Mayor Moses returned to the Council table.
A discussion was held regarding the current status of the
Design Review Overlay program. Community Development
Director Bruckner addressed Council regarding the history of
the Design Review Overlay from its inception in 1986 to the
present. In summary, he advised that because of lack
of sufficient staff, property owners were not held
accountable for the requirements under this program until
such time as they applied for a building permit, or by way
of complaint. Various Councilmembers, Planning
Commissioners and audience members asked questions,
principally regarding the right to dictate these
requirements to people. Community Development Director
Bruckner responded by saying that it was the Municipal Code
that dictated his department's actions.
