The City Council of the City of Azusa met in regular session at the above date and time in the Civic Auditorium. Mayor Alexander called the meeting to order, and led in the salute to the Flag. Call to Order INVOCATION was given by Reverend Rick Mac Donald of the Foursquare Gospel Invocation Church. ROLL CALL Roll Call PRESENT: COUNCILMEMBERS: HARDISON, MADRID, NARANJO, BEEBE,ALEXANDER ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT: Also Present City Attorney Dietsch, City Administrator Garcia, Acting Chief of Police Garcia, Community Development Director Bruckner, Utilities Director Hsu, Director of Community Services Guarrera, City Librarian Maghsoudi, City Engineer Abbaszadeh, Superintendent of Public Works Pedroza, Computer Services Support Mc Laughlin, Redevelopment Director Cervantes, Economic Development Specialist Hall, City Clerk Solis, Deputy City Clerk Toscano. CEREMONIAL Ceremonial The entire Council presented Certificates of Appreciation to all who participated in the Cert of Apprec. Vietnam Veterans Moving Wall Event. Moving Wall The entire Council presented a Certificate of Recognition to Mr. Chuck Ernst, Teacher Cert of Recog. of the Year. Economic Development Specialist Hall addressed Council announcing that the Azusa Float Committee has received $59,000 to date. She also introduced the winners of the float riding contest which were: Murray Hirota, Rachel Tapia, Michael Horta, James Ramirez, Nila Ferguson, and Lorena Arriaga. She also stated that the Blast to the Past event raised $4,000 and recognized residents, businesses and the School District for their contributions. Ms. Nancy Moore of the Azusa Unified School District addressed Council recognizing the students of the district for their participation in the many school fundraisers that 'were held for the Azusa Rose Float Committee. She stated that the Pennies for Petals program raised $2,045 in pennies, that the Shop Azusa two for one discount cards are now on sale for $10, and that Longfellow School held a swap meet with a part of the funds to go to the Rose Float. She then reintroduced the students to ride on the float who introduced their families to all, and two school students that will ride on the Azusa Rose Float who read the essays they wrote about the Rose Float. M. Hall/ Rose Float Update/riders N. Moore AUSD comments Economic Development Specialist Hall readdressed Council announcing the Lasagna M. Hall lunch to be held on Wednesday, December 6, 1995, from 11:30 a.m. to 1:30 p.m., at announcements the City Hall Gazebo. She also announced the Azusa Rose Float Viewing and Special Reception of thanks to be held on December 19, 1995, at Fiesta Parade Floats, 505 West Foothill Boulevard, Azusa. She reminded all to sign up for the float decorating which will run from December 26th through December 30th. 'REPORTS UPDATES AND ANNOIUNCEMENTS FROM STAFF Rpts/updates Staff City Librarian Maghsoudi addressed Council providing an update of the status of the City Librarian Library building. She stated that the roof damage will cost an estimated $500,000 to update on Lib repair and requested that she be allowed to form a Azusa City Library Foundation in roof order to raise funds for the repairs. It was consensus of Council that the City Librarian be allowed to move forward with the formation of a Azusa City Library Foundation. Community Services Director Guarrera addressed Council first recognizing Randy J. Guarrera Noriega and Robert Velasco for the success of the Tree Lighting Ceremony held this recognition/ evening, he reminded Council of the Christmas Caroling event and announced that the announcements Christmas Boutique held on Saturday, December 2nd was a success, and recognized Lenore Gonzales of his staff for the organization of the event. Mr. Tito Beltran of the Knights of Columbus, addressed Council inviting them to attend T. Beltran its first annual Appreciation Luncheon for the Azusa Police Department and Los Knights of Angeles County Fire Department for their contributions to the community, to be held Columbus Sunday, December 10, 1995, from 11:30 a.m. to 1:00 p.m., at the Azusa Woman's invitation to cncl Club. ' During the following comments it was moved Mayor Alexander, seconded by Motion To extend Councilmember Beebe and unanimously carried by roll call that Public Participation be Public extended to include all speakers that submitted cards. It was then moved by Mayor Participation Alexander, seconded by Councilmember Naranjo and unanimously carried by roll call time that everyone, even cards submitted late, be allowed to address Council during Public Participation. Trisha and Don Robinson, and Todd Buller addressed Council with complaints regarding parking problems on 10th Street in the area of the new Transit Yard. Complaints re: parking in the City Engineer Abbaszadeh responded stating that the City has been in the process of area of transit yard replacing missing no parking signs from the area and the vehicles that were parked there illegally were removed. City Administrator Garcia advised that the issue regarding the parking situation on 10th Street will be investigated, there will be a meeting with the Robinsons addressing their concerns and there will be a report back to Council. The following persons addressed Council in favor of Proposition A, the question of card ' clubs in the City of Azusa: Comments in favor of Prop A Richard Carpenter, Carlos Morgan, Walter Harville, Richard Lowe, Damon Economides, Donald Krug, Ron Legault, and Murray Hirota. The following persons addressed Council in opposition to Proposition A, the question of card clubs in the City of Azusa: Comments in opposition to Sal Pedregon, Burke Hamilton, Kathleen Dodd, Keith Hanks, Betty Thomas, Jessie Prop A Porras, Dick Stanford, Hank Bode, Robert Leyva, Paul Hatch, Ted Garcia, Art Morales, and Ron Williams. 12/04/95 PAGE TWO 1 Councilmember Madrid expressed her opposition to Proposition A. Madrid Councilmember Hardison expressed thanks to all who participated in the Tree Lighting Hardison Ceremony, he displayed the new issue of the Azusa Attitudes Magazine, and urged residents to vote on December 12th. Mayor Alexander, speaking as a resident of Azusa expressed his opinion in favor of Alexander Proposition A. Councilmember Beebe announced the Forum on Proposition A to be sponsored by the Beebe Kiwanis at 8 a.m., Tuesday, December 5th. She reminded all about the Float Reception to be held on December 19th and urged all to vote on December 12th. Councilmember Naranjo expressed his opinion in favor of Proposition A. Naranjo Moved by Mayor Alexander, seconded by Councilmember Beebe and unanimously M-1 & M-2 carried by roll call that items M1 and M2 be brought forward for handling at this time. Brt fwd. PUBLIC HEARING - on an intent to vacate a portion of the southeast corner of Eighth Pub Hrg Vacation Street and Georgia Place. Eighth & Georgia The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of Hrg open publication of notice of the Hearing published in the San Gabriel Valley Tribune on November 24, 1995. City Engineer Nasser Abbaszadeh addressed the Hearing stating that the owners of Digital Printing Systems, to be relocated to 767 and 777 North Georgia Avenue, have petitioned the city for vacation of a portion of the southeast corner of Eighth Street and Georgia in order to enable them to build the required building for its operations. Staff evaluated the request and determined that it may be granted if the developer removes an existing raised island and reconstructs the intersection and the developer has agreed to implement all the necessary changes. He stated that the Planning Commission has reviewed the request and found the vacation in conformance with the City's General Plan. Further, a quit -claim deed in favor of the applicant and a proposed resolution, are being presented for consideration. Testimony was solicited, but none was received. City Engineer comments Testimony After Council discussion, it was moved by Councilmember Beebe, seconded by Hrg clsd Councilmember Naranjo and unanimously carried by roll call to close the Hearing. Councilmember Beebe offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA VACATING Res. 95-C192 ' A PORTION OF THE SOUTHEAST CORNER OF EIGHTH STREET AND Vacating portion GEORGIA PLACE. of the southeast corner of Eighth Moved by Councilmember Beebe, seconded by Mayor Alexander to waive further Street and Georgia reading and adopt. Resolution passed and adopted by the following vote of the Council: Place AYES: COUNCILMEMBERS: HARDISON, MADRID, NARANJO, BEEBE, ALEXANDER NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE 12/04/95 PAGE THREE 1 CONTINUED PUBLIC NUISANCE APPEAL - from abatement cost for the property located at 1190 West Laxford Road, Spyridon S. Papastathopoulos, property owner. Community Development Director Bruckner addressed the issue stating that the property in question has a history of code violations relating to housing and building code, such as renting out mobile homes stored on the property and/or renting out housing with no plumbing facilities. He stated that the issue tonight is the cost for abatement of the nuisance as the issue of violations are in still in the courts. An independent Hearing Officer has confirmed and documented the costs and they have escalated due to the numerous times the applicant has not appeared at administrative hearings, meetings with staff, the District Attorney or the Judge. He recommended that the appeal be denied and the cost of $1,643.86, be confirmed. Cont Pub Nuis Appeal/ 1190 W. Laxford Com Dev Dir comments Mr. Robert G. Left, Attorney for the applicant, addressed Council detailing a series of R. Left, Atty. misfortunes and misunderstanding that the applicant has been experiencing within the for applicant last few years and requested that the cost for abatement be reduced to $600.00, with a Papastathopoulos payment plan of $100 per month for six months. Question and answer session ensued between Mr. Left and Council. Discussion Moved by Councilmember Beebe, seconded by Councilmember Hardison and Appeal denied unanimously carried by roll call to deny the appeal and confirm costs for abatement in cost confirmed the amount of $1,643.86. Further, that a lien be placed against the property until full payment is received, and that the City Attorney and City Administrator meet with Mr. Left to arrange a suitable payment plan. Moved by Councilmember Beebe, seconded by Mayor Alexander and unanimously M-3 brought carried by roll call that item M3 be brought forward for handling at this time. forward Mr. Robert Escalera addressed Council to appeal a Park and Recreation Commission R. Escalera decision of November 16, 1995, denying his request to waive lighting fees at Gladstone appeal of P&R Park for nit time juvenile independent baseball practice. He requested that the lights decision re: fees and ball field at Gladstone Park be donated for their practice on December 5,6,12,13 fees for use of and 14, 1995. Gladstone Pk. Discussion was held between Mr. Escalera and Council regarding the team's budget, Discussion its upcoming tournament, a possible decrease in practice hours, and possible fundraisers to be held by the team. Councilmember Naranjo suggested that perhaps the Azusa Drug and Gang Task Force account will provide funds for use of the ballfield and lights at Gladstone Park. 12/04/95 PAGE FOUR Referred to Azusa Moved by Mayor Alexander, seconded by Councilmember Hardison and unanimously Drug & Gang carried by roll call that the issue be referred to the Azusa Drug and Gang Task Force Task Force which has been identified as a possible source of funding for the use of Gladstone Park. Consent Cal. The CONSENT CALENDAR consisting of Items 1 though 15 was approved by motion 1-15, G-6 of Mayor Alexander, seconded by Councilmember Beebe and unanimously carried by Spec Call roll call, with the exception of item G-6, which was considered under the Special Call portion of the Agenda. Further, Councilmember Naranjo dissented on item G-11. Min appvd 1. The Minutes of the regular meeting of November 20, 1995, were approved as written. Res. 95-C 178 2. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Appropriation APPROVING APPROPRIATION AMENDMENTS FOR FISCAL YEAR 1995- Amendments 96 PURSUANT TO SECTION 2.450 OF THE AZUSA MUNICIPAL CODE. Specs Backhoe 3. Specifications for one Backhoe Loader and Trailer to be used in the Water Loader and Trailer Division were approved and the City Clerk was authorized to advertise for bids. 12/04/95 PAGE FOUR
