MINUTES OF THE CITY COUNCIL
' SPECIAL MEETING
APRIL 15, 1994 - 7:30 P.M.
The City Council of the City of Azusa met in Special session at the above
date and time in the Civic Auditorium.
Mayor Alexander called the meeting to order, and led in the salute to the Call to Order
Flag.

Nelson, Water Superintendent Bowcock, Deputy City Clerk Toscano.
The purpose of the Special Meeting was to consider continuance of water Purpose of

City Administrator Garcia addressed the issue stating that Mr. Covell has City Admin
requested a fourteen day extension of water service being supplied by the comments
City. He detailed the events that led up to the situation at hand.

Mr. Ralph Covell addressed the issue stating that the problems with the
water on his property began when the County sluicing project polluted his
water well. He advised that he has a claim pending against the County, of
which the City is now a third party claimant. He also described the losses
he has experienced since that time. He stated that he does have another
well and that he is currently in the process of running pipe into the existing
water lines from that well but needed fourteen days to complete the process.
Discussion was held between Councilmembers and Mr. Covell regarding the
county delivery of water, the time extension, alternate arrangements, his
claim against the county, the money that he currently owes the City for
water already delivered since September, 1993 and other possible methods of
supplying water to his property.
Further discussion was held between Councilmembers and Mr. Covell
regarding the guarantee of payment for water to the City. It was suggested
that Mr. Covell allow the City to impose a lien against his property for
payment, he responded negatively to the suggestion, stating that the City
would receive payment after settlement with the County. Councilman
Naranjo stated that it was not the responsibility of the Council to give away
public funds by giving Mr. Covell water at no cost.

Mr. John Donathan addressed the issue in favor of continuing water J. Donathan

Moved by Councilmember Hardison, seconded by Mayor Alexander to Motion approve
approve a two week extension of water service to the Covell property. extension of

Moved by Councilmember Madrid, seconded by Councilmember Naranjo Motion approve
and carried by roll call that additional water service to the Covell property water service
be granted with the stipulation that Mr. Covell make payment for water w/payment/lien
services received to this date or that he provide a lien on his property for for past due
past amount. Councilmember Hardison and Mayor Alexander' dis- amount (appvd)

Moved by Mayor Alexander, seconded by Councilmember Beebe and Adjourn
unanimously carried by roll call to adjourn.
