MINUTES OF THE CITY COUNCIL
_ ADJOURNED REGULAR MEETING
' SEPTEMBER 261 1989 - 7:30 P.M.
The City Council of the City of Azusa met in adjourned
regular session at the above date and time in the Civic
Auditorium.
Mayor Moses called the meeting to order and led in the
salute to the Flag.

Moved by Mayor Moses, seconded by Councilman Stemrich and

PUBLIC NUISANCE ABATEMENT COST APPEAL of Felix Alvarez,
President of A -ABA Cellophane Products, Corp., 780 N. Loren
Avenue.
The property was declared a public nuisance on December 3,
1986, and an order to abate was issued specifying that the
owner would be charged for all costs should they fail to
comply. The owners were represented by an attorney
throughout the process. The owners did not appeal the
declaration or order to abate. The property owners failed
to comply.

Community Improvement Manager Rudisel gave testimony Testimony
regarding this appeal after being given the oath by the City Rudisel
Clerk. He gave all the facts concerning this case and
presented photographs of the area in question for the
record.
Appellant's attorney, Mr. McMeekin, gave testimony after Testimony
being given the oath by the City Clerk. He stated, in McMeekin
essence, that the City was not allowed to assess attorney's
__fees and that only abatement Costs should be levied.

General discussion was held between Council and Acting City
Attorney regarding this matter.
Further testimony was given by Mr. Alvarez and his attorney
Mr. McMeekin.
Moved by Councilman Naranjo, seconded by Councilman Stemrich Appeal
and unanimously carried by roll call* that appeal be denied denied
and that the costs be confirmed.
Councilman Naranjo offered a resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. #8715
AFFIRMING THE ORDER FOR ASSESSMENT OF COSTS FOR ABATEMENT OF affirming
A PUBLIC NUISANCE FOR PROPERTY LOCATED AT 780 N. LOREN abatement
AVENUE PURSUANT TO CHAPTER 15.08 OF THE AZUSA MUNICIPAL CODE costs
(CASE NO. 89-278).
Moved by Councilman Naranjo, seconded by Councilman Stemrich
to waive further reading and adopt. Resolution passed and
'adopted by the following vote of the Council:
AYES: COUNCILMEMBERS: AVILA, STEMRICH, NARANJO, MOSES
NOES: COUNCILMEMBERS: NONE
ABSENT: COUNCILMEMBERS: LATTA
Moved by Councilman Stemrich, seconded by Councilman Naranjo Adj to 10/2
and unanimously carried by roll call* to adjourn the meeting 6:30 P.M.
to 6:30 P.M., October 2, 1989, in the Senior Center.
