if that Moses on suit would be dropped. She stated that she could not law suit respond on that at this time. Mrs. Gayle Avakian addressed the Council, stating that the Comments zoning of the rock quarry should be water conservation not G. Avakian community facilities. Mr. Tony Carrasco addressed the Council stating that he was Comments opposed to revocation of the permit. He and his wife were T. Carrasco both employed by the quarry. He felt that the company could work with the community to alleviate some of the problems that had been raised. Mr. Albert Aviles addressed Council, stating that he was Comments employed by Owl Rock for the past fifteen years. He felt A. Aviles that the continuing of the quarry was important to the people employed as well as the materials excavated were very important and needed for homes, flood control and other buildings. He did not favor revocation. Mrs. Carol Montano addressed the Council on behalf of the Comments Committee to Save the Foothills. She stated that the C. Montano 'Council's decision on this matter was very important. She felt the mitigation measures were not in the best interests of the City. She felt that revocation was the solution. Mr. John Van Doren addressed the Council as a member of the Comments Council from the City of Duarte. He responded to the J. Van Doren Mayor's question regarding the law suit against Azusa and stated that the Council of Duarte would have to meet and determine the appropriate action to be taken. As a citizen of the City of Duarte, he wanted to state that for many 11/21/88 PAGE SIX years the quarrying operation was silent and not any concern to him. However, when the quarrying resumed and the dust and noise problems were apparent, he was concerned. He, also, asked that the questions posed by Mrs. Fox would be considered. Mr. Art West addressed this issue requesting information on the placement of a conveyor belt across the river, the proposed new road on the east side of the river, and how much of Todd Avenue would be used when and if necessary. Community Development Director Bruckner responded to his concerns. Mr. West went on to state that he felt the City of Duarte was the beneficiary of the mitigation measures and the citizens of Azusa the loser. Mr. Ron Castleberry addressed this issue stating that he appreciated the City of Duarte investing their time and efforts to fight this issue. If the mitigation measures are approved then the citizens of Azusa will have to continue the battle. The quarry operation is an embarassment to the City and the San Gabriel Valley. Comments A. West Comments R. Castleberry Mr. Al Soper addressed this issue stating that homes have Comments been built on the foothills in the City of Duarte, and A. Soper wondered why the Committee to Save the Foothills did not object to that. He felt that the mitigation measures were fair for all parties concerned. Mr. Ron Legault addressed the Council stating that the homes Comments Mr. Soper alluded to were in the City of Bradbury, not R. Legault Duarte. He stated that the law suit against the City by Duarte would take tax payers money. The dust problems are still with us and there will be a lot more truck traffic. Mr. Tom Weckerly addressed the Council stating that he felt Comments the proceedings had been going on much too long and that no T. Weckerly one seemed to care about the employees of the quarry. Mr. Art Morales addressed the Council stating that the homes Comments Mr. Soper mentioned were in Duarte. He said that Azusa Rock A. Morales is an Azusa business using Azusa streets as was their rights. The City of Duarte should not have been built homes in such close proximity to the quarry. He believed that the mitigation measures should be approved. Mr. Art West addressed the Council stating that the concerns Comments of some that jobs would be lost if the quarry's permit were A. West revoked were not as large as the concerns of Johnston's Pump in Glendora, where 300 people would lose their jobs. Mr. Bert Law addressed the Council and stated that he was Comments proud of the City however, the quarry operations would ruin B. Law our drinking water. Mr. G. Paras addressed the Council stating that since moving Comments to the Valley he has a respiratory problem and the quarry G. Paras operations contributed to his problem. Because of all the evidence presented in the past, he felt the special use permit should be revoked. He stated that five quarry operations have been recently closed down because of environment problems. There being no further testimony, it was moved by Councilman Hrg closed Naranjo, seconded by Councilman Latta and unanimously carried by roll call to close the hearing. 11/21/88 PAGE SEVEN City 'Attorney then responded.to questions presented by Ms. Fox. With respect to the resolution amending the special use permit, he stated that the conditions would be a part of the resolution. With respect to Condition I, the renewal of the conditional use permit, the conditions as presently drafted provide that the decision is discretionary, however, that discretion is limited to the Council determining whether there has been substantial compliance with the conditions of approval. Also, with respect to Condition I, 'with the two year review by the staff and Planning Commission, the Public Hearing provided for, would be a duly noticed Public Hearing and subject to appeal. With regard to the zoning issue and Azusa Rock's application with the State for reclassification, these issues would be presented to the Council at a later date. Councilman Naranjo stated that the Council had received the final testimony, tonight, on this issue. That their decision was a difficult one and had to be considered carefully. Both the cities of Duarte and Azusa were dealing with past Council decisions of years ago; Azusa, allowing the quarry to operate, and Duarte, allowing homes to be built near the quarry operations. Therefore, he felt that mitigation measures were in the best interests of the citizens. He realized that some would not be in support of his decision, however, the citizens of Azusa elected the Council to protect the financial stability and responsibility of Azusa without jeopardizing their health and welfare, and he felt that mitigation addressed these concerns. He went on to state, that he would be the first to initiate proceedings for revocation of the permit, if Azusa Rock failed to comply with the conditions. He stated that he looks forward to a continuing working relationship with the City of Duarte and its citizens. He then made the motion to impose additional conditions as listed on Exhibit A, to mitigate these impacts. Mayor Moses wished to comment, stating that he was disappointed with the City of Duarte, because their complaints of dust and noise now reverted to the City of Azusa, because of the mitigation measures. That in 1956, when the quarry first started to operate, if they had quarried the mountain to the extent of today, there would be no problems, because there were no homes there then. He also did not appreciate the quarry using dynamite, as the dust problems would be greater. He felt that the recommendation of the Planning Commission to revoke the permit should be upheld. Comments Moses Councilwoman Avila commented that she felt empathy for the Comments people who were recipients of the dust problems. She has Avila & experienced the same problems. She stated that her decision second to was being made not without feelings, however, progress could motion of not be stopped, but a tighter rein placed on it. She then Naranjo seconded the motion made by Councilman Naranjo. Councilman Stemrich commented that he would go along with Comments Councilmembers Naranjo and Avila, and favor mitigation Stemrich measures. If the quarry did not comply, he said they would be closed down. Mayor Moses complimented the audience for their cooperation Moses com- in keeping their emotions in control, thus making the plimented Council's job much easier. Discussion was held with the Council regarding security, and General liability to the City if injuries occurred, and if the discussion business owners in the area were in favor of such an event. Mr. Art West addressed the Council regarding the Coast Fed Comments development and wondered why the existing apartments on the A. West west were going to be legalized. Director of Community CoastFed Development Bruckner advised that by doing so, there would project & be a continguous neighborhood of multi -family development response by that could work together in harmony and a project that would Comm.Dev.Dir. be completely rehabilitatad for low and moderate income Comments housing; further relocation costs would be extremely A. Morales expensive. Mr. Bruckner further advised him on the meaning 5th & Alosta 'center of legalizing a non -conforming use. Mr. West felt that probs Comments 'these apartments were of no value to the City. Patrick Mulraney, President of Truckers for Children, Truckers requested that he be allowed to close off Irwindale Avenue for Children from Gladstone to First Street, in order to have a fund req to have raising event to benefit children at the burn center. The benefit on event would commence at 7:00 A.M. on December 11th, and Irwindale cease at 10:00 P.M., but would like an additional 2 hours to clean up the street. Discussion was held with the Council regarding security, and General liability to the City if injuries occurred, and if the discussion business owners in the area were in favor of such an event. 11/21/88 PAGE NINE City Attorney apprised the Council that if any injuries occur on City Streets, the City is liable. It was consensus of Council that the matter be referred to benefit rfrd staff since there were many items that needed to be to staff addressed, such as logistics, police, fire and the closure of the street itself, as well as insurance requirements. Mr. Art Morales addressed the Council regarding hazardous Comments conditions at 5th and Alosta. He wondered if a striped A. Morales island could be erected so that people exiting the shopping 5th & Alosta 'center would have some measure of safety. Mr. Ron Legault addressed the Council stating that the fund probs Comments raising event that Truckers for Children were contemplating R. Legault on Irwindale Avenue could best be held on a portion of the use of Price Price Club parking lot. It would be more logical to do it Club fr ben. there. 11/21/88 PAGE NINE City Attorney apprised the Council that the Code Enforcement Comments officer and the Police Department were already working on Cty Atty abatement of the situation. The other alternative was a red-light abatement through the courts. Before such an action can be pursued an extensive report would have to be compiled as documentation. City Administrator Fuentes apprised that there are many bars Comments within the City that cause us problems. That even though Cty Admin one bar is closed down, their clients will frequent the others. City Attorney advised discussion that could not be done, but that the conditional use permit was the best tool to use in those cases. The possibility of the Redevelopment Agency purchasing that property was also discussed. Since this item was not on the Agenda, it was consensus of Matter rfrd Council that it be referred to staff for a complete report. to staff Councilwoman Avila advised that the porno shop, or adult Comments video store, was located near the School District office Avila adult where children are brought in to be tested for educational video store purposes. Lengthy discussion was held regarding this video shop, the General fact that they had placed newspaper ads advertising their discussion shops and listing their locations. Such an ad was even seen in San Diego, listing Azusa as one of their places of 11/21/88 PAGE TEN Mr. Louis Zamora addressed the Council stating some of the Comments problems that he sees in the City. He stated that L. Zamora yesterday, at 12 noon, two grown men were fighting just bars on 5th north of Fifth Street. He felt that this was a tragedy St. & porno breeding ground in that area with all the bars and the shop police problems. Another area is the pornographic video shop that is near the School District and near the elementary schools. He wished that the Council could address these items and do something to alleviate the problems. Councilman Stemrich apprised Mr. Zamora of some of the Comments problems that were occurring with the Alcoholic Beverage Stemrich Control with regard to these particular bars. They fine them, but do not close them down. Mr. Zamora stated that possibly on week -ends patrol officers Comments could walk a beat around that area, giving residents more Zamora security. The problems in that area affect the City economically. Lengthy discussion was held between the Council and Mr. General Zamora, wherein the Mayor was in favor of having two discussion officers patrol the area, and Councilman Latta stating that it should be declared a public nuisance and abated. The Police Department and City Attorney are well aware of the problem and are pursuing methods to reconcile the problem. The City Attorney advised Council that this video store was scheduled for discussion in Closed Session. OTHER BUSINESS/CITY COUNCIL Oth Bus/Cncl Moved by Mayor Moses, seconded by Councilman Naranjo and Cncl reps to unanimously carried by roll call that members of Council meet w/legis- meet with our legislators in Sacramento to discuss concerns lators of the City, such as the need for a traffic signal at Azusa Avenue and Ninth Street. Members of Council to rotate their visits and to authorize as many trips as deemed necessary to accomplish our goals. Discussion was held regarding the preservation/restoration Discussion of the Good Shepherd Presbyterian Church. City Attorney Good Shep. apprised Council that the Council had the authority to Church declare the church a historical building, however, no funds could be expended to help in its restoration. Moved by Mayor Moses, seconded by Councilman Stemrich and Aid church unanimously carried by roll call that the City afford any within legal aid to the Good Shepherd Church that is within the legal limits limits of the law. Discussion was held regarding erroneous editorial in the San Discussion Gabriel Valley Tribune on November 16th, wherein it stated SGV Tribune that the Council did not need to put all those revenue misleading measures on the ballot. We are required by State Law to do editorial SO. The Tribune has since printed a retraction, however, the misleading and inaccurate information is a source of irritation to the Council. Moved by Councilman Latta, seconded by Councilman Stemrich Formation and unanimously carried by roll call that an Azusa 2000 of Azusa 2000 Committee be formed. Said committee to be comprised of committee members of the community, who would design and report on goals and ideas that they would like to see in the year 2000. This report would be presented to Council for its use as a guideline and anticipated achievement, if feasible.
