Mayor Moses called the meeting to order and led in the salute to the Flag. ROLL CALL PRESENT: COUNCILMEMBERS: AVILA, STEMRICH, NARANJO, MOSES ABSENT : COUNCILMEMBERS: LATTA ALSO PRESENT City Attorney Thorson, City Administrator Diaz, Police Captain Nelson, Public Information Officer Cooper, City Clerk Solis, Administrative Clerk Sifuentes. The purpose of the Special Meeting was to have a Closed Session and to consider the adoption of an Urgency Ordinance, as well as introductory first reading of the permanent Ordinance, prohibiting formation flying at altitudes of 700 feet or less in the City after dusk. Rursuant to Government Code Section 54956, the 'Notice of pd,cial Meeting' was delivered to each Councilmember, on the date and time set forth in the following: COUNCILMEMBER DATE AND TIME DELIVERED BY E. Ord re: formation flying Certification of Spec.Mtg. notice (Cncl) Certification of mtg notice to news media A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA TO Res. #8815 CESS TO CLOSED SESSION ON FEBRUARY 22, 1990, PURSUANT TO Closed Sess. HE PROVISIONS OF GOVERNMENT CODE SECTION 54957 AND MAKING INDINGS PURSUANT TO GOVERNMENT CODE SECTION 54956.9(b). Moved by Councilman Naranjo, seconded by Councilwoman Avila to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: AVILA, STEMRICH, NARANJO, MOSES NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: LATTA TIME OF RECESS TO CLOSED SESSION: 5:40 P.M. Recess THE CITY COUNCIL RECONVENED AT: 6:10 P.M. COUNCILMAN LATTA ENTERED THE MEETING DURING CLOSED SESSION. General discussion was held regarding the dangers of the malathion spraying as well as the dangers posed by the helicopters flying in formation at low levels during the night time hours. The safety factors of the helicopters, in the event there was engine failure, the contamination of 'water and effects of malathion on the public. It was consensus of Council that a letter be drafted to the neighboring cities effected by the spraying urging them to adopt a similar ordinance as the one to be acted upon by the Council this evening. Further, citizens were urged to contact the Governor and the candidates running for that position advising them that spraying of malathion was dangerous to their health and demanding that it be discontinued. Council questioned the feasibility of using a helicopter to enforce the Ordinance if adopted. Captain Nelson advised that the Police Department was in the process of contacting other agencies to ascertain if one of their helicopters could be used by Azusa for that purpose. In the event one could not be secured, the possibility of renting a civilian helicopter and using Police personnel to accompany the pilot could be authorized. Councilman Naranjo offered the Urgency Ordinance, which the City Attorney read in full, as amended, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING Urg. Ord. CHAPTER 8.65 TO THE AZUSA MUNICIPAL CODE PROHIBITING FLYING #2436 IN FORMATION AT LOW ALTITUDES OVER THE CITY OF AZUSA AND formation DECLARING THE URGENCY THEREOF flying Moved by Councilman Naranjo, seconded by Councilman Latta that Ordinance be adopted. Ordinance passed and adopted by the following vote, to wit: AYES: COUNCILMEMBERS: AVILA, STEMRICH, NARANJO, LATTA, MOSES NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Councilman Naranjo then offered the Ordinance, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING CHAPTER 8.65 TO THE AZUSA MUNICIPAL CODE PROHIBITING FLYING IN FORMATION AT LOW ALTITUDES OVER THE CITY OF AZUSA Moved by Councilman Naranjo, seconded by Councilman Latta and unanimously caried by roll call to' waive further eading and introduce the ordinance. ,r. Mark Saucedo addressed the Council and advised that when he was a Safety Officer at Point Mugu, malathion was banned as a hazardous material, and not used at that base. He further stated that helicopters flying in a stacked formation at dusk is very hazardous and statistics have proven this. 02/20/90 PAGE TWO 1st rdg Ord formation flying Comments M. He was advised that it may not do anything but cause attention and the politicians will listen. Moved by Mayor Moses, seconded by Councilman Naranjo and Ltrs of pro - unanimously carried by roll call that a protest letter be test & Ord drafted and sent to the Governor, the Department of to Govrnr & Agriculture and all of our legislators regarding malathion legislators spraying and that a copy of the Urgency Ordinance be included. Master Brian Belangeri, Fourth grader, in the City of Azusa Comments addressed the Council and stated that he was aware the B. Belangeri spraying was harmful and did not want'any more, as he did not want to die from it. Moved by Mayor Moses, seconded by Councilman Stemrich and Contact EVO unanimously carried by roll call that EVO be contacted to fr sprt support the City's stand against malathion.
