' The City Council of the City of Azusa met in adjourned regular session at the above date and time in the Civic Auditorium. Mayor Alexander called the meeting to order. PRESENT: COUNCILMEMBERS ABSENT: COUNCILMEMBERS FA 1 HARDISON, MADRID, NARANJO, BEEBE, ALEXANDER NONE City Attorney Deitsch, City Administrator Garcia, Finance Director Craig, Accounting Services Supervisor Brisco, Community Development Director Bruckner, Acting Chief of Police Garcia, Deputy City Clerk Toscano. Call to Order Roll Call Also Present Pub Part. 'Mr. Robert Leyva addressed Council suggesting that the City send out questionnaires to R. Levya residents of the City through the Light and Water Department to receive ideas and comments suggestions for new revenues and new businesses. City Attorney Deitsch advised that the Public Hearing regarding Appropriation City Attorney Amendments was carried over from the previous meeting and also the Closed Session comments item regarding possible litigation. PUBLIC HEARING - to adopt a Resolution approving Appropriation Amendments for Pub Hrg fiscal year 1994-95. Appropriations Director of Finance Craig addressed the Hearing stating that this is the last closing act of fiscal year 1994-95 and that the department staff and City Administrator closed the books according to plan. He stated that 1994-95 fiscal year was the worst revenue year and that even though sales tax dwindled the City was able to maintain its reserves and restore the General Fund. He advised that departments had reduced its budgets in order to maintain an overall balanced budget. He advised that this Public Hearing was to cover any accounts that were overrun and underrun. He explained some of the funds and why and how the figures came about. Accounting Services Supervisor Brisco addressed the Public Hearing and explained the ' aggregate effect of fund increases and the decreases of the funds. Testimony was solicited, but none was received. Hrg closed 1 L Councilmember Beebe offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING Res. 95-C186 APPROPRIATION AMENDMENTS FOR FISCAL YEAR 1994-95 PURSUANT TO Appropriation SECTION 2450 OF THE AZUSA MUNICIPAL CODE. Amendments Moved by Councilmember Beebe, seconded by Mayor Alexander to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDISON, MADRID, NARANJO, BEEBE, ALEXANDER NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Councilmember Beebe offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 95-C187 CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION Results 12/12/95 HELD IN THE CITY ON DECEMBER 12, 1995, DECLARING THE RESULT AND Special Election SUCH OTHER MATTERS AS PROVIDED BY THE PROVISIONS OF LAW. Moved by Councilmember Beebe, seconded by Councilmember Hardison to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDISON, MADRID, NARANJO, BEEBE, ALEXANDER NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE 12/19/95 PAGE TWO I I I RESOLUTION NO. 95-C 187 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN THE CITY ON DECEMBER 12, 1995, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY THE PROVISIONS OF LAW. WHEREAS, a special municipal election was held and conducted in the City of Azusa, California, on Tuesday, December 12, 1995, as required by law, and WHEREAS, notice of the election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities, and WHEREAS, pursuant to Resolution No. 95-C127 adopted on September 5, 1995, the City Clerk of the City canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A." ' NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, does resolve, declare, determine and order as follows: SECTION I. That the whole member of votes (ballots) cast in the City except absent voter ballots was 4039. That the whole number of absent voter ballots cast in the City was 825, making a total of 4864 Votes cast in the City. SECTION 2. That the measure voted upon at the election is as follows: PROPOSITION A Gaming Club Authorization Act. Shall card clubs in which any games permitted by law, such as draw poker, low -ball poker and panguingue (pan), are played be allowed to operate within the City of Azusa pursuant to a City ordinance regulating gaming clubs? SECTION 3. That as a result of the election, a majority of the qualified voters voting on the measure entitled "Proposition A", did not vote in favor of it, and that the proposition was not carried and shall not be deemed adopted and ratified. ' SECTION 4. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: 1. The whole number of votes cast in the City; 2. The measure voted upon; 3. The number of votes given at each precinct for and against the measure; 4. The number of votes given in the City for and against the measure. 12/19/95 PAGE THREE I I SECTION 5. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. Code Sec. 54956.9 (b) (1). proposed issuance of demolition permit relating to a potential designated Historical site. RECESS: 8:01 P.M. RECONVENED: 8:25 P.M. Recess Reconvened ' City Attorney Deitsch advised that there was no reportable action taken in Closed Session.
