HomeMy WebLinkAboutMinutes - May 30, 1991 - CCCITY OF AZUSA MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR MEETING MAY 30, 1991 - 7:30 P.M. The City Council of the City of Azusa met in adjourned regular session at the above date and time in the Azusa Library Auditorium. Mayor Moses called the meeting to order and led in the salute to the Flag. ROLL CALL Roll Call PRESENT: COUNCILMEMBERS: DANGLEIS, STEMRICH, NARANJO, ALEXANDER, MOSES ABSENT COUNCILMEMBERS: NONE ALSO PRESENT Also present City Administrator Caswell, Senior Planner Watrous, Planning Technician Tang, Planning Commission Members, Solem, Castaneda, Holliday, Moritz, Flowers, Ripley and Subia, Acting Deputy City Clerk, Toscano. The San Gabriel Valley Council Boy Scouts of America Boy Scouts requested that the Mayor aid them in their 1991 Fund Raising Fund Raising Campaign. They requested that the Mayor submit letters with Campaign return envelopes to businesses on the City vendor list soliciting funds for their organization. It was moved by Mayor Moses, seconded by Councilman Alexander and carried by roll call to approve the request of the Boy Scouts, noting that the letter come from all Councilmembers and would not have return envelopes enclosed. Councilman Dangleis dissenting. City Administrator addressed Council regarding the Design Design Revw Review Ordinance stating that at a prior joint workshop Ordinance between the Planning Commission and City Council, staff was Amendment directed to amend the Design Review Ordinance. He stated that property owners in the overlay zone who were not making improvements or new construction to their property were objecting to complying to the Design Review Ordinance and requested direction from the Council and Planning Commission. Mr. Saxon, who is an Azusa property owner, addressed Council Comments and Planning Commission members stating that the City has existing ordinances and health and safety codes which could be enforced to ensure that owners maintairr their properties rather than be considered under the Design Review Ordinance. General discussion was held between Council and Planning General Commission citing various problems that have arisen through Discussion the enforcement of the current Design Review Ordinance. Each member presented his view on the subject, and each noted it did not seem fair that property owners who are not constructing improvements have to comply with the Design Review Ordinance. It was further noted that there have been some unreasonable requirements such as block walls that serve no purpose, color schemes, trash bin enclosures for some people but not for others, etc. Assistant Planner Watrous answered various questions posed Comments by the Council and Planning Commission members and stressed Watrous the need for specific direction regarding the Design Review Ordinance. Mr. Saxon, who is an Azusa property owner, addressed Council Comments and Planning Commission members stating that the City has existing ordinances and health and safety codes which could be enforced to ensure that owners maintairr their properties rather than be considered under the Design Review Ordinance. Ron Legault addressed Council and Planning Commission members stating that the trash dumpsters at Gladstone Park should be in an enclosed area. Art Morales addressed Council and Planning Commission members expressing his views regarding the properties on the 700 block of Azusa Avenue. After lengthy discussion regarding the Design Review Ordinance it was moved by Councilman Dangleis, seconded by Councilman Stemrich and unanimously carried by roll call to direct staff to revise the Design Review Overlay Ordinance where it emphasizes the following requirements: (1) "Clarifies that Design Review applies to all new developments", and (2) "Clarifies that Design Review applies to all existing development if they are making improvements to their properties, or the use is changed", and to delete the requirement: "Existing properties be automatically subject to Design Review". And further that staff be directed to review the list of requirements in the Design Review process with discretionary changes such as using the words "may be required". Comments R. Morales Design Revw Ordinance to be amended At this time discussion was held regarding the General Plan Discussion Element regarding Spanish -style motif in certain areas of General Plan the City and it was consensus of the Council that this be Element reviewed by the Planning Commission. Councilman Stemrich addressed complaints he received from property owners who installed driveways on their properties leading to areas where they park their boats, campers, etc. He stated that -according to the City's Municipal Code Section 19.48.055, this is not permitted and consequently has to be removed, which causes problems for these residents. He requested that this requirement be deleted from the Municipal Code. It was consensus of Council that this be referred to Planning Commission for review. City Administrator Caswell addressed Council and Planning Commission members regarding the SP -1 zone, which is the West End Specific Plan zone. This zone permits businesses that are only for automotive oriented uses. A carpet business has requested to operate out of a building in this area. It was consensus of Council that this be referred to Planning Commission for its review. Discussion was held regarding the definition and requirements for drive-in businesses in the City. City Administrator Caswell addressed this item stating that with recent concerns regarding mini -malls, liquor sales, etc., there was some confusion between drive-in and drive-thru businesses. He further stated that drive-in businesses require a Conditional Use Permit and that the sale of liquor does not. He suggested that a Conditional Use Permit be required for the sale of liquor so that there would be specific control by the City. Senior Planner Watrous addressed this item stating that on -sale liquor does require a Conditional Use Permit but that off -sale liquor does not and further that the definition of drive-in businesses does need clarification with regard to the way it is written in the Municipal Code. He suggested that it would be more appropriate to call the business drive -up or drive-thru. Discussion driveways West End Specific Plan Discussion Drive-in Businesses Comments Watrous Moved by Councilman Stemrich, seconded by Mayor Moses and Drive-in unanimously carried by roll call to revise requirements for Business drive-in businesses by applying stricter laws and to present revision to Planning Commission for their review. 05/30/91 PAGE TWO k., i I.:a Following additional discussion, it was moved by Councilman Naranjo, seconded by Councilman Dangleis and unanimously carried by roll call to explore possibilities for increasing Alcohol Beverage Control responsibility of all alcoholic dispensing businesses. Senior Planner Watrous addressed item regarding antique Antique stores stating that there is a need for clarification of the Stores definition of antique and second hand stores, because they are now identically defined in the Municipal Code. Since this has caused some confusion when dealing with new businesses, he requested guidance from the Council and Planning Commission. After discussion it was moved seconded by Councilman Dangleis separate antique stores from Municipal Code and create a stores. Mayor Moses abstaining. by Councilman Alexander, and carried by roll call to second hand stores in the new definition for antique Moved by Councilman Naranjo, seconded by Councilman Stemrich and unanimously carried by roll call to adjourn.
