Community Development Director Bruckner addressed Council explaining the definition and reasons for amortization in the City. He further gave examples of what would occur if complete removal of amortization in the City were implemented. He stated that if the City Council is attempting to respond to the more limited issue of these residential properties, the amortization section of the code could be modified while retaining the section essential to community improvement. The recommended changes to the code would be as follows: Make the finding that all residential ,development, regardless of density, is compatible with one another for purposes of amortization; therefore, there will not be a need to amortize residential units in residential zones; modify the provision dealing with the ability to reconstruct nonconforming uses due to destruction by fire, explosion or Act of God. The current code requires full amortization if the structure is damaged to the extent of 150% or more of the assessed valuation. A more common and equitable provision would be 50% or more of the structure's current appraised value. Roll Call Also present Amortiza- tion Worksp Comments R.
