PRESENT: COUNCILMEMBERS: DANGLEIS, MADRID, NARANJO, ALEXABSENT: COUNCILMEMBERS: NONNEIJDER, MOSES ALSO PRESENT Interim City Attorney Barbosa, City Administrator Garcia, Chief of Police Nelson, Director of Finance Craig, Community Development Director Bruckner, Utilities Director Hsu, Director of Community Services Guarrera, Superintendent of Public Works Pedroza, Administrative Analyst Dadaian, City Librarian Magsoudi, Redevelopment d Project Manager Forintos, City Treasurer Talley, Deputy City Clerk Toscano, Office Specialist Juana Hernandez. CEREMONIAL Councilman Naranjo presented a plaque to Victor Subia in honor of his service to the City as a former Planning Commissioner. Councilman Dangleis presented a plaque to Lyle Moritz in honor of his services to the City as a former Planning Commissioner. Chief of Police Nelson addressed Council offering congratulations and appreciation to the former commissioners. PUBLIC PARTICIPATION Mrs. Carol Montano, Director of the San Gabriel Valley Municipal Water District Addressed Council providing information regarding the San Gabriel Basin Water Quality Authority. She stated that there will be an assessment for a groundwater cleanup and that the Public Hearing will be held on September 20, 1993, at the Embassy Suites in Covina. She further provided an overview of three additional plans of the Authority, which were: the Metropolitan Water District conjunctive use, the EPA Treatment Plant, and the Torres -Feinstein Bill which calls for public/private partnership. Mr. Ken Manning, President of the Water Quality Authority addressed Council providing additional information on the Assessment. A question and answer session ensued between Councilmembers and Mr. Manning regarding the assessments, superfund, and general aspects of the Water Quality Authority. Manning comments Moved by Councilman Alexander, seconded by Mayor Moses and Item N -2a unanimously carried by roll call that item N -2a be brought brt fwrd forward for handling at this time. Mr. Art Morales addressed Council expressing his opinion A. Morales regarding the requirements for exemption from the comments assessment fees. Mr. Art Morales addressed the issue requesting that the A. Morales City aid Tapatio taco stand to relocate to the old comments McDonalds building and at the same time be preserving the building as a historical site. Mr. Wesley Kloepfer addressed Council with concerns W. Kloepfer regarding garage and yard sales, cable television comments reception, and business license fees. Staff was advised to take notice and respond to Mr. Kloepfer's concerns. Mr. Kevin Nunez addressed Council announcing the upcoming K. Nunez Azusa Classic Power Lifting Competition to be held at Azusa Comments High School on October 23, 1993. Mr. Buck Gwyn, resident of the City of Duarte addressed B. Gwyn Council expressing his concerns with dust from the Rock comments Quarry and also suggested that improvement be made to the procedures for entering the trails. Mr. Ron Legault addressed Council voicing concerns R. Legault regarding the old McDonalds building and Krems property in comments general. Ms. Lyn Van Kuilenburg addressed Council providing L.Van Kuil- definitions of numerous words and phrases utilized when enburg discussing the rock quarry industry. comments Mr. Jerry Hobbs addressed Council requesting an agenda date J. Hobbs in order to provide a presentation of a request to operate comments a bingo parlor. Councilman Naranjo responded providing him with procedures Naranjo for the presentation via City Administrator and other response information involving requests for bingo parlors. City Administrator Garcia advised that he was contacted by City Admin persons regarding the operation in the City about one year response ago, but that specific information regarding the operation was never received. The CONSENT CALENDAR consisting of Items 1 through 11 was approved by motion of Councilman Dangleis, seconded by Councilwoman Madrid and unanimously carried by roll call vote, with the exception of item G-6, which was considered under the Special Call portion of the Agenda. Councilman Dangleis abstained from item G-5, due to his active participation the NAIA National Track and Field Championships. 1. Moved by Councilman Alexander, seconded by Mayor Moses and City Atty unanimously carried by roll call that the City Attorney be to review directed to review ordinances of other cities that protect Ord protect historical buildings and that go along with the State of hist bldgs California Land Preservation Act. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF Res 93-C111 AZUSA APPROVING APPROPRIATION AMENDMENTS FOR Bdgt trsfrs FISCAL YEAR 1993-94 PURSUANT TO SECTION 3.040.050 OF THE AZUSA MUNICIPAL CODE.. 3. The Recreation Division will be hosting the second Holiday Bou annual Holiday Boutique on Saturday, December 4, tique/Bus 1993, at City Park from 7:00 a.m. to 5:00 p.m. In Lic Fee an effort to attract a good number of vendors and waived to encourage true novice arts and crafts, the one day business license fee for vendors was waived and the use of City Park for the event was approved. 4. Approval was given of the concept of implementing ESGV Recy- a recycling market development zone by entering cling Mkt into an agreement with the East San Gabriel Valley Dev Zone Recycling Market Development Zone Applicants. At this time the cities of Baldwin Park, Covina, E1 Monte, Glendora Irwindale, La Puente, La Verne, Pomona, and San Dimas have considered joining together to develop an application. Staff was authorized to work with cities listed. 5. Request by Azusa Pacific University that the City APU/NAIA of Azusa be a major sponsor of the 1994-95 NAIA sponsorship National Track and Field Championships was approved. The sponsorship was budgeted in the 1993-94 City budget. 6. SPECIAL CALL ITEM. Spec Call 7. At the August 2nd meeting, the Park and Recreation Trees in Commission was directed to investigate the area of possibility of removing Pear trees along Edith Ann Edith Ann and replace them with Myrtle trees. An extensive feasibility and cost study was conducted of the area. The Park and recreation Commission recommendation was approved as follows: the Pear trees not be removed or changed; staff be directed to remove the dead tree at 1307 Craig Allen Dr., examine the sick tree at 655 Edith Ann to determine if it can be saved; if not, that they both be replaced by Pear trees. 8. Renewal of contract between the City of Azusa and Agmnt w/ Los Angeles County for Weed Abatement Services was LA Co. Weed approved and its execution was authorized. Abatement 9. Renewal of agreement between the City of Azusa and Agmnt w/ the Chamber of Commerce for business development Chamber of and community promotion was approved and its Commerce execution was authorized. 10. The City Treasurer's Report as of July 3, 1993, was received and filed. 11. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. SPECIAL CALL ITEMS Councilwoman Madrid congratulated employees listed for step increase/permanent status recommendations and welcomed the new Redevelopment Director Steve Cervantes. Deliberat Azusa Rock Quarry appl 09/07/93 PAGE FOUR City Attorney Barbosa addressed the issue stating that the City Attny second opinion regarding the Azusa Rock Quarry operation comments has been received from Mr. Richard R. Terzian of the firm of Adams, Duque & Hazeltine and that .they find no present basis for entertaining the appeal to revoke the Rock Quarry permit. He then suggested that the findings of the Planning Commission, that the rock quarry operation be allowed to continue, be upheld. Moved by Councilman Dangleis, seconded by Councilman Appeal Naranjo and carried by roll call to deny the appeal and denied uphold the Planning Commission's recommendation. ' Councilwoman Madrid and Councilman Alexander dissenting.
