MINUTES OF THE CITY COUNCIL
REGULAR MEETING
DECEMBER 20, 1993 - 7:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and
time in the Civic Auditorium.
Mayor Moses called the meeting to order, led in the salute to the Flag.
INVOCATION was given by Director of Finance Geoff Craig.

The Council meeting was dedicated to the memory of Nick Macias. Mtg dedicated

Moved by Councilman Dangleis, seconded by Councilman Naranjo and unanimously N -2a brt fwrd
carried by roll call that item N -2a, relating to Nativity Scenes, be brought forward
for handling at this time.
Mr. Don Flowers addressed Council requesting that the Nativity Scene be allowed to D. Flowers
be placed on the front lawn of City Hall as in the past. He advised that it would be re: Nativity Scene
available from the Chamber; funds of $250 were donated and additional funds could
be donated by the City, if that was feasible, if not, they could be solicited from the
public.
City Attorney Barbosa cautioned Council that permitting private parties to place a Cty Attny
display of any kind on City property could possibly open the door for any group, advises
possibly negative, wishing to place improper or unwanted displays in front of City
Hall.
Discussion was held between Councilmembers and City Attorney Barbosa regarding Discussion
the types of groups or exhibits that may surface if the Nativity Scene is allowed to be
'placed on the front lawn of City Hall and the possible repercussions that may occur.
Mr. Carrel Cline addressed Council opposed to the possibility of opening the door to C. Cline
groups being allowed to negative displays. comments
Moved by Councilman Naranjo, seconded by Mayor Moses and unanimously* Nativity Scene
carried by roll call that the private party be allowed to place a Nativity Scene on the @ City Hall
front lawn of City Hall, at no cost to the City, from December 20, 1993 through experiment

Mr. Jim McJunkin addressed Council inquiring about his request at the last Council J. McJunkin
meeting that Council direct staff to seek ways to control dust better, change the comments
Conditional Use Permit, or change conditional operating permit of Azusa Rock.
City Administrator Garcia responded stating that due to the continuance of the City Admin
Planning Commission meeting, staff is not in the position to offer any other different response
information other than the Planning Commission staff report.
At this time Mayor Moses requested City Attorney to address why he has had to Moses
abstain on voting on the Azusa Rock issue. comment
'City Attorney Barbosa advised that the Mayor owns property adjacent to property City Attny
owned by Owl Rock Products, who is an entity of Azusa Rock, and that action of Response
Azusa Rock could represent an impact on the value of the Mayor's property. He
recommended abstention by the Mayor.
Chief of Police Nelson addressed Council wishing all a joyous and happy holiday
season. He advised the community not to drink and drive and further expressed his
gratitude to all who supported the Christmas tree sales by CAPP and APOA, which
raised funds for twenty -seven families in the community.
Mr. Art Morales addressed Council in favor of the Nativity Scene.
Director of Community Services Guarrera announced that Christmas Carollers will
be visiting the homes of Council and Commission members on Tuesday, and
reminded all that dinner is being served at the Senior Center on Wednesday night.

The CONSENT CALENDAR consisting of Items 1 through 13 was approved by Consent Cal.

3. White Construction completed the City -Wide Concrete project in accordance Notice of
with the Plans and Specifications. Due to saving in other capital improvement Completion
projects, the scope of this project was changed to include reconstruction of two City -Wide
alleys, expansion of City Yard, and additional concrete work. To close out the Concrete
contract, funds of $126,506.00 were taken from fund balance. The project was White Con -
accepted as complete; the extras and transfer of funds were approved; the struction
Notice of Completion was approved and its recordation was authorized.
' 4. The Police Department has declared two Kawasaki police motorcycles as Donate 2 Kawa-
surplus equipment. Normally this type of equipment is turned over to the city saki Motorcycles
for auction but, historically brought little revenue back to the city. Request to to Zacatecas,
donate the motorcycles to our Sister City, Zacatecas, Mexico, was approved. Mexico
5. GES -KMS III, is the developer of the methane gas electrical generating plant at Transmission
the Azusa Land Reclamation Company Property. They will sell the energy Agreement
produced from the generating plant to L.A. Department of Water and Power btwn GES -KMS
through Azusa and Edison electrical systems. They have requested Azusa to III
transmit the energy produced from the plant and deliver it to Edison at the
Azusa Substation. Certain upgrading will be required by the City and GES -
KMS III has agreed to reimburse the City of all costs for upgrading, terms,
conditions, and charges customary to providing transmission service. The
agreement was approved.
6. The Resources in Schools and the Environment Program is a partnership Education Part -
between the Department, Azusa schools, and the National Foundation, a non- nership/Phase
profit, national organization of education specialists. A committee of local II
public and private school teachers, coordinated by the Media and Curriculum
Administrator from AUSD, convenes regularly to plan and administer the
Program. Phase I of the Program concentrated on elementary school providing
teacher training and materials and was completed this fall. Phase II is planned
through June 30, 1994, where the Committee has plans to expand the number
of elementary schools and teachers attending the summer training institutes as
well as to reach out to High School teachers. Phase II was approved.
7. Chemical Waste Management, Inc., completed the removal of hazardous waste Completion of
materials from the City Yard, but, during the process, additional paints and hazardous waste
copper sulfur were brought into the Yard from illegal roadside dumping. There removal/Chemical
was a need for a change order in the amount of $2,525.50; advertise for bids Waste Mgmt., Inc.
at a later date. The hazardous waste removal with accompanying change orders
was approved.
8. Plans and Specifications for the Slauson park Community Pool were approved Plans & Specs
and the City Clerk was directed to advertise for bids. Slauson Pk Pool

10. Four informal quotations were received for the improvement of the public Sidewalk impvmts
sidewalks surrounding the Canyon Filtration Plant Property. The project would Canyon Filtration
include approximately 5292 square foot of sidewalk, two drive approaches, a Plant/G.M. Sager
' reservoir roadway, to include grading and compaction. Formal bidding
procedures were waived pursuant to the Municipal Code and the contract was
awarded to G.M. Sager Construction Company, low quote, in the amount of
$23,699.00, and its execution was authorized.
11. Approval was given to purchase the services of R.C. Foster Corporation for the R. C. Foster Corp.
installation of an altitude valve on Heth Reservoir at a cost of $6,500.00 Install valve

12. Louis T. Gabriel, Incorporated, completed Project No. D92040, City Facilities Notice of Comp.
Entrance Door Retrofit, in accordance with the plans and specifications of the Louis T. Gabriel
contract, on December 15, 1993. The project was accepted as complete, the Door retrofit
Notice of Completion was approved and its execution and recordation were
authorized.
13. Resolution authorizing payment of warrants by the City was adopted and
entitled:

Central Business District Redevelopment Project Area by the Agency to Bowden Sale of crt prop

Street and Alameda.

Project Manager Rick Forintos addressed the Hearing providing a detailed report of CRA Project
the proposed Disposition and Development Agreement between the Manager
City/Redevelopment Agency and Bowden Development Incorporated for the property continents
located on the northwest corner of Alameda Avenue and Sixth. He provided a
presentation of the proposal by Bowden Development to construct four single family
first time buyer homes on the property, which consisted of the project description,
Developer obligations, qualifications, Agency obligations, special housing provisions,
schedule of performance, and project costs and benefits. He further advised about
the silent second as well as deed restrictions to one house per lot.
Mr. Fred Bowden of Bowden Development Incorporated addressed the Hearing F. Bowden
soliciting questions from Council or audience. There were none. comments
Mr. Art Morales addressed the Hearing expressing his opposition to the demolition A. Morales
of the First Presbyterian Church that once stood on the property. comments
City Administrator Garcia responded stating that the demolition of property was a City Admin
joint effort by the owner and City to protect the public from danger under the health response
and safety code.

Chief of Police Nelson addressed item regarding cost recovery on juvenile detention COP/comments
stating that many situations involving juveniles have caused wasted time and money
to babysit the minor until the parents decide to pick up their children, and there have
been repeated offenders. He stated that rates to be considered will be adopted by
resolution at a later date.
Councilman Naranjo offered an Ordinance entitled:
