The City Council of the City of Azusa met in adjourned regular session at the above date and time in the Azusa Library Auditorium. Mayor Moses called the meeting to order and lead in the salute to the Flag. ROLL CALL PRESENT: COUNCILMEMBERS: DANGLEIS, STEMRICH, NARANJO, ALEXANDER, MOSES ABSENT COUNCILMEMBERS: NONE ALSO PRESENT Acting City Attorney Mc Osker, City Administrator Caswell, Director of Community Development Bruckner, Community Improvement Officer Rudisel, Senior Planner Watrous, Planning Technician Tang, Acting Deputy City Clerk Toscano, Planning Commission Members Moritz, Subia, Holliday and Ripley. Roll Call Also present Mayor Moses abstained from agenda item dealing with the Mayor abstn discussion of amended nonconforming use Ordinance on advice D-1 of the Acting City Attorney. It was consensus of Council that the Public Pub Part Participation portion of the agenda be moved to the end of end of mtg the meeting. Community Development Director addressed Council stating Comments that staff had previously been directed to amend the Comm Dev Dir amortization provisions of the Azusa Municipal Code. The Non -conform - directive was to eliminate amortization for residential uses ing use Ord. in residential zones, but to retain it for dissimilar land uses and certain development standards. The proposed amended Ed Tyck Ordinance was presented to Council for discussion. Mayor Pro -tem Dangleis chaired this portion of the Agenda Comments and asked staff to clarify for the audience, if this Mayor Pro - proposed ordinance is in favor of residential amortization tem Dangleis or if it is against amortization of any kind. Community Development Director responded that this ordinance Response would eliminate amortization from residential zones. Comm Dev Dir ' The following persons addressed Council expressing their views in favor of this proposed Ordinance: In favor of Ordinance Comments: Mr. Charles Garcia C. Garcia Mr. Anthony Ruelas A. Ruelas Mr. Ed Tyck E. Tyck Mrs. Marian Prefontaine Prefontaine Mr. James Sainz J. Sainz Mr. Eugene Ruddell E. Ruddell Mrs. Mary Lou Ruddell M. Ruddell Ms. Carmencita Amulong C. Amulong Mayor Pro -tem Dangleis read a letter from Joe Medina Sr expressing his views against the proposed Ordinance. Mr. Bill Simpson addressed Council at length voicing his reservation concerning amortization. The following persons addressed Council expressing their views in opposition to the proposed ordinance: Mrs. Frances Gonzales Mr. Murray Hirota Mr. Oscar Zamora Mrs. Isabel Fierro Mr. David Santellan Mr. Art Morales The majority of citizens were concerned with the Central area of the City and the apartments that are in this residential area. Noted were problems such as, drug traffic, prostitution, parking problems and code violations. Further, the citizens are concerned that if amortization is eliminated in this area, there would be no way to rid the area of these problems. ltr from J. Medina Comments B. Simpson Oppose Ord. Morales Concerns w/ Central Area Apartments Mrs. Inez Gutierrez addressed Council and stated that the Comments problems with apartments in the central area were health and I. Gutierrez safety problems which can be handled through Code Enforcement and the Police Department. A general discussion followed concerning the pros and cons of the situation. Subsequent to this Mayor Pro -tem Dangleis asked each Councilmember for his opinion. founoilman Alexander addressed this item stating that he Comments s against amortization and that it freezes property in S. Alexander tate for thirty years, further he believes in strong code enforcement. Councilman Naranjo addressed this item stating that he is not a supporter of the proposed Ordinance and further that code enforcement can only be controlled and supported by the Council that is in office at the time and that there is a need for a tool to control these problems and that is through amortization. Councilman Stemrich addressed this item stating that since the issue of amoritization has been tossed back and forth for about three years, he feels it is time for it to -be placed on the ballot so that the citizens of Azusa can decide if they want amortization or not. He requested that this be placed on the Agenda for the next Council meeting. Acting City Attorney McOsker responed that he would prepare a report back to Council as to whether or not the issue of amortization could be a ballot measure. It was moved by Councilman Stemrich to continue this agenda item for further discussion to the next Council meeting. Motion died for the lack of a second. It was then moved by Councilman Alexander to refer agenda item to the Planning Commission for a Public Hearing. Motion died for the lack of a second. Comments A. Naranjo Comments H. (dies) Moved by Councilman Naranjo, seconded by Councilman Stemrich Motion to and carried by roll call that this item be deferred defer action indefinitely. Mayor Moses abstaining and Councilman indefinitely Alexander dissenting. 11/13/90 PAGE TWO Mayor Moses returned to the Council table. A discussion was held regarding the current status of the Design Review Overlay program. Community Development Director Bruckner addressed Council regarding the history of the Design Review Overlay from its inception in 1986 to the present. In summary, he advised that because of lack of sufficient staff, property owners were not held accountable for the requirements under this program until such time as they applied for a building permit, or by way of complaint. Various Councilmembers, Planning Commissioners and audience members asked questions, principally regarding the right to dictate these requirements to people. Community Development Director Bruckner responded by saying that it was the Municipal Code that dictated his department's actions. Moses retnd Discussion re: Design Review Overlay Ord. Mr. Bernard Saxon addressed this item with his concern Comments regarding several aspects of the Design Review Program. He B. Saxon stated that this ordinance was unfair to small business owners in the City as well as businesses that have been in the City for several years and had applied for and obtained all necessary permits years ago. In conclusion, it was moved by Mayor Moses, seconded by Councilman Stemrich and unanimously carried by roll call to direct staff to redraft the Design Review Ordinance to indicate renotification process, as well as to indicate any changes in the application criteria and whether the ordinance would pertain to new or modified construction. PUBLIC PARTICIPATION Mr. Ron Legault addressed Council with his concerns regarding numerous vehicles that are left at the bottom of 'the canyon in the water after they were involved in accidents. He stated that the gas, oil and deteriorating metal might affect the drinking water. He was advised that the area that he was talking about was owned by Pasadena Water Works. Moved by Councilman Naranjo, seconded by Councilman Stemrich and unanimously carried by roll call to adjourn.
