MINUTES OF THE CITY COUNCIL
REGULAR 'MEETING
MONDAY, NOVEMBER 17, 1997 - 7:30 P.M.
-The City Council of the City of Azusa met in regular session at the above date and time
n the Civic Auditorium.
Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order
INVOCATION was given by Reverend Mark Carlson of the First Presbyterian Church. Invocation

UBLIC PARTICIPATION
Ms. Diana Offen addressed Council expressing her views on What's Right About Azusa D. Offen
as follows: she thanked all involved in the Veteran' Memorial, spoke about the comments
upcoming Mediation program between neighborhoods, thanked IBEW for help with the
November 4" election, as precinct walkers and telephone solicitors, she explained the
Target credit card and percentages back to local schools program and thanked Very
Special Chocolates for their part in Make A Difference Day.
Ms. Gina Rico and John Remanaugh, representatives of the Saint Frances of Rome Food G. Rico
Bank, addressed Council requesting donations to the bank. Discussion was held Saint Frances
between Councilmembers, staff and the representatives regarding the feasibility of Food Bank
utilizing CDBG funds, and/or other methods of funding the food bank.
Councilmembers and staff advised Ms. Rico to submit request for CDBG funding for
the next year as it is too late for funding this year. City Administrator advised that
there is currently an amount budgeted for the Food Bank and would check that amount
the following day. All donations could be made to the Saint Frances of Rome Food
Bank by calling 969-1829.

ouncil on behalf of the Congressman, wishing all a Happy Thanksgiving and advised Congressman
at he would take concerns expressed at the meeting back to Mr. Martinez. •. Martinez' Ofs
Ms. Stephanie Mendez, and son, addressed Council and the community thanking all for S. Mendez
painting her house as part of Make A Difference Day. comments
Mr. Raymond Noriega, Gladstone High School Drum Major, addressed Council and R. Noriega
audience requesting donations for trip to Paris, France to represent the City in comments
competition. He asked that donations be sent to 5553 North Fleetwell, Azusa, and that
he could be reached at (626) 815-0125. David Linden of Monrovia Nursery donated
$300 and the City donated $100.
Mr. David De La Zerda, addressed Council requesting permission to place the Nativity D. De La Zerda
Scene in front of City Hall during the Holiday Season; it was consensus of Council that comments
he be allowed to do so and the scene would be completed to coincide with the Tree
Lighting Ceremony on December 1, 1997.
Mr. Ron Legault addressed Council commenting on the Reimbursement Agreement with R. Legault
Monrovia Nursery, Section 8 Housing and the Welfare Assistance Program. comments
' REPORTS, UPDATES AND ANNOUNCEMENTS FROM COUNCIL/STAFF Rpts/updates
Mr. Ed Hlava, Co -Chairperson of the Cultural and Historical Commission, addressed E. Hlava
Council providing an update on the Commission activities which included a proposed Cult & Hist
Historic Preservation Ordinance, an updated list of Historic sites within the City, Commission
attendance by staff and a member to a workshop on CEQA, a meeting with Cheryl comments
Wydell of the State Historic Preservation Office, attendance at 15 day class on Historic
Preservation, review of the draft EIR for the Rosedale Project and a suggestion to plaque
the Covina ditch at Pioneer Park.
City Administrator Garcia advised that Redevelopment item V -B, relating to the City Admin
CC&R's for 850 West Foothill Boulevard, is being pulled from the Agenda and brought comments
back at a later date.
Councilmember Hardison requested clarification of Superfund sites within the City of Hardison
Azusa and the fact that property owners/small business owners are to be held liable for
alleged contaminations on their properties regardless of whether they are current or
previous owners. City Attorney Carvalho advised that she had prepared an analysis
of the situation regarding the options available with regard to this issue and will
redistribute the memorandum.
Councilmember Stanford displayed photographs of the 1997 Citrus League Champions,
Junior Midget Division, and the 1997 Citrus League Champions Gremlin Division. He
thanked Joe Rocha and John Moreno for the fantastic job with the Veterans Memorial
Ceremony. He thanked Community Improvement and Office Montegue for the clean
on Armstead, and offered comments on revenue measures, budget balancing with long
range financing strategies, USC LA County Medical Center and the status of the
facility, and Mc Gurk Company, a small Azusa business, being included in the
Superfund sites although they were not responsible for the pollution.
Councilmember Rocha provided update on people that were prayed for and others that
are still in need of prayer, Mrs. Mintack, Benny Flores, and Anita Mendoza. He
announced that on Saturday, December Oh there will be an organizational meeting for
people who are interested in participating with the construction of the band shell,
further, that In N Out has shown an interest to help with fund raisers. He thanked all
who voted in the November 4`h Special Election, participated in the Budget Workshop
on November IUh, and attended the Veterans Memorial Ceremony on November 1 Ph.
Lastly, he wished all a peaceful Thanksgiving.

Councilmember Beebe announced the Joint Planning Commission/City Council Beebe
workshop on Rosedale Project and Design Review, on Monday, November 24, 1997, comments
'at 6:00 P.M. in the City Library auditorium, the Tree Lighting Ceremony to be held
Monday, December 1, 1997, at 6:00 P.M., before the City Council meeting.
Community Development Director Bruckner responded to questions regarding the Com Dev Dir
Rosedale EIR and advised that the current draft EIR comment are due tomorrow, but the comments
plan has been revised and resubmitted by the developers , if the changes are significant
enough, the EIR will have to be revised, once completed it will be re -circulated for
another 45 day comment period. They will also be responding to comments submitted
on the old EIR, so all comments that have been received will be responded to and be
included in the final EIR and considered by Planning Commission and City Council

Mayor Madrid thanked all for carrying on in her absence from the budget workshop Madrid
held on November Ilyh, and also thanked Lynette and Patrick Clark for the story in the comments
Los Angeles Times on the remodeling job at their home. She announced the Mediation
training on Healing and Peace making skills, this week on Friday, November 21' and
Saturday, November 22, for more information call 812-3221, Captain Karen Pihlak.
The CONSENT CALENDAR consisting of Items III -A through III -J was approved by
motion of Councilmember Stanford, seconded by Councilmember Hardison and Consent Cal.
unanimously carried, with the exception of item III D, E, and G, which were considered Approved
under the Special Call portion of the Agenda.

H. Approval was given to provide an additional $2,000 CDBG funding to the
Visiting nurses Association for the Mano a Mano Program in order to provide an Add'I CDBG
outreach worker for the Azusa Family Resource Center, a one stop location funds to

Councilmember Rocha requested that until the flashing beacon is installed at the corner
of Vernon and Eleventh Street, that extra patrol and possibly the radar trailer be brought Rocha
back to that area on Vernon. Chief Broderick responded that this could be done. comments
Moved by Councilmember Rocha, seconded by Councilmember Stanford and
unanimously carried that the specifications for the Solar Powered Pedestrian Flashing Specs Flashing
Yellow Signal System for Vernon Avenue and Eleventh Street be approved and to Yellow Signal
authorize the City Clerk to advertise for bids. System approved

Utilities Director Hsu responded to Councilriiember Hardison's question regarding the
disposal of old equipment removed at the Azusa Substation, stating that most of the
equipment could be salvaged for strip metal and could be sold to other countries.
Councilmembers noted that the funds to be received from the sale of the surplus
equipment are unallocated at this time and suggested that they be used during the
Centennial for public art.
Moved by'Councilmember Hardison, seconded by Councilmember Stanford and
unanimously carried to declare the old circuit breakers as surplus; authorize staff to
dispose of them by accepting the offer of Berg Power Engineers to dispose of the old
equipment.

'ORDINANCES/SPECIAL RESOLUTIONS
Community Improvement Manager addressed Council explaining the proposed ordinance
relating civil fines and penalties, stating that it stems from SB814 which turns violations
into infractions and could be issued fix -it tickets. It allows a civil method with a less
cumbersome process. Discussion was held between Council and staff regarding
penalties, building code violations, pre -warnings, procedure, hearings, and amount of
penalties and who will set them. City Attorney Carvalho advised that she would come
back with additional information on specific nature on fines and penalties.

ADMINISTRATIVE PROCEDURES GOVERNING THE IMPOSITION,
ENFORCEMENT, ADMINISTRATIVE REVIEW AND COLLECTION OF
PENALTIES FOR VIOLATING PROVISIONS OF THE AZUSA MUNICIPAL
CODE.
,Moved by Councilmember Stanford, seconded by Councilmember Hardison and
unanimously carried by roll call to waive further reading and introduce the ordinance.

Councilmember Hardison voiced concerns regarding the method for gaging the weight Hardison re:
of material that is being extracted from the Rock Quarries. Rock Quarry
Mr. Tom Sheedy of Azusa Rock responded explaining the current method for weighing T. Sheedy
the material and stated that taxes are levied on the commercial material used, by the ton. response
He explained that there is a lot of waste associated with the material and that it is not
sold and therefore is not taxed.
Discussion was held between Councilmember Hardison and Mr. Sheedy regarding the
current method of weighing the material extracted, a method of weighing on the
conveyor, reliance plant material, the point of excavation, he stated was from Azusa
only, and the status of Irwindale site. Mayor Madrid stated that she would like to see
a report on how much tonnage is and has been removed, extracted every month and
over time, and an analysis of same and on the question of "should the clay be taxed?"
It was consensus of Council to recess to Closed Session to discuss the following:
